MINUTES OF A REGULAR MEETIN� OF THE
GOLDEN VALLEY BQARD OF ZONING APPEALS
JULY 13, 1976 �
The regular meeting of the Golden Valley Board of Zoning Appeals was held
Tuesday, July 13, 1976 at 7:30 P.M, at the Golden Valley Civic Center,
7800 Golden Valley Road, Golden Valley, Minnesota. The following members were
present:

Also present was Lloyd Becker, staff liaison and recording secretary.
The first order of business was the consideration of the minutes of the meeting
of the Board held on June 8, 1976, copies of which had been distrjbuted to the
members of the Board. Chairman Sell reviewed the minutes with the Board, and
there being no omissions, errors, or corrections, upon vote, motion to accept
the minutes as presented was seconded and carried unanimously.
76-6-13 3106 Manor Drive (Map 1) Residential Terry LeDell
Mr. and Mrs. LeDell were present for the hearing.
This petition was layed over from the June 8, 1976 meeting for the owner to
revise and re-submit alternate plans. The oriqinal waiver request was for 5.65'
off the required 15' sideyard setback to a setback of 9.35' from the west
property line to the proposed qarage addition.
Mr. LeDell presented alternate plans reducing the addition by 2' rvhich would
then require a waiver of 3.65' off the required 15' to a distance of 11 .35'
from the west property line.
Upon discussion it was moved by LeRoy Anderson and seconded by Mahlon Swedberg
to approve a waiver of 3.7' from the 15' sideyard requirement on the west
property line to the proposed addition. Upon vote, motion carried unanimously.
76-7-16 1530 ��#est Constance Drive (Map 11 ) Residential Sherwin J. Alpert
The petition is for the waiver of Section
3.07 (3) for 7' off the required 15' sideyard setback to a distance of
8' from the north property line to the proposed garage.
The Chairman reviewed the application and it was in order.
Mr. and �lrs. Alpert were present for the hearinq. Also present for Mr. and Mrs.
Alpert was Mr. E. Kallerup of Kallerup Construction. Mr. Kallerup had a sketch
of the proposed garage and family room. This was reviewed by the Board, and it
was thoroughly discussed for clarification with the Alperts.

Mr. A. L. Robertson, 1541 West Canstance Drive, appeared to obaect to the
proposal, primarily that the proposed projectian to the front of the existing
home would detract from the aesthetics of the nei�hborhood. Nlrs. Henry M. Ye,
1619 East Constance Drive, appea red and called attention to her opinion that
the existing 15' separation is desirable and she wauld like to see it maintained.
Durina the discussion it r�s noted by the Board that an existing single car
detached ga rage on the soutM side of the property could be easily expanded to a
double car garage, and the possibility of construction of a family room cauld
be done without a need for waivers. During discussion the Alperts and their
contractor revised their request to 5' off the required 15' to a distance of 10'
from the property line to the praposed garage.
Mahlon Swedberg moved and Glen Christiansen seconded the motion to approve the
variance subject to the conditions that the existing single car garage be
removed and never rebuilt, and that the Alperts comply with all ordinances and
any deed restrictions if they exist and valid. The motion was called and upon
vote Mahlon Swedberq and Glen Christiansen voted yes, and Sell , Anderson, and
Lundsgaard voted na.
This motion and action was questioned later in the meeting and a second motion
to deny Al�ert's petition �s made by LeRoy Anderson, seconded by Warren Lunds-
�aard and upon vote, 3 nays and 1 aye, with Mahlon Swedber4 questionin4 the
necessity of the second motion.
76-7-17 775 Colorado Ave. S. (Map 13) Industrial C . Robert Volp
The petition is for the r�iver of Section
5.05 for 20' off the required 35' landscape on the north side,
for 30' off the required 35' landscape on the west side,
for 10' off the required 10' landscape on the south side,
for 35' off the required 35' of landscape on the northeast
corner of the property only (Colorado Circle) .
The petition for the waiver of Section 5.05 (Yard Requirement} is to allow
construction of the proposed addition and to provide the required parkinq area
for the building.
Mr. C. Robert Volp was present.
The petition requirements were reviewed by Chairman Sell and were in order.
The Board and Mr. Uolp proceeded through the petition and each item was discussed
and compared in its relation to the plot plan as presented. The present building
has several non-conforming areas and the proposed addition requires that these
be considered. To meet the required parking, the green area would need substantial
r�aivers. A detailed and lengthy discussion of the parkinq and green area was
held with Mr. Volp and subsequently a mation was made by LeRoy Anderson and
seconded by Mahlon Swedberg to deny the petition. Discussion was called, and
upon further review LeRoy Anderson withdrew his motion and Mahlon Swedberq
his second.

• The plot plan as submitted was further reviewed and green areas drawn and
outlined by the Board. This plot was designated as Exhibit "A".
Exhibit "A" was made a part of the permanent record and the green areas as shown
are conditional for any permit to be issued. A waiver for 15 parking spaces is
also noted. A motion was made by Glen Christiansen in accordance with Exhibit "A"
to grant those areas as shown and for 10' off the required 10' landscape on the
south side and for 35' off the required 35' landscape on the northeast corner
of the property only (Colorado Circle), as requested in the Volp petition.
The motion was seconded by LeRoy Anderson and upon vote, motion carried.
(Note: The Exhibit "A" was signed by all Board members and Mr. Volp and is
maintained on file.)
76-7-18 7931 and 8021 Wayzata Blvd. (Map 23) Business & Professional S.S. Thorpe Ji
The petition is for the waiver of Section
i0.04 (height) for a 2-story office building on the property.
Nlr. Thorpe was present for the meeting.
Chairman Sell reviewed the request and found it in order. Mr. Thorpe explained
the reasons he was requesting a building of two stories and this was discussed
by all Board members. Present also was Mr. Thorpe's architect, Mr. Radloff, and
he explained the landscape and other questions on the building.
Mr. and Mrs. Dale Gustafson, 1030 Wisconsin Avenue, attended the meeting and
expressed their preference far a one story building. They also expressed concern
for the remainder of the adjoining property owners and the manner in which the
area would be developed and the effect on �roperty values.
A letter was received from Mr. Max Winter, owner of the property known as
Lot 1 Block 2 Arcridge Addition. Mr. Winter had originally signed in favor of
the p��ition but reaffirmed a telephone call that his letter requested his name
be removed from the petition and expressed his objection to the proposal .
A letter received fram Mr. Carl Horsager, 7921 Wayzata Boulevard, expressed
his views and reasons for objecting to the proposal .
leRoy Anderson moved to approve the Thorpe petition subject to City Council
approval . The motion was seconded by Mahlon Swedberg. Upon vote, motion carried
unanimously.
(Note: Mr. Glen Christiansen had to leave prior to the vote and was not present
for the motion.)
Lloyd Becker presented a complete City map to the Board of Zoning Appeals which
was color coded for appropriate items of all previous waivers granted by the BZA
since its formation. This map is a permanent record and will be kept current on
all future appeals.
Mr. LeRoy Anderson informed the Board that he will submit his resignation to the
Board at the August 1976 meeting. Mr. Anderson is movin� to Arizona.
