MINUTES OF A REGULAR MEETING OF THE

The regular meeting of the Golden Valley Board of Zoning Appeals was
h eld Tuesday, May 9, 1972 at 7:30 p.m, at the Golden Valley Civic Center,
7800 Golden Valley Road, Golden Valley, Minnesota. The following Board
members were �resent:
Mike Sell
Mahlon Swedberg
LeRoy W. Anderson
Donald E. Franzen
Walter Kost
Mike 5�11, Chairman of the Board, presided and Jim Ingemunson acted
as Recording Secretary.
The first order of business was the consideration of the minutes of
the meeting of the Board held on April 11, 1972, copies of which has been
distributed to the Board. It was moved by Mahlon Swedberg, seconded by
Walter Kost, carried unanimously, to approve the mznutes of the meeting
held on April 11, 1972.
The Chairman then brought before the meeting the following requests
for waivers:
72-5-5 1510 Aquila Ave. No. (Ma� 20) Residential Robert C, Erhardt
The �etition is for the waiver of Section
3.07 (3B) for 1�.65' off the required sideyard setback distance
of 12.95` to a setback distance of 8.30' from the
South property line to the Southwest corner of the
t�roposed attached garage only.
3.07 3B for 3.96" off the required sideyard setback distance
of 12.95" to a setback distance of 8.99' from the
North property line to the Northeast corner of the
existing house only.
Present to make the request was Mr. Robert Erhardt, the property
owner. Mr. Erhardt explained his �lan for the proposed garage addition.
The Board examined the proposal, and the survey of the subject property.
The� found that it would be possib le to construct a double detached garage
on the site without the need of a waiver.
Walter Kost motioned to deny the waiver as requested for the proposed
garage addition, and to approve the waiver as requested for the existing
sideyard variance on the North side of the dwelling. It was seconded by
LeRoy Anderson and carried unanimously.

The petition is for thw waiver of Section
3.07 (1.) for 20.3` ofF the required f rontyard setback distance
of 35' to a setback of 1Lt.7' from the West property
line along Byrd Ave. to the proposed attached garage
only.
3.�J7 3B for �.77' off the required sideyard setback distance
of 12.37' to a setback of 7,6' from the IVorth property
line to the existin g dwel�ling and proposed gara�e
addi�ion only.
Mr. Wi11is S_k.�nne.r, the owner, and his builder, Mr. Edwin Haftings
were present to request the waivers.
The Board examineci the proposal for a garage addition to the existing
house. It was noted that this house sets on an unusally steep slope, and
t�at the only existing off street parking is a very steep driveway leading
up to the house.
Mahlon Swedberg motioned to approve the waivers as requested with the
following conditions:
1. That the grade on the south side of the propsoed garage be
brought up to the roof level of the garage on that side.
2. That a safe��rt railing be pro+rided on the west and north side
�f garage roof deck.
3• That the west side of the proposed garage be f aced with a
bricre surface cotrrpatible with that of the existing house.
The motion was seconded by Walter Kost and carried unanimously.

The petition is for the waiver of Section
5.05 (B) for 12.►�0` off the required sideyard setback distance
of 20' to a setback of 7.60' from the West property
line t� the existing structure onl�r.
and for 16.l�0' off the required sideyard setback
distance of 20' to a setback of 3.60' from the
East property line t� the existing building only.
and for 10.70' off the required sideyard setback
distance of 20' to a setback of 9.30' from the
East property line to the proposed addition only,

Present to request the waiver was Mr. Glen Burnett of Volp Con-
struction Co, and Mr. Donald Fo rd of Cosom Industries. Also present
as interested parties were Mr. Henry Hagen owner of Midland �elding,
and his Attorney, V. Owen Nelson.
After hearing the request for the waiver, and seeing the prop�i���
plan, Mr. Nelson explained that his client was concerned about the
vacation of an access easement in the area where the proposed addition to
Cosom was planned.
Don Franzen moved to defer the hearing of this petition for a
maximum of six months, and requested that the appealant obtain an
agreement in writing on the easement in question, and that this agree-
ment be examined by the Village Attor:iey for his opinion.

The petition is for the waiver of Section
5.05 B for 3.2 ' off the required sideyard setback distance
of 20' to a setback of 16.8' fro m the North line to
the existing structure only.
Glen Burnett was present to make the request for Oken's. He
� ex�lained that the waiver requested is for an existing condition.
Don Franzen moved to grant the waiver as requested, It was seconded
by LeRoy Anderson and so carried.
There being no further business to come before the board, it was on
- a m�tion, duly seconded, adjourned at 10:00 p.m.
