The regular meeting of the Golden Valley Board of Zon3ng Appeals �ras held
�izesday, February 11, 1969, at 7:30 p.m. at the Golden Va11cy Givic Genter,
780� Golden Va11ey Raod, Gc3lden Va11ey, Minnesotra. Board appainted Ck�ai�-
man pra tem Anderson presided and the following members �rere presen�:
Bru.ch, FIaover, Jensen. Alternate: Swedberg. Members absent: Fran�en.

MOTTED by Hoover, seconded by Jensen, uaanimousl� carried to apprav�e the
minutes of December 1�, 1968.

The Board noted the Qillage Council minutes of June 20, 1967 approving an
appeal for this parcel in which a different praponent was asking for a
waiver on the South side.

A general di.scussion followed in which Mr. Hawks explained tY�e proposed layout
plan and �tr. Herman expZained the proposed structure to the Board. Mr. Hawks
stated that it was the original int�nt to cornply t�i.th the Urd3.na.nce. However,
after soil �tes�s, econorn3_cs wauld not allc�+r the building of the structure i.n

Mr. Porter was present to explain his request to the Board. So�ne of the more
predominant points 3n �r. Port�r�s presentat3on to the Board are listed below:
1. Ths proposed addition is lc�cated on the best soil conditions.
2. Becaus� of the weight of the netAr maehines and the vibratiar� ereated
by the machines, it is important to place the machines on the best

request. The Baard noted the area to the West of this parc�l is nnt c3evel.aped.
In view of this it was felt the request regarding the West property lin� would
set a precsdent for �l�e undeveloped area. It was also noted that the propox�ent
did not submit a survey with the location of the present structur�, therefore
it is diff5.cult tp knc�r if the waivers as requested are correct.

Northfield and Southern Railroad.
The Baard noted this is an �.pgrading Qf the area, par�ieularly to the parcex
and to th� stzucture itself.

The Board reviewed the By-Laws from the m�eting of Decemb�r 1.0, 1968, and
the following chang�s �re made:
Article' II - Officers
1. The gice-President of the Village Planning Cor�r►ission sha�.l be a
member af the Baard of Zoning Appeals. The Chairman shaZl be eleet�d
from and t� th� members of the Board of Zoni.ng Agpeals. In his
absence, the Secretary shall call the meeting to order and thase
members present shall elect a Chairmars pro t,em and he shall assum�
t,Yie duties of the absent Cl�airman.
The &�ard looked favorable upon the above changes and propc�sed approval of
t�ie amended By-law at the n�t scheduled Board of Zoning Appea].s meeting.
Approval of the Filing Fee
Th�; Board review�d Section 17a..48 of the Zoning Code and recommended the
following change. To read as follows:

Appeals to the Board of Zoning Appeals may be t�k�n by any� a�f�cted
person upon the filing of a petition with the Village Qrdinance
Administrator. 5uch petitions shall be heard at the next re�zlar
- monthl.� meeting af �he Board of 2oning Appeals provided that petitions
must be rec�iv�d by the Secretary at least by the last working day
of the month prior to the day of the me�tin� for which a hearin� is
seh�du.led. Tf i� do�s not foll.crw this procedure it shall not be
entitled to be heard until the following regular monthly meeting.
' Eaeh petition shall be comprised of a registered survey of the
buildings thereon, a completed petition form as shall be provided
by the Village, with a $50.00 filing fee except for single family
