10-14-75 BZA Minutes ��� �,� �� _ MINUTES OF A REGULAR MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS October 14, 1975 The regular meeting o£ the Golden Valley Board of 2oning Appeals was held Tuesday, October 14, 1975 at 7:30 P.M. at the Golden Valley Civic Center 7800 Golden Valley Road, Golden Vailey, Minnesota. The following Board members were present: Mahlon Swedberg, Chairman LeRoy Anderson Mike Sell Donald Hughes, Planning Commission Representative Mahlon Swedberg, Chairman of the Board, presided and Jim Ingemunson acted as recording Secretary. Mike Se11 moved to accept the minutes of the meeting of September 16, 1975 as written, seconded by Don Hughes and so carried. The Chairman then brought the following items before the Board: 75-10-26 (Map 5) 2565 Kewanee Way Residential Ernst Albrecht: The petition is for the waiver of Section 3.07 3C for 5.894' off the required South sideyard distance of 13.294' to a setback of 7.40' from the South property line to the proposed garage addition only. Present to request the variance were Mr. & Mrs. Ernst Albrecht. The Chairman reviewed the petition and found it to be in order. The secretary gave some brief historical information on past waivers granted on this street. Mike Sell moved to grant the variance as requested, and explained that he felt there is a clear cut case for the waiver. It was seconded by LeRoy Aiiaerson and carried unanimously. 75-10-27 Ma 15 1620 Florida Ave. No. Residential James M. Valkevich: The petition is for the waiver of Section 3.07 for 1' and 8' off the frontyard setback distance of 35' to setback of 34' and 27' from the North property line to the respective existing Northwest and Northeast corners of the existing atitached garage. and for the waiver of Section 3.07 for 8' and 15' off the required 35' setback to a set- back of 27' and 20' to the respective Northwest and Northeast corners of the proposed �arage addition only. ,�;�'-; �'�,:',:? Board of Zoning Appeals October 14, 1975 and for the waiver of Section 3.07 for 5.5' off the required 35' setback distance to a setback distance of 29.5` from the North property line to the Northeast corner of the proposed family room addition only. Present requesting the variance was Mr. James Valkevich, his wife, and one neighboring property owner. The Chairman reviewed the petition and found it to be in order. Mr. Valkevich then described his plans for a garage expansion, and a family room addition, and the board questioned the proponent on the len�ht of time he has lived in this house, and other possible alter- natives for expansion of this house. Chairman Swedberg, and board member Anderson explained that they did not feel that the reasons for the proposed variance would fall within their definitions of hardship. The proponent and the board then discussed the idividual waiver requests. LeRoy Anderson moved to grant the waiver of 3.07' for the existing structure only, and it was seconded by Mike Sell. The motion carried unanimously. Mike Sell moved to deny the waivers for the proposed garage expansion and family room, and it was seconded by LeRoy Anderson. In discussing the question, the proponent expressed a willingness to reconsider the proposed variance. LeRoy Anderson withdrew his second of the motion, and Mike Sell withdrew � the motion. Mike Sell moved to hold this item over until the next regular meetin�; in November. It was seconded by Don Hughes and so carried. The Chairman called a five minute recess, and the meeting xesumed with the following request for variance. 75-10-28 (�iap 20) 1431 Orkla Drive Residential Flovd Boline: The petition is for the waiver of Section 3.Q7 for 19.2' off the required 35' front setback distance to a setback of 15.8' from the East property line alon� Orkla Drive to the proposed garage addition only. �;��'�� Board of Zoning Appeals October 14, 1975 Present requesting the were Mr, & Mrs. Floyd Boline. The Chairman reviecaed the petition application and background material, and found everythfng in order. The board members then examined the proposed garage and family room addition, and discussed the variance. The Chairman was not in favor of a waiver of this magnitude on a front yard setback. LeRoy Ander- son also expressed ob�ection to this particular variance. Mr. Boline and the board discussed some alternate garage plans, and the proponent said he would like some time to consider the alternatives. LeRoy Anderson moved to hold this item over until the next regular meet- ing in November, and it was secanded by Don Hughes, and so carried. 75-1�-29 Ma 20 8555 Duluth St. Residential Richard A. Bowman: The petition is for the waiver of Section 3.07 for 2.Ob' off the required street side setback distance of 35' to a setback distance of 32.94' from the North property line along Duluth Street to the proposed entry addition only. and for the waiver of Section 3.07 for 1.45` off the required street side setback distance of 35' to a setback distance of 33.55' fram the West property line to the proposed addition only. and for the waiver of Section 3.07 for 1.45` off the required 35' setback distance to a setback of 33.55' from the West property line to the existing dwelling only. Present requesting the variance were Mr. & Mrs. Richard Bowman and their architect. The Chairman reviewed the petition and found it to be in order. Mr. and Mrs. Bowman explained their proposed addition of a new front entry and a family room. Mr. Bowman described the problems they were having with the present front door, and the cold Northwest winds which not only damaged the door, but also caused cold drafts in the living area of their home. The setback variance for the family room would be primarily to improve the appearance of the proposed addition. LeRoy Anderson moved to approve the setback variance for the existing structure only, and it was seconded by Don Hughes, and carried unan- imously. The board then went back to discussing the variance for the front entry. ��,� �, �.� Board of Zoning Appeals October 14, 1975 Mr. Anderson felt that the hardship described could be alleviated with- out the requested variance. LeRoy Anderson moved to deny the waiver for the front entry on1y, and it was seconded by Mike Sell. After further discussion, the motion carried with 3 in favor and 1 (Uon Hughes) against the motion. The board then considered the setback variance for the proposed family room. LeRoy Anderson moved to grant the proposed variance of 1.45' off the setback for the new family room addition. The �otion was seconded by Don Hughes and carried with 3 ayes and 1 nye (Mahlon Swedberg). As a final item of business Chairman Swedberg discussed his meeting with the Mayor on the B.Z.A. budget.
