MINUTES OF A ftEGULAR MEETING OF THE GOLDEId VALLEY BOARD OF ZONING APPEALS DECEMBER. 9, �9b9 The regular meeting of the Golden Vall.ey Board of Zoning Appeals was held Tuesday, �7ecember 9, 196g, at 7:30 P.M. at the Golden Va1Zey Civic Center, 7800 Golden Va11ey Road, Golden Valley, Minnesota. The following Hoard members, , constituting a quorum, were present: LeRoy W. Anderson Donald E. �ranzen Dr. ftobert R. Hoover Patil. D. Senstad LeFtoy W. Anderson, Chairman of the Baard, presided and Jon I,. Wes�lake, Secretary of the Board of 2oning Appeals, acted as Secretary of the meeting. The first order af business was the consideration of the minutes of the meeting of the Board held on Novembsr 12, 1969, copies of which had been distrib- uted to the Board. It was moved b�r Paul. Sen�tad, seconded by Robert Hoover, earried unanimously, to approve the minu�es of the meeting held on November 12, 1969. The Chairman then brought before the meeting the following requests far waivers: b9-12-37 2700 Major Ave. No. (!t) ftobert C. Van Hoe The petition is for the waiver of Section 3.�7 (1) for 13.17� on a proposed addition to the present garage to a front yard setback of 21.�off the South property line, also known as 27th Ave. No. (Required 3S') 1l�.f32 for the expansion af a nonconforming use, specifically, expansion via the construction of an 8� x 22� addition to the Sau�h of the present garage. Mr. Robert C. Van Hoe was present �o e�lain his request ta the Baard. The Board reviewed the discussion in reference to this request which was presented at the November 12, 1969 Board meeting. It was then moved by Paul �enstad, seconded by I7onald Franzen, unanimously carried, tQ gra.nt a waiver of Section 11t.02 of the Zaning Code for the expansion of a nonconforming use, specifically, expansion via the construction of an 8� x 22� garage addition to extend from the South of the presen� garage. �,7.so, a waiver of Sec�ion 3.07 (1) for 13.17� on a proposed addition to the present gaxage. T�tis waiver was graz�ted under the condition that it does not apply to any future structures nor to any future construction whatsoever, but only to the specific construction with respect to whieh an application for building permit is now being made. 69-12-I�2 7�os Gountr� Club Drive {17) France Ave. Nursing Home - Leo Zaworski The petition is for the waiver of Section 11.43 That no building sha11 be erected to exceed two and one-half stories in height. Paul Pink of G�ngold-Pink Architecture and Bill Kiefer of Skyl.ine Builders Inc. were present to make the request to the Board. Mr. �ciward D. Jordan, a property owner to the North of this parcel, was present as an interested party. No action was �aken by the Board because the parcel is presently being rezoned .for an Institutional (i-3) category. 69-12-lt3 8200 Wayzata Boulevard (23) Brookview Muni.cipal Golf Course The petition is for the waiver of Section 11.06 for 1�2� an a proposed golf starage building to a sideyard setback of 8� off the East property line. (Required 50ij Mr. John L. Brenna explainec3 the reason for e�cpanding the present storage building to the Boaxd. Messrs. John I. Noer and Richard M. Fox asked questions and stated their views wi�h respect to the request. The Board pointed out because of the size of this pareel there should be a workabl.e so3ution which would not require a variance. A1so, the Baard noted the lack of a definite hardship with respect to the request, It was moved by DQnald Franzen, seconded by Paul 5enstad, carried unanimo�zsly, ta deny the request. b9-12-ltl 8{70 Pennsylvania Ave. So. (18) Possis Machine Inc. . The petitian is for the waiver of Sectian 7.0�1 (�.OSA.I) for 25+ of landscaping to a front yard landscaped area of 50� off the North property line, also known as Laurel Ave. (Required 75' ) 1.03 Lot of Record. In a11 of the zoning districts every bui.lding hereafter erected or strueturally altered sha11 be located on a separate lot or parcel af record, and in no case shali there be more than one (1) principal buildi.ng on any one such lot or parcel. The words "principal building" sha11 be given their eommon ordinary meaning, and in the case of doubt or in any question of interpretation, the matter sha11 be referred to the Gol.den Valle� Board of 2oning Appeals. Messrs. Marlyn S. Glatfelter of Possis Machine Inc., Otto Scrunid of Urban Planning & Design, Sne., and Robert F. Brenny of Premier Realty were present to explain the request to the Board. N1r. Gordon I,. Prchal, an interested property owner to the Nor�h of this parcel, was present. The Board in reviewing this request noted that the request for two buildings on one parcel wi.l1 be resolved when the proposed structure will be attached to the present structure. It was moved by Paul Senstad, seconded by Robert Haover, carried unan- imously, to approve Section 1.Q3 of the Zoning Code. (This waiver as granted a�plies to the section of building which �rhen completed will become a single structure.) 1 �� Board of Zoning Appeals December 9, 1969 page 3 Tt was then moved by Paul Senstad, seconded by �onald Franzen, to deny Sectian 5.05 A-3 for 25� af landscaping to a front yard landscaped area of SO' off the North property line due to a lack of hardshi.p with respect to this particular request. The motion carried with 3 yeas and 1 nay. .In view of the Brookview Municipal Golf Course request� the Board discussed in general parks and other Village-owned property. Due to Qrdinance changes, purchase af property that is no�confarming to present Ordinance5, etc., the Board is asking �he Villa�e Manager to have a report drawn up �hat wilZ. contain a survey of the noncanforming situations with r�spect to setbacks of structures and green areas of Village-owned property. The Board wi.11 continue this discussion at the February 1970 Board of Zoning Appeals meeting.
