02-10-70 BZA Minutes � � � MINUTES OF A REGULAR MEETTNG OF THE GQLDL"N VALLEY �AR,D OF ZflNIl�TG APPEALS FEBRUARY 10, 1970 The regular meeting of the Golden Va11ey Board of Zoning Appeals was held Z�.iesday, February 10, 1970, at 7:.30 P.M. at the Golden Valley C�vic Center, 7800 Golden Valley Road, Golden Valley, Minnesota. The following Board members, constituting a quorum. were present: LeRoy W. Anderson Donald E, Franzen Paul D. Senstad Morton D. Silverman Mr. D�n. J. Zynch, Chief Building Tnspector, was present at the invitation of the Board and Jon L. Westlake, Secretary of the Board, was present. LeRoy W. Anderson.. Chairman of the Board, presided and Jim M. Tngemunson acted as Secretary of the Board. The first order of business was the consideratian of the minutes of the meeting af the Board r�e1d on Jarnzary 13. 1970 and Januar� 26, 1970, copies of which had been distributed to the Bc3�.s°d. It was moved by Pau� Sens�ad, seconded by Dona2d Fran.zen, carried unanimously, to approve the minu.tes of these two meetings. The Chairman then brou.ght before the meeting the follc�wing requests for waivers> All agreed to add the following requ_est to the agenda. 70-2-5 1�92fl Dona Lane (�.j Paul G. Koven The petition is for the waiver of Section 3.07 (3a) For 1.33' on the existing hom.e only to a side�Tard setback of 13.671 aff the East property line,^�Requ ired l��) Mr. and Mrs. Pau1 G. Kaven presented their request to the Board. The Chairman of the Board noted that signatures had been obtained from ' all adjaining property owners. The Board also pointed ou.t the request is on the existing structure on1y. Frank Ainsworth of I�975 Sorell Ave, No. The Board in dzscussing the request reviewed the March 1966 and Apri1 9, 1968 Board of Zoning Appeals minutes. It was also noted as in the previous request the neighborhood is almost entirely sin�le famil.y dw�llings. It was moved by Paul Senstad, seconded by Donald �`ranzen, carried unan,imously, to deny the reo,uest. 70-2-7 5801 Duluth Street (11) Ridgway Construction Co. (Urban Planning & Design) The petition is for the waiver of Section �..03 (b) Subdistricts and height limita�ions: Four subdistricts and corresponding height limitations are hereby established within the Nlultiple Dwelling District to be known as M-1 Maximum hei�ht two(2) stories Ms. Otto Schmid of Urban Planning & Design explained to the Board the reason for the request. . Mr. Leo Cram of 1880 Adair Ave. No. was presen.t as an interest�d property owner, The Board discussed the definition and interpretation o�' story and height. ' The Board also noted -this zs not a waiver req�zest but rather an interpretation, of �ection }�.03. Tt was then moved by Paul Senstad, seconded by Donald Franzen, carried unanim�usly, that the plan as presented, drawn b,y James M. Cooperman -AIA.- �rchitect dated December 17, 1°69, is interpreted as a two story strueture with tuck under garages. On the basis of the interpre�ation k>y the Board of the proposed project, the petitioner withdrew his request and asked th.at the filing fee be refunded. 'I'he Board in discussing the request agreed that one house on the two lots would be the most reasonable t�.se of the property because of the Ordinances. It was moved by Paul Senstad, seconded by Donald Franzen, to grant a waiver of 30� to a front yard setback of 5t off the East property line, also known as vJheeler B1vd., subject to combining Lots 6 and 7. Block 6 Lakeview Heights to form a single lot, The motion carried unanimously.
