JULY 13, 1971
The regular meetin� of the Golden Valle� Board of Zoning Appeals w�s held
Tlxesday, July 13, 1971 at 7:30 P.M. at the Golden Valley Civic Center, 7$0�
Golden Va11ey Road, Golden Va11ey, Minnesota. The follc�win� Board members were
present:

Mahlon Swedberg, Chairman of' the Baord, presided and Jim Ingemunson acted
as Recording Secretary.
The first order of business was the consideration of the minutes of the
meeting of the Board held on June 8, 1971, copies of which had been distributed
to the Board. It was mo�red by Don Franzen, seconded by Mike Sell carried
unanimvu.sly, to approve the miriutes of the meeting held on June 8, .1971, as
presented.
The Chairman then braught be�ore the meeting the follc�wing requ�st for waivers:

The pe•titi�n is for the waiver of Section
3.07 {1} #'or 2.5i o�f the required f'ront yard setback distance
of 35' to a setback distance of 32.5' from the property
line along Utah Ave So. to the proposed attached gara�e
addition only.
3.07 (3b) for .9� off the required sideyard setback distance of
13.2' to a setback distance of 12,33t from the north
property line to the proposed attached garage addition
only.
3.07 (3b) for 1.2t off the required sideyard setback distance of
13.2� to a setback of 12� from the north property line
to the existing sin.gle family residence onl�.
Present to mak.e the request for the wazver was the owner, Mr. McFarland.
The board concluded that this particular hause and Iot is an urn3:sual situ-
ation, with the hause built at an angle to the street, and the lot of an irregular
shape. The board also noted that Mr. idcFarland has reduced his rec3uest from its
original amaunt.
Dan Franzen moved to grant the waivers as proposed, and to insure compliance
with same, that a Iocation survey of the ne�a con5truction be provided by the owner
to the Village buildin� department. It was second�d by Walter Kost and so
carried.

The petition is for the waiver of Section
3.02 to permit the construction of a double bungalo�w on the combined
parcels of 6350 and 7010 in Plat 86701, Richland Hills 2nd.
The board reviewed the discussion that took place on this petition at
the last meeting of the board.
A memo from Lawrence Geisler of Midwest Planning and Research, Inc. con-
cerning the future land use across Winnetka was read.
Don Franzen moved to grant the waiver as asked, to allow one single story
dauble bungalcyw, with driveway access limited t� 23rd. Ave. Only. It was
seconded by Mike Sell and carried unanimausly.

The petition.:�.s for the waiver of Section
I�.03 (a) for 8.6 units in addition to the maximum allataable 75.l�
units to a total of 8!� apartment units on the proposed
540.o x 414.29� site.
13.02 A for 7.5� off the required landscaped area of 20.0� to a
landscaped area of 12.5t between the proposed sauth
parking area, and the proposed sauth property line.
Present to make the request for the wa,ivers were Mr. Stanley Sopczyk f
from American Mortgage and ftealty Corp.
Zt was e�Iained that the present site wauld support an 84 unit 4 story
apartment building. With the removal of 60t on the south end of the site
there wauld remain space for 75 units.
The board and the appealant then discussed the necessit� for the waiver
of Section 13.02 A, and then Mr, Sopezyk withdrew the request for a waiver
on Section 13.02 A.
Don Franzen moved to grant the waiver of section 1�.03 (a) as requested
for the proposed site plan filed with the Village buildin� department and
labeled "exhibit A", provided that the proponent fuxnish the village, at no
charge, the b0� right-of-way for the proposed street along the south end of
the subject property, and that a landscaped berm be constructed along the
north and svuth sides of the site to screen the proposed garages and parking
areas. It was seconded by Mike Sell and so carried.
?1-7-71a. 7800 Golden Valley Road Fire Department Drill Tower Al Hanover
The petition is for the waiver of Section
11.03 for 3.5 stories in addition to the maximum allawable of
2.5 stories to a height of 6 stories (52�) for a proposed
fire drill tawer.

Appearing as proponents were David Gorski, Village Public Safet� �ixector,
and A,l Hanaver, Village Fire Chief. Also Mr. Kilstofte, the architect for the
proposed tower was present.
The proponents and the board, discussed the need for the tower, its location,
appearance, and exact height.
Don Franzen moved to defer the decision on the tower hei�ht until the follc�aing
items of information are received.
1. A site plan with the location of the proposed tower.
2. A completed applieation for�n with the exac� height of the proposed
tower.
3. Opinions from the Building Board of Review and Architectural Review
Board concerning the location and appearance of the proposed tower.
1�. Nctification to adjoining property owners if the location is toward
the east side of the Civic Center site,
T.he motion was seconded by Walter Kost and carried unanimausly.
If the proposed tower is blended astitically with the Civic Center site, and
reviewed and approved by the adjoinin; property owners. It would be the
recommendation of the board to approve of the hei�ht.
71-7-15 b21 N. Li1ac Dr. (Map 21) Professional and Business Office-Mark Rodman
The petition is for the waiver of Section
1b.06 for .1� off the requixed rear yard setback distance of 20� to
a setback of 19.9� from the west property line to the southwest
corner of existing stx�ucture only, and for .6► off the required
sideyard setback distance of 201 to a setback of 19.4' from
the north property line to the northeast corner of the existing
strrzcture o�ly.
1.03 for interpretation or waiver o�' the provisions of this section.
13.O1 for the waiver of 8 parking spaces off the required number of
98 spaces t� a total of 9Q parking spaces on the site.
Mr. Rodman appeared as proponent. Mr. Rodman asked the board for a deferral
until the next regular meeting of the b�ard.

The petition is for the waiver of Sec�ion
3.07 (1) for 7t of.f the front yard setback distance of 35t to
a setback of 28t from the front property line to the
proposed attached and existing garage only.
3.07 (3�) for 7.55� off the requ.ired sideyard setback distance
of 13.55� to a setback of 6� from the north property
line to the proposed attached garage only,
Mr. Stanton Jorgens was present to make the request for the waiver.
It was noted that this same petition was granted by the board on
November 8, 1966, and that the waiver had expired after one year when the
proposed addition wasn�t started.

by Walter Kost and so carrieci,
