05-26-71 BZA Minutes . � �7 MTNUTES OF A SPECIAL MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEA.LS MAY 26, 1971 The special meeting of the Golden Va11ey Board of Zoning Appeals was held ttiednesday, May 26, 1971 at 7:30 P.M. at the Golden Valley Civic Center, 7800 Golden Va11ey Road, Gfllden Valley, Minnesota. The following Board members were present: Mahlon S�redberg LeRoy W. Anderson Donald E. F`ranzen Mike Se11 Mahlon Swedbergy Chairman of the Board, presided and Jim Ingemunson acted as Recording Secretary. The first order of business was the consideration of the mixiu.tes of the meeting of the Board held on May �, 1971 copies of which had been distributed to the Board. . It was moved by ZeRoy Anderson, seconded by Don Franzen carried unanimausly, to approve the mirnztes of the meeting held on May 11, 1971, as corrected. The Chairman then brought before the meeting the following request for waivers: 71-2-9 11�09 Pennsylvania Avs. N. (Map 15) Residential Nick Loseheider The petition is for the waiver of Section 3.07 (2) for 1� off the required rear yard setback distance of 15t to a setback of l�� from the west property lzne to the proposed dwelling only. Present to make the request for the waiver was Mr. Nick Loscheider. Also present was the owner of the subject lot, Mr. Rufus Bankole. The board discussed the waiver as was originally requested at the May 11, 19?1 meeting of the board. It was noted that the owner and builder changed the proposed house plan to one more close7�y in conformance with the zoning code, thus reducing the need for a variance from 8.67� to l� . Don Franzen questioned the location of the corner stakes and the correct- ness of the lot survey in regard to the confusion tha� occured on this point at the May 11 meeting. The secretary informed the members that this problem had been resolved and that the survey is correct as shown. There being no further discussion and considering the narrowness of the corner 1ot, it was moved by Don Franzen, and seconded i�y LeRoy Anderson to grant the waiver as requested at the May 26, 1971 meeting. 71-2-10 7505 Cauntry Club Dr. (Map 17� Institutional The petitioner requests a review of the waivers granted to the proposed structure at the Oct. l3, 1970 meeting of the board. Present to make the reques�t for the waiver were Mr. Keefer and Mr. Stinski from Skyline Builders, and Paul Pink the architect for the prc�posed building. Also present as an in.terested party was Rev. Nielsen from Calvary Lutheran Church. The board reviewed �he past petitions on this project, and the waivers that were granted at the October 13, 1970 meeting of the board, The appellant presented plans and drawings of the proposed nursing home, It was also explained that Sk�rline Builders has acquired the lot on the west side af th� original parcel, and that the combination of that lot with the nursing home site, wi11 eliminate any need for waivers on parking. The board carefully examined the new plans, and related them to the waivers already granted. Tt was determined that the only waiver now required would be f or the west wing o�' the proposed structure. The appellan.t explained that the added height of the west wing is necessary to meet the additional space requirements of the sta�e standards regarding rnzrsing homes. The proposed board and care home that received the waivers on October 13, 197� didnst require as much space in day rooms, nursing stations, therapy rooms, etc. Also the proposed west wing has been designed in a step down fashion to modify the appearance of what would otherwise be a straight four s�ories on the south side of the proposed west wing. Because the appellant will be adding the adjacent lot to the west on Cauntry C1ub Drive to the original site, and since the proposed west wing will be no higher than the proposed building for which waivers have been granted, LeRoy� And�rson moved to grant the waiver as requested for the west wing only. It was seconded by Don Franzen and carried vnanimously.
