12-10-68 BZA Minutes �� REGULAR MEETING OF THE GOLDEN VALLEY BOAFtD OF ZONING APPEALS December 10, 1968 The regular meeting of the Golden Valley Board of Zoning Appeals was held Tuesday, December 10, 1968, at 7:30 p.m. a� the Golden Va11ey Civic Center, 7800 Golden Valley Road, Golden Va11ey, Minnesota. Chairman Christiansen presided and the �ollowing members were present. Bruch, Hoover and Jensen. Also present: 19an Lynch, Building Inspector; Jon Westlake, Code Administrator; Carol Wachter, Secretaxy. APPROVAL OF MINUTES MOVED by Jensen, seconded b�.� Bruch, unanimously carried to approve the minutes of November 12, 1968 as corrected. 68-12-60 6125 Wynnwood Road (11) Donald J. Scheunemann Note: The Engineering 13epaxtment has verified the distance and the petitioner is asking for a lesser waiver. (See minutes November 12, 1968) The petition is for the waiver of Section 3.07-(1) for 3' of an existing residence to a front yard setback of 32'off the North property line. (required 35' for building) 3.07-(1) for 5� of a proposed double ara e to a front yard setback of 30� off the North property line. (required 35' for building) Mr. and Mrs. Scheunemann were present to e�lain the request to the Board. It was noted by the Board that the Engineering Department had verified the distance as to the November 12, 1968 meeting. MOVED by Jensen, seconded by Bruch, unanimously carried to grant a 3' waiver to a setback of 321 off the North property line on the existing and future structure. Because of the change in the request from the previous meeting this motion will supersede the action taken by the Board at the November 12, 1968 meeting. 68-12-62 2221 Toledo Ave. No. (5) Donald W. Grossenberger The petition is for the waiver of Section 3.02 ��The following uses and no others sha11 be permitted in the Residential �istrict: 1. Country Estates and one-family dwellings; except that two-family dwellings shal.l be permitted on lots whichz (a) Directly abut a heavier use district. or (b) Are directly across a street from a Commercial Light Industrial or Industrial District." Mr. 9�onald W. Grossenberger was present to submit his request for a dout�le bungalow to the Board. Mrs. Eugene Schweim, 2201 Toledo Avenue, was present to object to a double bungalow being built on this site. 89 � _ Board of Zoning Appeals December 10, 1968 Page 2 The Board noted that the lot to the West of this parcel supports a double bungalow, and the remaining adjacent paxcels are singZe farnz.ly dwellings. The Boaxd felt in granting this request it would affect the single family atmosphere. It was also pointed out that if a small portion of the lot to the south was combined with this paxcel it could be divided into two single family lots. MOVED by Hoover, seconded b�r Bruch, carried unanimously to deny the petitioner�s request. 68-12-63 715 Florida Ave. So. (z8) Volp Construction Company The petition is for the waiver of Section 7•055 "In no case shall loading or unloading berths or areas be situated on the street side of any building.�r (F.�cisting off Laurel Avenue) Mr. Glenn Burnett of �olp Construction Company presented drawings to the Board. He explained that they would provide 10' to 12� screening for the loading area off Laurel Avenue. Mr. K. G. Partridge of Partridge Lumber Sales, 700 Florida Avenue, app�ared and stated he had no objection to the proponent's request. The type of screening that is to be used was discussed by the Board. The Board specified evergreens at least 10� to 12� in height, with screening both on the North and a portion of the East of the property (the East to provide screening as you would �€iew the site from Laurel Avenue). This specific screening would be by the Northeast corner of the building where the dock axeas are visible from Laurel Avenue. MOVED by Jensen, seconded by Hoover, that the Bo�d grant the request for the waiver subject to planting and screening suitab�e to the Council. All present voted in favor of the motion except member Bruch who abstained. Review By-Laws of -the Golden Valley Board of Zoning Appeals The Board reviewed the By-Laws, and the following change was made. The change is as follows: Article �i - Cfficers 1. The Vice-President of the Village Planning Commission shall be a member of the Board of Zoning Appeals. The Chairman shall be appointed from among the members of the Boaxd of Zoning Appeals. In his absence, the Secretary shall ca11 the meeting to order and those members present shall elect a Chairman pro tem and he shall assume the duties of the absen� Chairman. The Board looked favorable upon the above change and proposect approval of the amended By-Laws at the next scheduled Board of Zoning Appeals meeting. The Board wishes to have the following entered into the minutes: Board member Hoover pointed out to the Boaxd members that in the larger sites, according to the present Ordinance, we require 35 feet of landsca�ing on the street side, and 10 feet of landscaping on the side and rear yards, leaving a large area of b�acktopping 9� Board of Zoning Appeals December 10, 1968 Page 3 from the landscaped area to the structure. A general discussion followed in which the Board directed the Chairman, who is a representative of the Planning Commission, to inform the Planning Commission in regard to a possi�.e. Ordinance change, where green areas be interspersed in the parking 1ot to break up the vast area of blacktop. There being no further business the meeting adjourned at 10;20 P.M.
