11-12-68 BZA Minutes �� REGiTLAR MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS November 12, 1968 The regular meeting of the C�lden Valley Boaxd of Zaning Appeals was held Tuesday, November 12, 1968, at 7c3� p.m. at the Golden Valley Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota. Board appointed chairman pro tem Anderson presided and the following members were present: Bruch, Hoover. Alternate: Swedberg (present for a portion of the meeting). Also present, Building Inspector Dan Lynch; Jon Westlake; Carol Wachter. APPROVAL OF MINUTES MOVID by Bruch, seconded by Hoover, unanimously caxried to approve the minutes of October 8, 1968. 68-11-53 130 Edgewood Ave. So. (18) Nilsen-Erickson Inc. The petition is for the waiver of Section 3.07-(1) for 6� of an existing residence to a front yard setback of 29� off the South property line, which is South Cortlawn Circle. (required 35� front yard setback) 3.07-(l) for !�� of a �roposed residence to a front yaxd setback of 31� off the South progerty line. This addition will extend West 2lt� from the Southwest corner of the existing structure. (required 35' ) Mr. Lee Martin appeaxed before the Zoning Boaxd to explain his request. Mr. Erickson of Nilsen-Erickson, Inc, was preser�t also to answer questions for the Boaxd. MOVID by Bruch, seconded by Hoover to recommend that the building perm:i.t be issued and that no waivers be granted in order to leave the building in a non conforming status. The Boaxd noted the requested waivers are on the existing residence and not on the new construction. In all of the zoning districts, every building hereafter erected or structurally altered shall be located on a separate lot or parcel of record, and in no case shall there be more than one (1) principal building on any one such lot or parcel. The words "principal building" sha11 be given their common ordinary meaning, and in the case of doubt or in any question of interpretation, the matter shall be referred to the Golden �alley Board of Zoning Appeals. (Ord. No. 263, 6/20/67)�! The proponent was present to explain his request to the Boaxd. He stated that the building is primarily a prefabricated type of structure -- it measures 4' x 9' and takes very little space. He feels that it has an aesthetic value for the shopping center. They provide one-day photo service which he feels is a service to the community. At the present time, they have similar buildings in Wayzata, Trlhite Bear, Minneapolis, West St. Paul -- in fact, they will have 2� in the greater metropolitan area. MOVED � Hoover, seconded by Bruch, carried unanimously to deny the petitioner�s request. The Boaxd noted the additional traffic would aggravate an already bad traffic problem. Mr. Eugene Da� appeaxed before the Boa.rd and presented the request. They p1an to remove the old garage-type sheds that were present when they moved in five years ago. The Board notecl that other requests in this area have come before them, and the proponents have tried to eomply more favorable with the code. It was felt in this request that an upgrading of the property through aesthetics would coincide more to other parcels which the Boaxd has ruled on in this area. These parcels are 5730 Wayzata Boulevard and 900 Turners Crossroad So. The Boaxd have particular attention to the East portion of this property along Xenia Avenue. (required 35' for building) Mr, Scheunemann presented pictures showing the proposed garage and breezeway. MOV� by Hoover, seconded by Bruch, carried unana.mously to a11ow the petitioner at b125 tiJynnwood Raad to construct his proposed addition, so that his front yard setback will not exceed the front yard setback of the closer of the two houses adjacent to this paxcel, which axe 6105 Wynnwood Road and 2380 Colorado Avenue, as measured from the North property line. Also, t�e Boaxd directed the Engineering �9epartment of Golden Valley to varify the shorter distance from the North property line to the existing structures. 68-11-61 935 17ecatur Avenue No. (21) Premier ftealty, Inc. - Ryan Const. Co. The petition is for the waiver of Section 7•055 "In no case shall loading or unloading berths or areas be situated on the street side of any building:" {�.sting off Decatur Ave. ) Bob Brenny of Premier Aealty and Jim Ryan of Ryan Construction Company were present to explain the request to the Board. The proponents stated the loading dock will be screened from the street, and there will b� landscaping throughout the parking areas. � �� Board of Zoning Appeals November 12, 1968 Page 6 The Board noted that this parcel is a corner lot which has street frontage on two sides, a spur track on the West side, and the building designed for future expansion to the South. MOVED by Bruch. that they approve the waiver of the Ordinance and that additional consideration be given to e�ctensive green axea treatment. Motion failed for want of a second. MOVED by Hoover, seconded by Bruch, that the Board of Zoning Appeals approve the petitioner�s request for the waiver with the stipulation that maximum foliage be planted in the landscaped areas with particulax emphasis on the area screening the loading berth so that the loading area wi11 not show from the street. The size of the foliage will be of a height that will provide screening now for the loading area and retain its foliage throughout the seasonal change. It was further stated by the Board that green islands be interspersed in the parking lot to break up the sea of black top. All members voted in favor of the motion except':Alternate Mahlon Swedberg, who voted nay. The motion carried.
