10-13-70 BZA Minutes �. ll J MINUTES OF A REGULAR MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS OCTOBER 13, 197� The regu.lar meeting of the Golden Va11ey Boaxd of Zoning Appeals was held Tuesday�, October 13, 1970, at 'j:30 P.M. at the Golden Va11ey Civic Center, 7800 Golden Valley Road, Golden Valley, Minneso�a. The following Board members were present: " Dr. Robert R. Hoover LeRoy W. Anderson Joseph L. .Brown Donald E. Franzen Mortan D. Silverman I�. Robert R. Hoover, Chairman of the Board, presided and Jim Ingemunson acted as Recording Secretary. The first order of business was the consideration o� the mirnztes of the meeting of the Board held on September 8, 1970, copies of which had been dis- tributed ta the Board. Tt was moved by Donald Franzen, seconded by LeRoy Anderson, carried unanimousl,y, to approve �he mirnztes of �he meeting held on Sept. 8, 1970. The Chairman then braught before the meeting the follawing requests for waivers: 70-11-33 18 Western Terrace (map 23) David Hersk The petitian is for the waiver of Section 3.07 (3c) for 3� off the required sideyard setback distance of 15� for a setback distance of 12� from the East property line to the existing dwelling only, 3.07 (1) for 1! off the requircd front yard setback distance of 35� to a setback distance of 3�.' from the property line on Western Avenue to the existing dwelling only. Mr. Ray 5egal was present to request the waiver, Also present to speak on Mr. Herskts behalf was Mr. Hyman Shinder, It was explained that the house. was built in 1963 by Gharles Alexander, and the error in placement hadn�t been discovered until the present owner applied for a permit to add a family room. The new raom wc3uld be entirely conf orming. Don Franzen moved to grant the petition as presented. It was seconded by Joe Brown and carried wi.th 1� yea and 1 abstention. 70-11-3�t 2303 Xerxe� Ave. No. (map 1) Ronald E. Edstrom The petition is for the waiver of Section 3.07 (3e) for 3.7' off the required sideyard setback distance of 10� to a setback distance of 6.3� from the Sauth property line to the proposed addition only, Mr. Edstrom, the property owner, was present to request the waiver. .� !� Board of Zoning Appeals October 13, 1970 page 2 It was shown, that the house was built in 1941 by F. R. Lein and sideyard varianee� were gran�ed by the Board of Zoni.ng Appeals in 1966. Those waivers were for the existing structure only and wauld not appl.y to an addition. It was moved by ZeRo� Anderson to gran�t the �aiver as presente�. Joe Brown second�d the motion, and it carried unanimously. 70-11-3.5 2311 Byrd Ave, North (ma� 1) Brent Nelson The petition is for the waiver of Seetion 3.07 (1) �or 6,G� off the required 35' front yard setback to 28.1t from the property line on Byra Aven.ue to the existing structure on1y. 3.07 (3b) for 2.6� off the required sideyard setback distanee of 12' to a setback distance of 9.�.' from the Fast propert-y line to the existing dwelling on1�'. 3.07 (b) for 6.6t off the required sideyard setback distance of 12� to a setback distance of 5.�t from the West property line �to the existing dwelling on1y. 3.�7 (3b) for 3' off the requirEd sid�:yard setback distanae of 12� to a setback distance of 9t from the West property line to the proposed addition only. The hrnzse was built in 19�� by Paul EY�ghauser, and a garage and a breeze- way were added in 1951. �on Fran�en moved to accept the first three parts of the petition as presented. 2t was seconded by Mort Silverman, and carried unanimrnzsly. In order to give Mr. Donohoo more time to get signatures from the adjoining property owners, LeRoy Anderson moved to defer aetion on the fourth part of the petition until later in �he meeting. It was seconded by Don Franzen and carried unanimously, Mr. Donohoo returned with signatures of property owners surrounding the subject property, �iving their approval of the proposed waiver, Joe Brown moved to approve the fourth part of the petition as presen.ted. It was seconded by Dan Fran�en, and carried unan�mously. 70�11-3b 6701 Glenwood .Avenue (map 17) Mareus K. Taylor The petition is for the waiver of Section 3.07 (1) for 10,07� off the required setback distance of 35� to a setback distance of 2�.93� from the property line along Idaho Ave. No. to the proposed at�ached garage only. Mr. Mark Taylor, the owner, wa� present to request the waiver, 171 Board of Zon�ng Appeals October 13, 1970 page 3 The house was built in 19�1 by Swan E�ickson, and the land was subdivided in 1960. The Board recognized that the 1960 subdivision of the land left no space for an attached garage to be built. A garage built in the front yard would probably be more objectionable than the one proposed. Don Franzen moved to approve the waiver as presented, to allc3w for an attached single garage and breezeway. Tt was seeonded by Joe Brown, and carried unanimausly�. 70-11-37 301 Meadow Lane So. (mag 9) Mrs. Vivian Leach The petition is for the waiver of Seetion 3.07 (3b) for 3.9' off the required sideyard setback distance of 11.25� for a setback distance of 7.35' from the South property line to the proposed garage addition only. Mrs. Leach was present to request the waiver. The house was built in 191t9 by Harry Leaeh. It has a walkout basement at �he rear with the lot slopin� down toward the back. Mrs. Leach explained �hat because of the lot topography there is no other place to build a garage. Joe Brown moved to approve the waiver as presented. It was seeonded by Don Franzen and carried unanim.ously. 70-11-38 1,1.�08 Lilac I�rive No. (ma� 6) George Seiter The petition is for the waiver of Section 3.07 (3B) for 10.18� of�' the required side�ard setback distance of 12.58� f or a setback distance of 2.1�� from the S rnzth property line to the proposed attached garage only. Mr. George Seiter was present to request the waiver. P�S° Seiter e�lained that they chose the proposed plan for an attached garage and breezeway to save two large split leaf maple. The Board noted that the lot in question is large enough to have a garage built on it without the need of a variance. Mort Silverman moved to deny the petition, It was seconded by ZeRoy Anderson, and earried unaninausly. 70-11-39 1�625 Glenwood Avenue (map 9) Robert W. Reitz The petition is for the waieer of Section 3.07 (2) for 8.2� off the required rear yard setbaek distanee of 19.1�' �o a rear yard setbaek distance of 11.2� from the 5auth property line to the proposed porch onl,y. �r. Reitz, the owner, was present to request the waiver, and Mr. Rolf Kirkwood from the Building Clinic Store was also present. � �G Board of Zoning Appeals October 13, 1970 page !t Mr. Reitz explained �hat the living area in his home was entirely on the second floor level and that the proposed deck would serve as a fire escape as well as a us�.ble porch. The Board was concerned that a future owner crnzld easily enclose the area below the poreh. As for a fire escape, the Board feZt that a narrower balcon,y wau3d serve as �aell. LeRoy Anderson moved for denial of the waiver requested. It was seconded by Joe Brown, and earried unanimously. 70-11-1�0 7505 Ccnzntry Club Drive (map 17) Skyline Builders The petition is for the waiver of Section 11.03 for 1�2 story in addition to the maximum allowable 2 1/2 staries, for 3 stories along the North 98� of the West side of the main struc�ure, and for 3 stories along the North 106� of the East side vf the main structure of the proposed boarding-care home only. 11.03 for 1 1/2 stori�s in addition to the ma�imum allowable 2 1/2 stories along the South 98t of the West side c�f the main structure, and along the entire South side of the main strueture, and along the soutn 155� of the East side of the mazn structure of the proposed boarding-care home only. 11.03 for lf2 story in addition to the maximum allowable 2 1/2 stories on the Sou.th side of the West wing of the proposed boarding-care home only. Mr. Keefer of Skyline Builders and I�r, Pink of Gingoid Pink Architects were present to request th� waivers. Mr. Pink explained the coneept c�f the boarding-care facility, and presented plans and elevations. The Baard noted �hat the proposed building is smaller than the r�u.rsing home that was fortnerl.�r proposed for this site. LeRoy �.nderson moved to grant the waivers as presented. No, tQ the existing building, and for 31' off �he required 35' setback distance to 1�� from the right of way of Ottawa Ave. No. to the proposed boiler room addition only'. 1 � 3 Board of 2oning Appeals Oc�ober 13, 197� page s At the September 8, 1q70 meeting of the Board of Zoning Appeals a waiver was granted to School District �275 for an addition to the boiler room at the Middl� and High School. The waiver was granted providing,;that the school distxi.et obtain a location survey� and the signatures of adjacent property owners. A survey loeating and defining the amount of th� waiver and a list of signatures giving approval of the variance were given to the Village staff and presented to the Board, Mort 5ilverman moved to accept the �chool district�s survey and the list o�f signatures as a final eondition for granting the waiver as presented. Tt was secc�nded by Don Franzen and carried unanimously.
