MINUTES OF A REGULAR MEETING OF THE
GOLDEN VALLEY BOARD OF zONING APPEALS
September 14, 1976
The regular meeting of the Golden Valley Board of Zoning Appeals was held
Tuesday, September 14, 1976 at Brookview Recreation Center, 8200 Wayzata Blvd.
Gotden Valley, Minnesota. The following members were present:

Lloyd Becker, staff liaison
Member absent: �len Christiansen
The meeting was called for 7:00 P.M. to allow one—half (1�2) hour for the Director
of Public Safety, J�nes Crawford, and 6eorge Erickson, Fire Department Represent—
ative, to update and familiarize the Board with various aspects of Pubtic Safety
and Fire Protection as they pertain to Zoning when variances are granted.
6eorge Erickson reviewed the garage to house separation, if detached, the re—
quirements for attached garages, and also reviewed cortmercial and industrial
` requirements.
A portion of this meeting was allotted for questions and at tMe end of the meeting
the Board thanked Mr. Crawford and Mr. Erickson and noted that this meeting
was beneficial to the members in their consideration of future petitions for
waivers. This joint meeting ended at 7:45 P.M.
The regular meeting of the Board of Zoning Appeals began at 7:45 P.M.
The first order of business was consideration of the previows minutes of the
Board of Zoning Appeals for August 10, 1976, copies of which had been distributed
to the Board. Chairman Selt reviewed the minutes and the Board noted there
were no ommissions, corrections or errors.
It was rrioved by Mahlon Swedberg, seconded by Watter Kost to approve the minutes
as written and �pon vote being taken the motion carried unanimously.

The petition is for waiver of Section
5.05 for 10' off the required 20' sideyard setback

Mr. Rouzer was present for the hearing. The Board thoroughly reviewed Mr. Rouzer's
request including the use of two driveways, the future parking requirements if
the building was sold, ar�d the green areas as they are to be developed.
Mr. Rouzer explained there are approximately four (4) ernployees at this place
of business and a large area of parking that will not be used will be land—
scaped, equipped with underground watering system, and every effort made to
provide an attractive appearance to the area.
Walter Kost moved that taking into consideration adjacent properties, and
noting the efforts by Mr. Rouzer to make a desireable ir�rovement, ahd subject
to Golden Valley City Council approval at their next meeting, to approve the
waiver as requested. The motion was seconded by Donald Hughes. Upon dis—
cussion, Mahlon Swedberg requested that it be noted that because all major
requirements were to the rear of the building he had no major abjections but
was concerned about the green area on the south property line.
Chairman Sell calted the motion and upon vote, carried unanimously.
76-9-?3 201 Turnpike Road (Map 9) Residential Hugh D. Carpenter
The petition is for waiver of Section
3.07 (3) for 6� off the required 12' sideyard setback on
the south property line to the proposed addition.
Mr. Carpenter was present at the meeting and explained why he wanted the waiver,
noting that the present home has only taro bedrooms and no dining room and that
he desired additional living area as well as garage area. The Board asked
Mr. Carpenter for rr�re detailed plans for clarification of the proposed structure.
It was agreed to allow Mr. Carpente� to return home and at a tater time in the
meeting, present the plans to the Board. This was done and Mr. Carpenter' s
petition was contined after the next petition had been completed. After
reviewing the ptans the Board noted that the request was at a minirrnam for
construction and that it appeared no other feasibte alternates were avaitable.
The Board also noted that if constructed there w�ould still be approximately
22'6�� between adjacent dweiling.
The motion was made by Donald Haghes to grant the petition as presented.
Walter Kost seconded the motion and upon vote being taken, the motion carried
unanimously.

76-9-24 4335 Douglas Ave. S. (Map 10) Residential Melvin P. Bubrick
The petition is for waiver of $ection
3.07 (1 ) for 20' off the required 35` sideyard setback
to a distance of 15' from the east property line
of Lot 5 Block 5 Kennedy South Tyrol Hills
Addition, for construction of a single family
dwelling.
Dr. and Mrs. Bubrick were present for the hearing.
The Board reviewed the plot plan and construction plans as presented. The
terrain of t�e lot, the surrounding properties, and placement of the house
on the lot was thoroughty discussed.
A previoas request for waiver for construction of a house on this lot had been
before the Board several years ago and had been denied.
It was noted that the previous proposal had a much larger home, which was tess
practical for the total lot size.
The Board felt that the present waiver request should not be less stringent aad
that it would be rr�re desireable to move the proposed dwelling closer to the
west property line.
During discussion the Bubricks presented an alternate plat proposal which their
architect felt was less desireabte for construction but woutd provide m�re
setback on June Avenue.
At this time Mahlon Swedberg made a motion to defer the proposal to a later date
to allow examination of records of a previous waiver request on this property.
The motion faited for tack of a second.
Walter Kost moved to accept the alternate proposal and to allow 14.5� off the
required 35' setback to a distance of 20.5' from the property line at the
northeast corner of the garage, and 10.33� off the required 35' requirement
to a distance of 24.67' at the southeast corner of the house, and in accordance
with the plan and alternate survey plat as signed and dated September 14, 1976.
The rrbtion was seconded by Oonald Hughes and upon vote being taken the motion
carried unanimously.

The petition is for waiver of Section
3•�7 (1) for 20' off the required 35' setback at the
southeast corner of the proposed addition,

Mr. and Mrs. Fortman were present for the hearing.
This lot is unusual as three sides of the structure are prominent and visible
because of the location and the lot has unusual topographical characteristics.
Mahlon Swedberg was concerned with the bulk of the proposed addition.
Donald Hughes suggested planting be installed to enhance the appearance of
the stracture.
Mr. Fortman Mad complete plans with att elevations and sides shown. The
existing driveway is qaite steep and by allowing the floor to be lowered and
adding one course of concrete block to maintain house to garage elevation the
angle of tMe driveway coutd be reduced also.
Donald Heaghes moved to grant the waiver for a garage addition 22' wide and
25' deep with a waiver of 17.5' off the required 35' setback to a distance of
17.5' to the southeast corner of the proposed addition and to grant the
remaining waivers as requested and showr� by the survey.
Walter Kost seconded this rrbtion.
Ouring discussion of the motion Mahlon Swedberg proposed two (2) amendments:
1 . Retain the existing basement floor level in the new garage addition.
2. Suitable landscape be designed and installed around the addition.
The amenc�nents, as proposed, failed for lack of a second.
Mahlon Swedberg proposed one amendment to require the landscape only, this
was seconded by Walter Kost.
The Chairman catled the motion and upon vote being taken carried unanimously.
The Board directed Mr. Fortman to have his registered surveyor set the 17.5'
distance from the lot line for construction.

The petition is for waiver of Section
13.02 for 25' off the required 35' of green area
for a distance of 217' as measured along the
south property line. The 217' is measured
east from the east right of way of
Florida Ave. S.
At the request by letter from the proponent, this itexn was remc�ved by staff
from the agenda.

The petition is for waiver of Section
3•02 (1 ) to allow a double hoWSe to be constructed on lots

Lot 1 Block 2 — to allow a two—family dwelling
in a residential area,
lot 5 Block 1 (existing barn) — to allow an
existing two—family dwelling in a residential area.
Mr. Jopp was present for the hearing.
The Board discussed the approved plat and reviewed the requirements needed
for the proposed waivers.
It was the Board's opinion no waiver was necessary for Lot 1 Btock 2 for a
double house, as it was across the street from a heavier use and in compliance.
The existing barn structure was discussed and its location reaffirmed on the plot.
Mr. Jopp provided further background information and Oonald Hughes clarified
previous Planning Commission actions.
Walter Kost moved to approve the requested waivers as stated on the petition
(which is Lot 5 Block 1 ) that pertain to the existing barn structure.
The motion was seconded by Mahlon Swedberg and upon vote being taken the motion
passed unanimously.
R. C. Ernst Review of waiver qranted Jane 8, 197b (Basement Storage Area)
Mr. Ernst was not present at the meeting.
1'he Board had the opportunity to review all previous minutes concerning the
building affected at the waiver granted June 8, 1976.
The Board reiterated their action taken June 8, 1976. The City Attorney
confirmed their actions as correet.
Chairman Mike Sell diseussed several administrative items with the Board mernbers.
Following this discussion and with no further business to come before the Board,
it was on motion, duly seconded and upon vote being taken the meeting was
adjourned at 11 :30 P.M.
