MINUTES OF A REGULAR MEETING OF TNE
GOLDEN VALLEY BOARD OF ZONING APPEALS
AUGUST 13, 1974
The regular meeting of the Go)den Valley Board of oning Appeals
was held Tuesday, August 13, 1974 at 7:30 P.M, at the Golden Vattey Civic
Center, 7800 Golden Vaiiey Road, Golden Valley, Minnesota. The following
Board members were present:
LeRoy Anderson
'Walter Kost
Glen Christiansen
Donald Nughes
LeRoy Anderson, Chairman of the Board, presided and Jim Ingemunson
acted as recording secretary.
The first order of business was the consideration of the minutes for the
meetings of July 9th and July 29th, copies of which had been distributed
to the Board. It was moved by Glen Christiansen and seconded by Walter
Kost to approve the minutes of both July 9th and July 29th as written, and
it carried unanimously.
The Chairman then brought the foliowing items of business before the
Board.
74-8-21 9235 Medicine Lake Road (Map 19) Commerciat R. C. Ernst
The petition is for the waiver of Section
5.05 B for 18' off the required 50' setback distance to a
setback distance of 32' from the East property line
along the institutional zoning to the proposed building
only.
Present to speak for the variance was Richard Ernst, Sr. He reviewed
the background of the present proposal . His basic reason for requesting
the variance is the width of the subject lot from East to West. The
variance would altow two rows of parking on the West side of the proposed
building.
Also present were Mr. Radimaker, a neighboring businessman, and his
attorney, Mr. David Sellergren. They were opposed to the variance.
Tfie Board then di.scussed the matter among themselves and there was a
difference of opinion regarding the justification of this variance.
Glen Christiansen moved to deny the waiver as requested and it was
seconded by Don Hughes. The vote was sptit with 3 aye and 1 nay, and the
motion carried. Walter Kost cast the descending vote.

The petition is for the waiver of Section
3.02 (1 ) � 3.041 to allow a double bungalow on this vacant lot.

Present requesting approval for the clouble house was the property
owner, Earl �lilson.
The Board reviewed their actions on this matter from the last regular
meeting of the Board. They found that Mr. Wilson has now prepared a ptan
and elevation for the house, and that the Village Engineering Department
witl set the minimum elevation at the time the buitding permit is issued.
The Board noted that there would be no other variances requested for
this house, and that the only real objection to this proposal was the
potential this might have in adding to the neighborhoods water problem.
The water problem would also be there with a single house, however.
Walter Kost moved to approve the double house on this lot and it was
seconded by Glen Christiansen, and so carried.
74-8-22 1021 Rhode Island Ave. N. (Map 16) Residential Richard T. Martin
The petition is for the waiver of Section
3.12 (1 ) for 3' off the required sideyard setback distance
of 5� to a setback of 2' from the South property
line to the proposed double detached garage only.
Present requesting the waiver were Mr. & Mrs. Richard Martin.
The Chairman reviewed the application and noted that consent has been
obtained from the adjoining property owners. It was alo noted that a
similar variance was granted on this street about a year ago.
Don Hughes moved to approve the variance as requested, and it was
seconded by Watter Kost and carried unanimausly.
74-8-23 4500 Elmdale Road (Map 4j Residential Elmer Hilger
The petition is for the waiver of Section
3.07 (3a) for 1 .5' off the required sideyard setback distance
of 15' to a setback distance of 13.5' from the West
property 1ine to the Southwest corner of the pro—
�osed garage addition only.
and for Section
3.07 (2) for 6.6' off the required rearyard setback distance
of 17.6' to a setback of 11 ' from the rear pcoperty
line to the proposed garage addition only.
and for Section
3.07 (1 ) for 16' off the required 35' frontyard setback
distance to a setback distance of 19' from the
property line along Elmdate Road to the existing
single family dwelling only.

and for Section
3.07 (1 ) for 3.5� off the required 35' frontyard to a front-
yard setback of 31 .5' from the property line along
Lee Ave. No. to the existing single famity dwelling
only.
Mr. � Mrs. Hilger, the property owners, were present to request the
variances.
The Chairman reviewed the petition, and found it to be complete. The
Board then examined the plans for the propsed addition and noted that the
additian would still a) low nearly 40' between this house and its closest
neighbor to the West, also an existing ctoset inside the present garage
caused need for the double garage to be wider than the usuat minimum size.
Walter Kost moved to grant the waivers as requested, and it was
seconded by Don Hughes and so carried.
]4-8-24 2400 McNair Drive (Map 1 ) Residential Robert Shellum
The petition is for th� waiver of Section
3.12 (1 ) for 7' off the required building separation distance
of 20' to a separation of 13' from the existing
house to the proposed garage only.
Mr. Shellum was present to request the variance. He described the
proposed •detached garage construction and answered the Board's questions
concerning its' iocation on the lot.
Don Hughes moved to approve the variance as requested, and it �ias
seconded by Glen Christiansen and so carried.
7�+-7-13 3�15 Golden Vatley Road (Map 1 ) Residential Mary Critelli
The petition is for the waiver of Section
3.�2 (i ) � 3.041 to ailow the existing house at 3�15 Golden
Valley Road to be used as a double house.
The petitioner ' s application was not complete, and on motion, duly
seconded and carried. _ This item was deferred until the next regular
meeting in September.
There being no further business to come before the meeting, it was on
motion, duly seconded and adjourned at 8: 30 P.M.
