05-14-68 BZA Minutes i) 1 REGULAR MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS May 7�.�, 1968 A regular meeting of the Golden Valley Board of Zoning Appeals was held Tuesday, May 1�., 1968 at 7:30 p.m. at the Golden Valley Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota. Chairman Christiansen presided and the following members were present: Anderson, Bruch, Hoover. Also present were Dan Lynch, Building Supt. and Jon Westlake. APPROVAL OF MINUZ'ES MOVED by Anderson, seconded by Bruch, unanimously carried to approve the minutes of April 9, 1968. 68-5-10 5730 Wayzata Boulevard (13) Natalie Stuart The petition is for the waiver of Section 13.02 (D) for 10� of landscaping to a sideyard landscaped area of 0� off the East property line from the rear of proposes building to the Nort�h property line. (requir�d 10� of landscaping) 13.02 (D) for 101 of landscaping to a sideyard landscaped area of 0� off the West property line from the rear of proposed building to the North property line. (required 10� of landscaping) 13.02 (D) for 10� of landscaping to a rear yard landscaped area of 0� off the North property 1ine. (required 10� of landscaping) 5.0� for 15' of a proposed building to a sideyard setback of 5� off the West property line. (required 20t for building setback) MOVED by Anderson, seconded by Brucn, unanimousl.y carried to approve the waiver with the following stipulations: l. The proposed structure will conform to the same front yard setback as the buildings on each side which are set back 50� from the R/W line of Town Road. 2. No parking within the 50► setback. 3. The landscaping shall have a protected border because of parking up to the property line from adjacent parcels. Also, the Board noted an easement agreement on file with the Building Department for road purposes covering access to the rear of the property from Xenia Avenue. 68-5-23 715 Co�orado Avenue South (13) B, J. Schwartz The petition is for the waiver of Section 5.06 of 1�7� of landscaping to a front yard landscaped area of 28� off Laurel Avenue. The remaining area is not bituminous for parking and access in maneuvering of trucks and trailers for loading and unloading of goods. (required 75� of landscaping) (Excerpt from Board of Zoning Appeals 11-1l�-67) ��After considerab�e discussion, the petitioner withdrew his request and is going to work out a landscaping p1an. It was poi.nted out that the vegetation should be of a certain size to provide screening now, and maintain its screening effect through�u:t the seasonal change.�� � � Board of Zoning Appeals May ]�., 1968 Page 2 MOVED by� Anderson, seconded by Bruch, unanimously carried to deny the request. The Board noted the petitioner is asking for the same waiver of landscaping as previously presented in order to receive a release on his landscaping bond held by the Building Department. It was pointed out by the Board that the 75� of required landscaping was noted on the survey at the time the building permit was issued, which would not warrant the justification of the �8� waiver. The Board also noted the plantings are not sufficient to provide screening, and would take several years before it is dense enough to provide protection for the area North of Laurel, which has clear visibility of the sight. With the present zaning north of Laurel being Qpen Development and Residential, it was the opinion of the Board that this would be a precident setting action in this area. 68-5-23 5735 Lindsay Street (12) Lakeland �gineering Equipment Co, The petition is for the waiver of Section 5.�5-A (1) for 2�� of a proposed building ta a front yard setback of 50�. (required 7 � for building setback) �.05-B , for l�Ot of a proposed building to a sideyard setback of 60� . (required 10(�� for buildi.ng, setback) MOVED b�; Hoover, secoz�ded by Anderson, unanimously carried to approve the waiver with the stipulation that the parking area be moved further to the South on the East side of the proposed building so as not to infringe upon the required green area of the Residential zoning adjacent to their parcel. The Board noted in granting the sideyard waiver it allowed trucks to maneuver an the i�est side of the proposed building, not on the East side. It was also pointed out that the larger portion of land on the East side of this parcel is zoned for Radio use which would allow access in maneua�ering of trucks and trailers to within 10 feet of the property line, which is readily visible from the Residential area to the East. 68-5-2� 1710 Douglas Drive (11) A. A. Hardy and Associates The petition is for the waiver of Section 13.02-C for 10► of landscaping to a side yard landscaped area of 0� off the North property line. (required lOt of landscaping) (Excerpt from mi.nutes of the Golden Valley Planning Commission May 13, 196�) "The Ordinance Committee found the following: l. Land to the south wi11 probable go to a heavier use; multiple dwelling or business and professi�nal office, This land abuts the railroad and is not shaped for easy platting to residential lots. 2. The existing residence to the south is 90 feet from the petitionerrs lot line. 3. The Committee recommends that a 20 foot waiver to a 30 foot setback be granted on the south only, adjacent to the Open Development Zone. The Ordinance Committee unanimously recommend.s approval of the 30 .foot setback along the south side adjacent to the Qpen Development area, stipulating that Village Ordinances and Regulations sha11 be complied with in all other respects.'I 59 Board of Zoning Appeals May ].la, 1968 Page 3 The petitioner asked to have this item deferred pending further stucjy of his paxcel of land. 68-5-25 1000 Zane Avenue North (12) Lester Company The petition is for the waiver of Section $.05-A (1) for l�Q� of a proposed building to a front yard setback of 35� . (required 75� for building setback) MOVED by Bruch, seconded by Hoover, unanimously carried to approve the waiver. The Board noted the parcels surrounding this parcel except North of Lindsay Street axe zoned light Industrial. When the area North of Lindsay Street is zoned, it will place this parcel in conformance.
