A regular meeting of the Golden Va11ey Board of Zoning Appeals was held
Tuesday, Ju.ne lI, 196� at 7:30 p,m, at the Golden Valley Civic Center,
7800 Golden Valley Road, Golden Va11ey, Minnesota. Chairman Christiansen
presided and the fo3lowing members were presents: Jensen, Bruch, Hoover.
Alternate: Swedberg. A1so present was Planning Director, Otto Schmid.

on this petition due to the fact that the petitioner was not present.

MOVED by Bruch, seconded by Swedberg �o recommend that the building permit
be issued and that no waivers be granted in order ta leave tY� building in
a non conforming statu5. The motion carried unanimously.

Mr. David S�nith and Mr. Earl Wilson were present to e�lain the petition.
It was n.oted that the 1ot to the east of Ntr. Smithis lot is village property
and therefore, could not be purchased. Mr. Glilson pointed out that the pre�nt
50 foot lot is buildable as is, but that Mr. Smith would like to construct
a home with a two car garage, and thereby be in keeping with the caliber of
homes in this area.
The Board, in discussing this petition, requested that the following additional
information be obtair4ed:
l. The existing front yard setback along Plymouth Avenue.
2. An up-to-date Registered survey,
MOVED by Bruch,, seconded by Jensen, carried unanimously, to defer action on
this petition until the Ju�y 9, 1968 meeting,
Mr. Go r don Boyer an.d Mr. Willard Lee were present as objectors to the
proposed waiver.

Mr. McKenzie and Mr. Christiansen were present to e�alain the petition. They
stated that a buildin.g permit was issued and work begun on the proposed porch,
and, only after the footings had been dug was it determined that waivers were
needed. They are askin� for the waivers so that the porch can be constructed
in line with the rest of the house,
MOVED by� Hoover, seconded by Bruch, to grant the following �taivers on the
existing structures: Setbacks to 32.5 feet an the N. W, corner of the existing
home; 2l�.88 feet on the N. E. corner of the existing home; 27 feet on the N.w
corner of the existing garage; 22,5 feet on the N. E. corner of the existing
garage. (Al1 measurements from Glenwood Avenue) In addition, the following
waivers on the existing garage from Ellis Lanec Setbacks to 19 feet on the
N. E. corner of the existing garage and 20 feet to the S.E. corner of the
existing garage. (35 foot setback required in all instances sighted) . This
motion caxried unanimously.
It was f`u.rther MOSTED by Bruch and seconded by Swedberg, to grant the following
waivers on the proposed porch: A waiver of 10.12 feet to a setback of 21�.88
feet on the N. W, corner of t,he proposed porch, and a waiver of ]..1a. feet to a
setback of 21 feet on the N. E. corner of the proposed porch, (All measure-
ments taken #rom Glenwood Avenue) . This motion carried unani�ia�sly.

The petition is for the waiver of Section
3.07-(3) for 1.5i af a proposed residence to a side yard setback of
13.�t off the East property line. (required 15' sideyard setback)
3.07-(3) for 1.5� of a proposed residence to a sidayard setback of
13.5t off the West property line. (required 15i sideyard setback)
It was nated that the required registered survey �as r_o� submitted.
Mr. Douglas Kluge was present and explained tb.at due �o the nati?re of this lot
and the existing houses in this area, the sight lines from his n.ome would be
obstructed unless he was allowed to construct the home as he requested,
The Board discussed this request at length and observed that this was an unusual
lot and that certain problems did exist in regards to topography and proximity
of the existing homes. However, the majority of the Board believed that �he
proposed house could be modified to meet the ordinance or a new design adopted
which would fa11 within the setbacks. Tt was also brought to the attention of
the Boaxd that a previous waiver request for 5 feet at 2�00 Valders Avenue No.
was denied by the Planning Commission on September 13, 1965, and by the Village
Council on October 5, 1965, for the reason that '�this house is not appropriately
designed for this 1ot. A fu11y conforming plan is entirely feasible. ��
MOVED by SvJedberg, seconded by Bruch, to deny the waiver request on the grounds
that no hardship exists. The motion carried with 3 yea :and 2 nay.

The petition is for the waiver of Section
3.07-{�) for 10� of a proposed residence to a front yard setback of
25� off the South 1ot line, which is Plymouth Avenue.

�1r. EarZ Wilson. was present to explain his request, He said that he would like
to build a two story house with attached garage facin� Castle Court, The reason
for this is that the house would face existing houses and that ingress and
egress from the garage would not take place on Plymouth Avenue,
The Board no�ed that this lot is of the required 100 foot width and that it
would be possibl,e to build a ho�ne in conformance with the existing requirements
of the code.
MOVED by Hoover, seconded b� Bruch, carried unanimousl,y to deny the waiver as
no hardship exists.

Ik�. B1oom was present to explain. that the waivers he is requesting are on the
exis-ting home which he was unaware was in non-conformance. The new addition
he is contemplating would be constructed withi.n the requirements of the code.
Mr. Laird, of' �..�09 Beverly, was present and expressed no objection to the
waiver requests on the existing home.
I�t was brought to the attention of the Board and Dr. B1.00m that a measurement
from the garage to the property line alang Ardmore is not shown on the survey,
The Board instructed Ilr, Bloom to obtai.n this measurement from his surve�ror.
It was ��IOVED and seconded to defer this item to the July 9 meeting.
The Board agreed ta hear the following item noting that an application had not
been completed and a Registered Survey �ras not availab�e.

It was suggested that Mr. Hlac�y obtain an additional 7 .feet from his neighbor,
Mr. Conner, who was agreeable to this suggestion.
The Board did not take action on this item.
