GOLDEN V�1LLI�EY BOARD OF ZONING APPEaLS

The regular meeting of the Golden Va11ey Board of 'Loni.ng Appeals was held
Tues�ay, Nove�nber 9, 1971 at 7:30 P.M. at the Golden Valley Civic Center,
780Q Golden Valley Roa�, GoZ�en Valley, I�Iinnesota. The follc>wing board members
we.re present:

Mahlon Swedberg, Chairrzan of the Boa�d, presided and Jim Ingemunson acted
as Recordi�g Secretary.
The first order. of business was the considerati�n of the minutes of the
meeti*�g of the Board held or�. Octoper 12, 1971, copi�s of wrizch had been dis-
tributed to the board. It was mo�ved by I�Iike Sell, seconded by LeRvy Anderson
carried unanimously, to approve the mi�utes of the meetin�; held on October 12,
1971, as corrected.
The Chairman then brou�ht bef ore the rneeting the follc>wing requests for
waiver s:

The petztion is for the waiver of Sect:ion

Present to request the waiver was �r. LaPorte. `
The board discu.ssec� �tlze petition anc� found it to be a reason.able request
for the site, however it was felt that the waiver i_f granted, shauld have certain
conc.�itions at�ached.
Ulalter Kost rrave�� to gran.t the waiver of Section 71.a.02 to allow the existing
r�si�ential structure to be used as a real estate offics on�y, provided that the
�oll�wing �h�pe conditions be applied:
la Tk�a� pavec3 off street parking be provided accordin� to the
site plan fil.ed with the Village Biiilding Depart��ent and
lat�eled eyhibit 1°A".
2. That the waiver apply to ths use as a real estate office only
and th�t any f�ture change in size or use will require ;further
consic�erati�n by the Village.
3. That the residence cor��Iy with all Village safety standards,
r.odes, and sign or��inances regarding office structurss,

The petition is for the waiver of Section
3.07 (1) for 10� off the required front yard setback distance
of 3.5� to a setback of 25t from the North property
line on Olympia St. to the proposed dwelling only,
Present to request the waiver was Mr. Maher, son of the property owner,
The board discussed the petitior_ and pointed aut the fact that the next
property to the east of the site was given a waiver of 91 off the front yard
setback.
Mr. Maher stated that he wished to build the proposed house in line with
the neighboring residence.
LeRoy Anc3erson moved to grant the waiver of Sec. 3.07 (1) for 9� off the
, required front yard setback distance of 3�' to a setback distance of 26� from
the propert3T line along Olympia Street to the proposed residence only. It was
seconded by Walter Kost and so carried.

The petition is for the waiver of Section
5.05 A for 18t off the required front yard setback distance
o� 35' to a sethack of 17i froln the 1Vorth property
line to the proposed office structure only, and for
32� off the required 35' setback to a setback of 31
from the Southwest property line to the Southwest
corner of the proposed office bu.ilding only.
S.Os A for waiver of the required landscaped areas along
the North, West, Southwest, and East property lines
as shot�rn on the site plan filed with the Village
Building Departrnent and marked exhi�it "A".
13.01 for the waiver of four (!�) parking spaces of the
requixed number of 20 (1/75) to a total of 16
parking spaces on the site.
Present to request the waiver was Mr. Roriney Cooperman, and his builder
Mr. J. Johnson. Also present as interested parties were Mr. Hyer, a neighbor
on the adjoining property to the east and Mrs. MeKelvy the exec�tri�c for the
estate of Mr. Brown, which is located to the north, across Golden Valley Road,
Mr. Hyer and NIrs. �cKelvy were not opposed to the proposed development of
the s�zb,ject site, however Mr. Hyer wished to survey his awn property to be sure
that the property line between his property and the subject is correct.

The board considered the development of the entire corner to the north
and east �f tne subject site, and the possible consequences of �rantin� waivers
to t�ti e�:tent requested by Mr. Cooperman.
LeRay Anderson moved to deny all the waivers as requested, and it was
seconded by 'vJalter Kost and carried unanimausly,
�'he last item of business was consideration of the boardis requirement
for a certi.fied copy of a current survey to be provided by each petitioner.
Z?�e term cu�rent survey was discussed, and it was decided that current would
mean:
1. With vacant land, a survey th�t correctly shaws the
parcel 'as it exists at the time of the petition.
2. With lan� oceupied by struetures, a survey which has
the location ard size of those strtzctures show.n by
the �.rveyor as they are at the time of the petition.
There being no further business to come before the meeting, it was on
motion, duly seconded, adjourned at 9:30 P.M.
