11-14-72 BZA Minutes � �3 7 MINUTES OF A REGULAR MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS NOGEMBER 14, 1972 The regular meeting of the Golde� Valleq Board of Zoning Appeals was held Tuesdaq, November 14, 1972, at 7:30 P.M., at the Golden Valleq Civic Center, 780U Golden Valley Road, Golden Valleq, Minnesota. The following Board ffiembers were present: Mahlon Swedberg Mike Sell LeRoy W. Ander�on Don Franzen Mike Sell, Chairman of the Board, presided and Jim Ingemunson acted as Recording �ecretary. The ffrst order of bnsiness was the consideration of the minutes of the meeting of the Board held on October 10, 1972, copies of which had been distributed to the Board. It was snoved bq Mahlon Swedberg, seconded by LeRoy Anderson carried unanimously, to approve the minutes of the meet- ing held on October 10, 1972. The Chairman then brought before the meeting the following requests for waivers: 72-9-18 (Map 15� Residential Crestview Ave, & Manor Drive Richard Dempsey Lot 16 Block 6 Delphian Hei�hts 3rd Unit The petiCion is for the waiver of Seetion 3,07 (1) for 15' ofi` the required frontyard setback of 35' to a setback of 20` from the East propertp line along Crestview Ave., to the proposed dwelling onlq and also for the waiver of section. 3.07 (1) for 33' off the required 35' setback distance to a setback of 2' off the South property line along the platted right-of-way for Manor Drive to the proposed ' dwelling onlq. Present to petition for the waiver was Mr. Richard Dempseq. Also present were seven property owners from the vicinitp of the subject lot. The board noted that the Planning Commission and Council had recently approved the lot division and combine creating the lot in question, and that as a condition to that approval, a dedication of lU' of land on the West side of the platted lots was given for a eul-de-sac on Kewanee Waq, and there is to be no driveway built on the Village right-of-way for Manar Drive to serve the Southerly most lot. �:; Mr. Dempseq presented a plan for the lot, and a topographic survey made by Caswell and Associatesr The plan showed a proposed house 2U' back L✓ t� l_i Board of Zoning Appeals November 14, 1972 from Crestview Avenue, and 2' back off Manor Drive. The board examined the plans, and the survey, and discussed the proposals, and possible alternatives. Property owners from the following addresses e.�camined the plan, and expres- sed disapproval of the proposal: 3512 Manor Drive M. E. Black 3524 " " A. A. &orman 2312 Crestview Ave. J. G. Zroker, Jr. 2322 " " R, C. Pelant 2500 Kewanee Way L. Schiestl The board discussed the possibility of moving the proposed house $' or 12' North, or of designing a house that would betCer suit the difficult lot. Mahlon Swedberg moved to deny the waiver as requested, and the motion died for lack of a second. LeRoq Anderson asked the petit�oaer if he could reconsider the proposed plaa and location and the reply was negative. Mahlon Swedberg again moved to deny the waiver as requested and it was second- ed by LeRoy Anderson and carried unanimously. 7_2-11-27 2555 Kewanee Wav (Map S) Residential Richard Dempsev The petition is for the waiver of Section 3.Q7 (1) for 10' off the required frontyard setback distance of 35' to a setback of 25' from the EasC propserty line along Dewanee Waq to the proposed dwelling onlq. Mr. Dempseq was present to request the waiver. Also present as an inter- ested party was Mr. L. Schiestl, the home owner at 2500 Kewanee Way. The board listened to the petitioners explanation for the proposed house, and questioned hi� on some of the details. It was noted that the proposal was for a single family d�relling with no garage. There would be space for a future sfngle attached garage if the present request was expanded to cover a future garage addition to the South. Mr. Schiestl stated that he was opposed to the requested frontqard setback variance, and was concerned that this house and the one directly to the I3orth �rould have cars parked on the street which is at this location on a slope, and near a sharp turn. Don Franzen �goved to approve the variance of the front yard setback, and the motion died for lack of a second. After further discussion, the Board asked Mr. Dempsey if he would consid- er including a garage in his present building proposal, and he stated that he would not. 6 ) �y Board of Zoning Appeals � November 14, 1972 LeRoy Anderson �aoved to deny the petftion as requested. McDonald The petition is for the waiver of Section 3.07 3a for 2.4' off the requixed sideyard setback distance of 15' to a setback of 12.6' from the South propertq line to the propbsed g�rage addition only. Mr. MeDonald from UNSCO was present to request the waiver. He ex- plained that due to the grade of the lot, and th� water problem at the back of the lot this proposal was the only practical solution for in- creasing the size of the present si�gle attached garage. LeRop Anderson moved to aceept the petition as requested, aad it was seconded by Mahlon Swedberg and so carried. 72-11-28 5250 Wavzata Blvd. (Map�9 Z, Commercial Ralph Green The petition is for the waiver of Section 5.05 B for b.42' off the required 20' sideyard setback to a setback distance of 13.�8' from the West propertq line to the exis:tinE building only, and for 14` oFf the required 20' sideyard setback to a setback distance of 6' from the West propertq line to the proposed addition onlq. Mr. Grecn was present to request the waiver. Also present were two of the four docCors now located in the Tyrol Clinic. They presented plans for the proposed addition, and answered questions from the board on the proposal. It was noted that the petitioner owns the land on both sides of the subject, and that the propertp owner to the North was informed of the pro- posal and the meettng to consfdex it. Don Franzen moved to grant the nariance as requested in the petition, and it was seconded by Mahlon Swedberg and so carried. 72-11-29 8325 lOth Ave. No. �,Map 21) Lit�ht Industrial Placet Inc. . The petitioner requests the board to consider the decision of the Village zoning Admin�strator, Jon Westlake, concerning their setting up business tn Premier Realty buildtng on Lot 10, Busch's Golden Valley Acres, which is zoned light industrtal. Secondly, if the board agrees with Mr. Westlake's decision, the petitioner requests the waiver of Section ' 6.02 to allow Placet Inc. to operate in the bnflding cn Lot 10, Bus�chts Golden Valley Acres. G�V Board of Zoning Appeals November 14, 1972 The board examined the letter from Placet Inc., to the Village of Golden Vallep, �nd Lhe letter from Jon We�tlake to Plaeet Ine. The board also wished ta note that all the regular members of the B.Z.�., had toured Placet Inc., present establtshment at 5000 West 35th Street in St. Louis Park. The board also revieared the uses lfsted for the Light Industrial and Industrial Zoning districts. Mahlon Sraedberg moved to accept the op�nion of Jon �Testlake as it was stated in his letter to Placet Products Inc. , and dated November 7, 1972, as a correct interpretation of See. 6.02 uses premitted in the Light Industrial Zon3:ng district. The board then considered Placet�s xequest to �aive Section 6.�2 to allow their company to oper�te out of the building on Lot 10 Busch's Golden Valleq Acre�. Mahlon Swedberg moved to deny the waiver of See. 6.02 for the pur- pose of this request, and it was seconded by Don Franzen and carried un- animonslq. 72-11-3� 7520 Winnetka HeiQhts Drive (kiap 14) Residential Earl Wilson The petition is for the wafver of Section 3.07 (3a) for 2' off the required sideqard setback distance of 15' to a setback of 13' from the West propertq line to the protrusion o� the fireplace only oa the West side o� the proposed dwelling. Mr. Wilson was present to request the waiver. He described the proposed house and presented plans for the structure. Don Franzen moved to grant the waiver as requested, and it was seconded bp LeRoq Anderson and so carried.
