Swedberg, an alternate member, was present. LeRoy W. Anderson, Chairman of the Board, presided and Jan L. Westlake, Secretary of the Board of Zoning Appeals� acted as Seeretary af' the meeting. The first order of business was the cansideration of the minutes of the meeting of the Boaxd held on June 1f3, 1969, copies of whi.ch had been distributed to the Board. It was moved by Robert Hoover, seevnded by Mahlon Swedberg, and unanimously carried tca approve the minutes of the meeting held on June lf�, 1969. The Boaxd in discussing this request pointed out the definite variations in terrain on this parcel. , A motion was moved by Morton Silverman, seconded by Mahlon Swedberg, carried unanimausly to grant a wai.ver of Section 3.07-1 for 15� on a praposed double garage �o a front yard setbaek of 20� off the West property line. (This wa.iver as granted is for the proposed ga.rage only, which is to be located on the Southwest por�ion of the parcel.) It was then moved by Robert Hoover, seconded 'by Morton Silverman, urtanimously carr�.ed, to place the following stipulation on the waiver of the structure as granted above. The Board also painted out this is a standard 100 foot Iot, and the requested waiver is on the South side where no hardships exist. The Board in discussing this request pointed out that this site is zoned Ccsmmereial, to which A�apendix I Section �.06 E and 5.0lt of the Zoning Code wauld apply. � i7 Board of Zoning Appeals July $, 1969 page !� Board member Paul Senstad stated at the ti,me the Ordinance Committee reviewed and upgraded the service station Ordinance he was chairman of the Ordinance Committee. Mr. Senstad pointed out the standards are striet on purpose. One of the items that was of concern at that time to the Comm�i.ttee was the ma�ter of trailers and trucks and other �ypes of rental equipment, The intent of the Ordinance is that i£ you rent or sell products in a Commercia�. d.istrict the placement shall be under a roof. The Baard was in complete agreement �hat this is the intent of the Ordinance. In all of the zoning districts, ever� bui.lding hereafter erected or structurally altered shall be located on a separate lot or paxcel of record, and in no case shall there be more than one {1) principal building on any one such lot or pareel. The words "principal building" sh�.l be given their co�nmon ordinary mean3.ng, and in the case of doubt ar in a�,y ques�ion of interpretatian, the matter shall be referred to the Golden Valle,y Board of Zoning Appeals. Messrs. Frank J. Ideuman ar�d Fred R. Jacobberger, an attarney representing this request� e�lained the reasons for the location and placement of the proposed kiask. The Board in reviewing this request noted waivers were �ranted at the August 1968 meeting for �arking. The present proposal will take up additional. parking space which the proponent wi11 compensate for on anather part of �he site. This added paxking without the propased structure woul.d comply closer to standards. The Board further pointed out that it is elear the petition is for the waiver of Seetion 1.�3. In that this proposed strueture is a principal � building for this operation, there is no connection between this structure arnd the present building on the site. It is a separate entity and a busi.ness by itself� whether it be a franchise, lease business, etc. Therefore, i� is a princzpal building for that particular business. It was moved by Paul Senstad, seconded by Mahlon Swedberg, carried Lmanimously, to deny the request. The Board pointed out the following in discussing the reque�t: . 1. There are overhead service doors on the North, South, and East of the proposed structure. 2. The propo5ed structure has street frontage on a1.1 four sides. 3. There is a loading area an the We�t side of the building for parts service. �t. The loading area on the West side of the structure ig far enough back so that it will not affect traffic patterns or green area. It was moved by Paul Senst�d, seeonded by Mortnr� Silverman, to approve the request. The motion earried with !t yeas and 1 nay. The Board in a general discussion pointed out they have received several. requests for the e�ansion of single car gara�es. In view of this, the Board wou3d like the Planning Commission to take a closer laok at the Qrdinance with respect to double garages on r�esidential lots where not only the residence but the area itself would benefit.
