07-09-74 BZA Minutes �>>: :... . . .. . . !)/� . ! l_lrJ"� MINUTES OF A REGULAR MEETING OF 7HE GOLOEN VALLEY BOARD OF ZONING APPEALS JUIY 9, 1974 The regutar meeting of the Golden Valley Board of Zoning Appeals was held Tuesday, July 9, 1974 at 7:30 P.M. at the Golden Valley Civic Center, 7800 Golden Vatley Road, Golden Valley, Minnesota. The following Board members were present: Walter Kost Mahlon Swedberg Mike Sell Oonald Hughes The recording secretary was James Ingemunson, and in the absence of the Chairman, LeRoy Anderson, the secretary opened the meeting and asked for nominations for the position of Chairman Pro-tem. Mahlon Swedberg moved to nominate and elect Watter Kost, Chairman Pro-tem, for July, and it was seconded by Mike Sell , and so carried. The next order of business was the consideration of the minutes of the meeting of the Board held on June 11 , 1974, copies of which has been distributed to the Board. A correction was made, deleting fihe a�ork "of"from the first line of the first paragrpah on page four. There were no further corrections or changes. Mike Sell moved to approve the June tlth minutes as corrected, and it was seconded by Mahton Swedberg and so carried. 7�+-7-13 3015 Golden Va) ley Road (Map 1 ) Residential Mary Critelli The petition is for the waiver of Section 3.02 (1 ) & 3.041 to allow the existing house at 3015 Gotden Valley Road to be used as a double house. The appealant was not present and had informed the secretary that he would not be ready for a hearing at this time. Mike Sell moved to defer this item untit the next regular meeting. It was seconded by Mahlon Swedberg and so carried. ]4-7-14 g17 No. Litac Drive (Map 12) Radio Zoninq K RS Radio The petition is for the waiver of Section 5.05 B for 93.7' off the required sideyard setback distance of 100' to a setback of 6.3' from the North property line to the existing building and its' proposed addition only. � � ��..1ti7 Board of Zoning Appeats July 9, 197� and for waiver of Section 5.05 B for 71 .3' off the required sideyard setback of )00' to a setback distance of 28.7' from the South property line to the exisfiing building and 47.3' to the proposed addition only. Present to request the variance was Richard Poe, Vice President and Generai Manager of KQRS. Also present were Terry Stripsky and John Schnell , members of the station's staff. Mr. Poe presented a letter of ownership, and proceeded to describe the need for the proposed addition. Ne said the reason was three-fold. To pravide more adequate work space within the building; to provide space for new equipment which would replace some existing equipment, �nd to provide accousticatly improved studios to remedy the present problems with sound from Highway #100 and Golden Va11ey Fire Station, number two. Mr. Poe said that the station would be refurbishing the exterior of the old building, and would be willing to screen the trash area on the site. The Chairman noted that there were signatures of approval from several surrounding property owners. The Chairman also asked Mr. Poe if this remodeling would require any addition to the three towers on the site, and Mr. ,Poe's answer was "no sir". This question was asked again later by another rnember of the Board and the aswer again was negative. The petitioner was alo questioned about alternative building areas on the site, and it was shown that the rear area was restricted by poor soil and the supporting cables and ground wires for the towers. There were no persons present in opposition to the requested variance. Mahlon Swedberg moved to approve the variances as requested, with the condition that the present dumpsters be screened, and that the exterior refurbishing be included ir� the remodeling. It was seconded by Mike Sell , and carried unanimously. 7�+-7-15 5301-33rd Ave. No. (Map 3) Residential Earl Wilson The petition is for the waiver of Section 3.(J2 (i ) � 3.041 to aliow a double bungalow on this vacant )ot. Present to request the variances was Mr. Earl Wilson. Also present were several neighboring property owners. The Chairman reviewed the application and noted that consent was given by two neighbors and one had signed as undecided. �/+, / ��;<; !2' l i S ,� RJ�.,p'�.3 Board of Zoning Appeais ,1u1 y 9, 1974 The general comments from the neighboring property owners referred to the open ditch that runs along the edge of this property,. and about the wat�r. problems that have plagued this area. What opposition there was did not focus on a double house versus a single house, but rather on any type of construction that might aggravate the present water probtems. The Board agreed that there is a serious storm water problem in the ?rea but noted that this was beyond their authority to remedy. The Board pointed out that the question before them was whether the site should have a single or a double house on it. Mahlon Swedberg moved to defer this item for one month, and thereby give Mr. Wilson a chance to prepare a specific plan for the lot , and obtain a minimum elevation from the Vitlage Engineer. The motion also requests that the Village Endineer give his opinion on the possible effects of a double versus a single dwelling on this site, and the possible impact these would have on the flooding problem in this area. It was seconded by Mike Sell and so carried. 7�-7-16 1806 Zephyr Place (Map 1 ) Residential-Eart Wilson The petition is for the waiver of Section 3.07 (1 ) for 20' off the required frontyard setback distance of 35' to a setback distance of 15' from the North— east property line along Zephyr Place to the pro— . posed single family dwelling only. Present to request the variance was Mr. Earl Wilson, the owner and builder. The Chairman reviewed the petition and noted that several neighboring property owners were present and interested in the proposed house. Mr. Erickson from 1812 York Ave. No. said that as president of the Meridian Water Association, he could not allow another water service because the system was already overloaded. Other interested neighbors present were Mr. � Mrs. Maraggos from 1810 Zephyr Place, and R. C. Quist from 1815 Zephyr Place. The neighbors were also concerned about the possible loss of trees, and the obstruction of the view that could resutt from construction on this site. Mike Sell stated that these things may happen with or without a variance, and that the question was whether or not this lot deserves a variance. Mike Sell moved to accept the variance as requested based on the lots topography, and it was seconded by Donald Hughes and so carried. .. .. , � � C!V r6 Board of Zoning Appeals July 9, 1974 71+-7-17 1359 Flaq Ave. No. (Map 20) Residential Earl Wilson The petition is for the waiver of Section 3•07 3c for .33' off the required sideyard setback distance of 5.84' from the North property line to proposed dwelling only. and for the waiver of Section 3•�7 3c for 6.5' off the required sideyard distance of 12.34' to a setback of 5.84' from the South property line to the proposed dwelling only. Present to request the var.iances was Earl Wilson. Mrs. J. Ettinger from 1501 Flag Ave. N. was present as an interested neighbor. She gave her consent for the variance when she saw the locations of the proposed homes. The Chairman noted that items 74-7-17, 74-7-18, 74-7-19 and 74-7-20 are al � of the same nature and req�ested by the same proponent. Therefore, the general discussion of the sideyard variances could cover atl four lots while the actions taken would be for each tot separately. The Board found that Mr. Wilson is planning four separate one story houses with attached garages, and that these would be walkouts to the West with the living areas including decks on the West side to take advan- tage of the lots elevation and slope. It was also noted that Mr. Wilson had constructed a retaining wall and trench to help take care of the water run off that has been a problem. The Board also reviewed the blanket waiver on the frontyard setback that was given in 1965 by the Planning Commission.
