MINUTES OF A itEGULAR MEETING OF THE
GOLDEN VALLEY BOARD OF ZONING APPEALS
October 12, 1976
The reguiar meeting of the Golden Valley Board of Zoning Appeals was held
Tuesday, October 12, 1976 at the Civic Center, 7800 Golden Valley Road,
Golden Vatley, Minnesota. The following members were present:
Mahlon Swedberg
Glen Christiansen
Donald Hughes
Lloyd Becker, staff liaison
Members absent: Walter Kost and Mike Sell
Mahlon Swedberg assumed the chair as Acting Chairman.
The first order of business was the consideration of the minutes of the previous
meeting af the Board of Zoning Appeals held September 14, 197b, copies of which
had been distributed to the Board.
Acting Chairman Mahlon Swedberg reviewed the minutes with the Board.
Donald Hughes noted that the minutes should be corrected by removing the
quotation marks from paragraph 3, page 2, in the matter of the Rouzer sales
petition. Remove the quotation marks on the last paragraph at the bottom of
page 4 in the matter of the Wayne Jopp petition.
Mahlon Swedberg noted that in the matter of the petition for Melvin P. Bubrick
(76-9-24) Page 3 paragraph 6 should be corrected to read as fottows: At this
time Mahlon Swedberg made a motion to defer the proposal to a later date to
allow ex�nination of records of a previous waiver request on this property.
MaMlon Swedberg expressed his views on the September meeting and discussed a
variance that was granted in comparison to previous petitic�ns and those that
may be considered in the future. Noting that all matters being considered, he
regretted his vote in favor of Petition 7b-9-23. In conclusion, he stated that
the only way the Board can be fair to all those in the past and those in the
future would be by an Ordinance change.
Glen Christiansen moved to accept Mahlon S►aedberg' s e�cpressions on Item 76-9-23
�nd so record them in the minutes of the meeting. Donald Hughes seconded the
motion. Upon vote, motion carried ur�animously.
Donald Hughes moved to accept the minutes of the meeting of September 14, 1976 as
corrected. The motion was seconded by Glen Christia�sen. Upon vote, the motion
carri ed unanirnc�usl y.
76-10-28 3425 Terrace Lane (Map 1 ) Residential Carolyn S. Bakken
The petition is for the waiver of Section
3.12 (1 ) for 16' off the required 20' separation from
Eaouse to detached garage to a distance of 4'
between the existing house and the proposed
garage.

Carolyn S. Bakken was present for the hearing.
The Board thoroughly discussed the request. The lot slopes toward the rear,
and moving the garage' further back would require additional foundation and fill .
Mrs. Bakken was asked to review her plans with the builder to determine whether
the garage coutd be placed more distant from the house.
Glen Christiansen moved to defer action on this proposal for the benefit of the
proponent to allow her to consult further with the contractor. The motion
was seconded by Donald Hughes. Upon vote, motion carried unanimously.
76-10-29 6925 Olyrr�ia Street (Map 15) Residential Dr. John M. Taborn
The petition is for the waiver of Section
3.07� (B) �fQ�r 6.25' off the required 11 .25' sideyard
setback to a distance of 5' frcxn the East
property line to the proposed addition.
Mr. John Taborn was present at the meeting and reviewed the reasons for
construction to their home.
The Board discussed and corr�ared adjacent properties, the dwelling locations
and lot sizes as they relate to the Taborn request.
Donald Hughes rnc�ved to approve the petition as requested, noting that economics
was a factor and secondl�+ that the lot on the East is unbuilt. Glen Christiansen
seconded the mc�tion only because there is no present structure on the lot to the
East, and while there is no definite hardship shown by the proponent, this open
lot was a consideration in his second of the motion. fliscussion was called, and
upon vote, the motion carried unanimously to approve.
76--10-30 845 France Avenue North (Map 7) Industrial Animal Humane Society
of Hennepin County
The p�tition is for the waiver of Section
13.02 (D) for 35' off the required 35' green area
at the existing parking lot to allow b�ac�top
as shown.
Alan T. Stensrud was present for the hearing representing the Animal Humane
Society of Hennepin County. Mr. Stensrud reviewed the reasons for the waiver
request.
The Board questioned Mr. Stensrud about other areas available for adr�itionat
parking and further development of the area.
At the close of the discussion it was moved by Glen Christiansen to deny the
petition in view of the fact that sufficient property for parking is available
if developed and the 35' green area could be established as required; therefore,
no justification for the waiver is apparent. The motion was seconded by
Oonald Hughes. Upon vote, the motion to deny the petition as requested was
unanimous.

There being no further business to come before the Board, it was on motion,
duly seconded, and upon vote being taken, the meeting was adjourned at 9:3� P.M.
