MINUTES OF A REGULAR MEETTNG OF THE
GOZDEN VALLEY BOARD OF ZOIVING APPEALS
MARCH 9, 1971
The regular meeting of the Golden Valle.y Board of Zoning Appeals was held
Tuesday, March 9, 1971 at 7:30 P.M. at the Golden Valle� Civic Center, 780o
Golden Va11ey Road, Golden 9alley, Minnesota. The following Board Members
were present:

Donald E. Franzen
Morton D. Silverman
A1so present, as a guest of the Board, was i�ike Sell, recently appointed
n� the Crnzncil to serve on the Board for the 197I term.
Mr. LeRoy Anderson was elected as chairman pro tem and Jim Ingemunson
acted as recording secretary.
The first order of business was the consideration of the miriutes of the
meeting of the Boaxd held on Jan. 12, 1971, copies of which had been distributed
to the Board. Zt was moved by Morton D. Silverman, seconded by Donald Fran�n
carried unanimausly, to appr�ve the minutes o.� the meeting held on Jan. 12, 1971.
The Chaa.rman pro tem then brought before the meeting the followin� item
for discussian:
At �he Village Cauncil Meeting of Feb. 16, 1971, there was a discussion
of front, side, and rear yard setbacks, Of particular interest was the
situation wi.th corner 1c�ts, both vacant and the ones with existing structures.
The follctwing motion was a result of that discussion:
MOVED by Ulstad seconded by Stockman carried to deny the appeal from the
Board of Zoning Appeals and rec�uest a clarificati�n from the Board of Zoning
Appeals regarding the determination of front yard and side yard of a lot.
'I'h.e Board then discussed the sections o�' the Residential Zoning Code,
involving yards and their setback distances, Secti�ns covered included
12.02, 5, 7, 28, 29 and page 37 of the Uniform Building Gode, defining
front of 1ot.
The Board realizes �hat the sections of the cod� in question are not
specific t�hen it comes to corner lots.
Mort Silverman moved to make it the opinion of tk�e Board that by inter-
pretation of the Village Zoning Code and the Uniform Building Code, in the
case of a corner lot, the owner determines by the design and placement of his
structure which street is the front irrespective of Section 12.07 of the
Village Zoning Code. '
Don Franzen seconded the motion, and i� carried unanimously.

In f`urther discussian, the Board felt that this area of the eode is too
vague in the light of future requests f'or waivers on corner lots. Don Franzen
moved that the Board reeommend to the council that the Planning Cornmission
pay part�.cular attention to the problem of ya,rd definitions and setbacks on
corner lots while working on the current z�ning code revision,
It was seconded by Mort Silverman and carried unanimausly.
During the final discussion, the Board was concerned that a present owner
of a eorner lot can interpret side and rear yards to his own advantage when
ma.king alterations.
�here beirig no further business to come before the meeting, it was on
motion, duly seconded, adjourned at 8:34 P.M,
