MINUTES OF A REGULAR MEETING OF THE
GOLDIIV VALLEY BOARD OF ZONIlVG APPEALS
MA.RCH 10, 1970
The regular meeting of the Golden Valley Board of Zoning Appeals was held
Tuesday, March 10, 197�, at 7:30 P.M, at th� Golden Valley Civic Center,
7800 Golden Valle�r Road, Golden Valley, Minnesota. The following Board members,
con.stituting a quorum, wer� present:

Mr. Lowell E. Odland, Village Fhgineer, and Mr. Jan L. Westlake, Secretar�r
of the Board, were present.
LeRoy W. �inderson, Chairman of the Board, presided and Jim M. Ingemqnson
acted as Secaretary o.f the Board,
The first order of business was the consideration of the minutes of the
meeting of the Board held on February 10, 1970, eopies of which had b�en dis-
tributed to the Board. It was m.oved by Paul Senstad, seconded bv Robert Hoover,
carried unanimously, to approve the minutes of the meeting held on Feb. 10, 1970.
The Chairman then brought before the meeting the followin� requests f'or
waivers:

Z'he petition is for the waiver of Section
7.46 (2) for 19' of landscaping to a front yard landscaped area of l6�
off' the North Right of �vay� line of Highway 12. (Required 35')

Messrs. James Lupient and Robert Blader of Lupient Oldsmobile, Donald W.
Chatfield of Anderson Cadillac, and John Kosman, architect, were presen� to
represent the request.
The Board discussed the following points in re�erence to the proposed reque5t:
l. A private roadway to be no larger than 30 feet in width.
2. Provision of a completed landscaping plan on the Lupient
Oldsmobile site.
3. If a pu�blic roadway is developed to serve these parcels, the
suggested waiver would be null and void,
�.. Customer Parkzng and parking of new and used cars on the private
roadwav to serve these two buildings should be prohibited.
It w�s moved by Morton silverman, seconded by llonald Franzen, to grant a
waiver of 19� of landscaping to a front yard landscaped area of 16t off the
North Right of Way line of Highway �12 with the following stipulations:

1. That the total front yard green area will equal at least 35� as
required by the present Zoz�ing Code. The plan showing the total
35' of green area is an file in the Village of Golden �Talley
Buildin� Dept. marked �hibit A. (Board of Zoning Appe�Is 70-3-3)
2, That the waiver as granted would revert to the required 35' as
measured from �the lot line 35' North from the North Ri�ht of Way
line of Highway �12 if and when a public roadway is provided.
Board member Robert Hoover then indicated further discussion on the four
points previously discussed.
It was then moved by Robert Hoover to amend the previous motion to include
the following recommendations:
1. Erectian of no parking signs along the proposed private raadway to
eliminate customer parking and parking of new and used cars on the
private roadway.
2. Preparation of a landscaping plan to be turned in the Building
Department prior to constructian of the proposed private roadway.
Board msmber ponald Franzen seconded the amended motion, carried unanimously.
It was then moved by Donald Franzen, seconded. by Mort Silverman, to approve
the motion as amended, carried unanimausly.

The petition is for the waiver of Section
11.Oo for l�t on a proposed utility building to a sideyard setback
of 1�� off the West propertv line. Required 30�)
Mr. Lowell E. Qdland, Village Engineer, e�plained the request to the Board
on behalf of the Village.
The Board pointed out the waiver as requested is from an imaginary line
between the proposed uti7ity buildin� and the proposed library. The green area
as required wi11 meet the requirements of the Zoning Code.
It was moved by Donald Franzen, seconded by Mort Silverman, unanimously
carried, to apprave the waiver.
It was then moved by� I�onald Franzen, seconded by Norton Silverman, carried
unanimous7,y, to obtain from the Village Attorney an opinion, to be placed in the
ma.riutes, with respect to �he proposed Village utility building in reference to
Section 1.03 of the Village Zoning Code.
The following opinion was received from Mr. Robert M. Skare, Villa�e Attorney,
dated March 17, 1970:
"At your request we have examined the question of whether or not the
proposed storage and utility building to be located upon property owned by the
Village of Golden Valley and comprising the site of the Civic Center, would
require any sort of a waiver under the provisions of Section 1.03 of our zoning
code prohibiting the ereetion of more than one principal building on any� Iot of
record.

Based upon the information supplied to us we are of the opinion tnat tne
proposed structure, being a building of the type described above and to be
located upon the nor�heast corner of the present Civie Center property site,
is not a principal building within the meaning of Section 1.03 of our zoning
ordinances for the reason �hat its proposed use appears to be incidental
and auxiliary to the main Civic Center building now located upon the si�e.°
There being no further business to come before the meeting, it was an
