MIN[JTES OF A REGULAR MEETING OF THE
GOLDEN VALLEY BOARD OF ZONING APPEAI.S
DECEM�ER 12, 1972
The regular meeting of the Golden Va11eq Board of Zoning Appeals was
held Tuesdap, December 12, 1972, at 7:3U p.m., at the Golden Vallep Civic
Center, 78U0 Golden Valley Road, Golden Valleq, Minnesota. Ttie following
Board members were gresent:
Mahlon Swedberg
LeRoq W. Anderson
Walter Kost
Jim Ingemunson acted as Recording Secretary, and in the absence of the
regular Chairman, Mike Sell, the Secretary opened the meeting and called
for the election of a Chairman Pro-�Tem.
Mahloa Swedberg was nominated, and elected as Chairn�an Pro-Tem. A4r.
Swedberg then brought the following items before the board for considera-
tion.

The petition is for the wafver of Section
10.04 to allow an additional two stories to the maximum
allowable of one storq for a total of three stories.
Also to allow the additional height of an elevator
penthouse and microwave tower. All waivers being
based oa a set of plans presented by the proponents
and marked exhibit ''A'' and filed in the �Dillage Build-
fng Department.
Present to request the waiver were Mr. Richard Levine, architect for
Metromedia and Mr. Leo Domeier from WTCN. They presented preliminarq plans
and renderings for a proposed television studio and mierowave transmitting
tower.
The board reviewed the past historq of proposals oa this site. One
neighboring propertp owaer, Mr, D, V, Ralph of 440 Deeatur Ave, appeared
and spoke in opposition to the proposal.
The board noted that while there are office'buildings in Golden Valleq
that are as tall as the main part of this proposal, the microwave tower
��ves thfs buildfng a special character and that the Village Counci3 should
have the opportunity to review the proposal.
LeRoq Anderson moved to denq the request, and it was seconded bq
Walter Kost and s4 carried.

The petition is for the u�afver of Section
3.07 (1) for 3.1' + or - .10' o�f the required frontyard setback
distance of 35t to a setback of 31*9' + or - fro�
the North property line along Knoll Street to the
existing dwelling only, as shown oa survey bq McCombs-
Knutson Assoc. Inc., and dated December 5. 1972.
Mr. Jodan was present to request the waiver. He e�plained that he was
selling the property, and the waiver would a11ow him to transfer the prop-
erty with a clear title.
The board noCed that the wafver is for the existing strueture only.
LeRoy moved to grant the waiver as requested and it was seconded bq

The petition is for the raaiver of Section
13.02 (D) for 10' off the required landscaped area along
the �test property line Co a landscaped area of
0' on that side only, and exCending the length
of Che present parking lot onlp.
Mr. John Sicora was present to request the waiver.
The board examined the elevation as shown on a survey done by the
Village survey erew, and noted that the appealant does have a water problem
at the Southwest corner of his l�it, It was also noted that this building
and its parking lot were buflt before the present zoning code went into
effect. Mr. Sicora stated that he would be willing to re-establish the
required 10' of Iandscaping on the West propertq line from the front pro-
perty line to the building setback line of 35'.
LeRoy Anderson moved to grant tfie waiver of the 1Q' of landscaped area
on the West side of the subject propertq fro;s a pofnt 35' North of the South
property line and extending the Iength of the present parking lot only.
It was seconded by Walter Kost and so carried.
The final item to be considered was a claim bq a builder, Normaa Neilsen,
of the existance of a S` waiver €rom the frontyards of Lots 1 & Z Block 3,
Heathbrooke 2nd Addn. Revised, as given fn the platting of the lots. This
would allow a 30' frontpard setback on these lots. Mr. Neilsen claims that
these waivers were not recorded in the minutes of the Planning Commission or
Council.
LeRoq Anderson moved to defer a decision on recognition of these wainers
until a written statement can be obtained from at least two of the parties
involved with the Planning Com�tssion or staff at the time of the Heathbrooke
2nd platting. Walter Kost seconded the motion and it was so carried.
