MINUTES OF A REGULAR MEETING OF THE
GOL�EI� VALZEY BOARD OF ZONTNG APPEAI�S
SEPTEMBER 8, 1970
The regular meeting of the Golden Va11ey Board of Zoning Appeals was
held 'It�.esday', September 8, 1970, at 7s30 P.M. at the Golden Valley Civic
Center, 7800 Golden Valley Road, Golden Va11ey, Minnesota. The fallowing
members, constituting a quorum, were presen�:

Dr. Robert R. Hoover, Chairman of the Board, presided and Jim Ingemunson
acted as Recording Secretary.
The first order of business was the consideration of the minute� of the
meeting of the Boaxd held on August 11, 197d, copies of which had been dis-
tribu�ed tfl the Bc>ard. It was moved by Donald Franzen, second�:d by Joseph Brown,
carried unanimously, to approve the miriutes of the meeting held on August 11, 1970.
The Chairman then brought before the meeting the follrnaing requests for
�raivers.

The petition is for the waiver of Section
5•05 (A} for 7� off �he r�quired setback distance of 35� to a
setback of 28� from the North property line to the
proposed building and parking area.
�•�5 (A) for 2� off the required setback of 3�� to 33� f'rom the
South pro�e�ty line to the Southwest corner of the
proposed building and for 13.�' off the required 3s'
to a setback of 21.�� from the South property line to
the Southea�t corner of the building.
5.06 (C2} for a ma�imum of 8� off the required landscaping distance
of 20� to 1.�� from the Srnzth property line to a point on
the South side of the proposed parking lot distance of
I�lt East from the proposed building.
5.�5 (B) for 10� off the required sideyard setback distance of
20� to a setback distanee of l�� from the West property
line to the proposed building only.
5.0,� (B) for 5� off the required sideyard green area of 10� to
a green area along the East property line of 5�.
13.01 for a elimination of !�7 parking spaces off the rec�uired

This petition was returned to the Board for reconsideration upon an
appeal to the Council on August 17, 1970 .from a Board of Zoning Appeals denial
on July 1l�, 1970,

Mr. Robert Brenny was present to make the request, and Mr. Bernie Churilla
of B1ack and Decker was present as an interested party.
Mr. Brenny point,ed o�zt the areas affected on a site plan as the Board .
Chairman read the petition.
The Board then questioned Mr. Brenny and Mr. Ghurilla an the size�.of
the building and the riumber pf parking spaees needed for the proposed tenant.
The Board felt that the number of parkin� spaces that would have to be
waived were too great, and that while there may be enough space for the pro-
spectiv�; tenant, there is no assurance that the building couldn�t be used
for a commercial operation.
The Board then discussed the possibility of acting on each waiver in the
petition separately. Due mainly to the large waiver of off street parking
that would be necessary, Con Franzen moved to deny the entir� petition. Tt
was seconded by LeRoy Anderson and carried unanimously.

The petition is for the waiver of S�etian
3.07 (3a) for 5' off the requixed sideyard setback of 15� to a
setback distance of 10� from the Sc�utheast property
line to �he proposed garage only�.
3.07 (1) for .71� off the required front yard setback distance
of 35� to a setback distance of 31�.29� from the property�
line to the existing strueture only.
Mrs. 5ickman was present to make the request for the waiver.
The Board noted that the access �o the Sickman�s present garage will be
cut off when the Village builds the cul de sac at the end of Dresden Laz�e
and then vacates the South side of 26th .Avernze North.
LeRoy Anderson moved tp grant the petition as presented. It was second�d
by Mort Silverman and carried unanimously.

The petition is for the waiver of Section
3.07 (1) for 2.6� off the required front yard setbaek of 35' to a
setback distance of 32.�t from the South property line
an Mandan Ave. to the proposed attached garage on�.y,
Mr. Brett was present to make the request of the Bmard.
Mr. Brett explained the situation concerning his steep lot.
Franzen moved to grant the petitioner�s request. It was seconded by
Silverman, and carried unanimausly.

The petition is for the waiv�r of Section
5.0,� (B) for 80t off the required rear yard setback of 100► to
a rear yard setback distanee of 20�.
Mr. Nei1 Brastad was present to make the requ�:st for the waiver.
The Board discussed the previous waiver granted to �he adjoining property
to the 5outh and the location of the building on the adjoining property to the
North.
Joe Brown moved to grant the waiver as presented. Tt was seconded by
Don Franzen and carried unanimously.
70-10-32 ��.00 Glernaoad Avenue (map 8) Middle and High School
The petition is for the waiver o� Section
�.05 (A) for 20t off the stre�t to building setbaek of 35� to a set-
back distance vf 15' from the Northwest curb line of Otta�ra
Avenue N, to the proposed sehool addition only.
Mr. Ron Pearson of Elerbe �rchitects was present to make the request for
the waiver. Mr. �on Palmer of the District 275 School Board was prese�.t as
an interested party,
After e�xamining the su.rve�s presented, it was decided that more detailed
information would be necessary to grant the speca.fic waiver� necessar�r for the
proposed additions. However, it was felt that the waivers would be granted,
and that a delay in the granting of a permit wvuld be in the best interest of
the taa� payers for District 275,
It was moved by Joe Brown to grant the specific waivers as needed to a11ow
the �aa�tion of 20t to the South side of the existing boil.er room o� Golden
Valley High School, provided that a survey be made and that appropriate
waivers be defined by the Village Staff, and that adjacent property owners
agree to said waivers. It was seconded by�Don Franzen and carried unanimrnzsly.
