MIATUTES 0F A REGUJ�AR MEETING OF THE
GOLDEN VALLEY �A.RD OF ZONING APPEALS
JAANARY 12, 1971
The regular meeting of the Golden Valley Board of Zoning Appeals was held
Tuesday, January 12, 1971 at 7:30 P.M. at the Golden Va11ey Civic Center,
7800 Golden Valley Road, Golden Valley, Minnesota. The following Board members
were present:

The first order of business was the consideration of the miriutes nf the
meeting of the Board held on December 8, 1970, copies of which had been dis-
tributed to the Board. It was movsd by LeRoy Anderson, secanded by Mort
SiJ�verman, carried unanimously, to approve the mirnztes of the meeting held
on December 8, 1970,
The Chairman then brought before the meeting the follawing requests f'or
waivers:
7�-12-�1 187� Lilac Drive North (map ll) Texaco Inc.
The petition is for the waiver of Section
5.05 B for 8� off the required side or rear yard setback distance
of 2Q� to a setback distanc� of IF► from the existing West
property line to the proposed service bay additzon only.
13.02 D for 7� off the requir�d 10� landscaped area to a landscaped
area of 3' along the West and South property lines.
5.06 C (2) for 10� off the required landscaped area of 20t to a
landscaped-area of ZOt along the North property line on
Duluth Street.
5.06 C �2� �'or 6� off the required landscaped area of 20� to a
landscaped area of l�.a.t on the East property line along the
existing service road.
Presen�t to request the waivers were Mr. Ken Gowriluk of Texaeo, .Tnc.
and Mr. Bruce Russell, the lessee,
Mr. Gowriluk presented letters of consent from Goodman Bros, and
Super Valu Inc.
The Board then disc�zssed the proposed additions and improvements, and
the requi.red waivers necessary to allow the issuance of a building permit.
The Board felt that even though `they may be sympathetic tvward the
praposed improvements, there is not a gern�ine hardship attributable to the
land upon which they could base the requested waivers.

I,eRoy Anderson moved tc� deny the request for the waivers. St was seconded
by Joe Brown and carried with � yea and 1 nay.

to a landscaped area of 201 along the West property line
on Lewis Road.
Mr. Brenny presented the request for the waiver and showed the Board the
revised layout for the proposed addition.
The Board discussed the space require:nents for a truck turnaround on the
subject property.
The Board was also aware of the existing waivers on neighboring property
to the North ar;d West.
LeRoy Anderson znoved �o acce�t the waiver as requested. If, was seeonded
by Franzen, and carried unan.imously.

The Chairman explained how Mr. Reitz missed appealin� the Board►s October 13,
1970 decision wit,hin the thirty-day limit.
Joe Brown moved to address a letter to the Gouncil f'rom the Board sta�ing
the Board1s �eel.ings on this appeal. Tt was seconded by� MQrt Silverman, and
carried uaanimously.
