MINUTES OF A REGULAR MEETING OF THE GOLDEN VALLEY BOARO OF ZONING APPEALS December 14, 1976 The regutar meeting of the Gotden Valiey Board of Zoning Appeals was held Tuesday, December 14, 1976 at the Civic Center, 78Q0 Golden Valley Road, Golden Valley, Minnesota. The fotlowing members were present: Chairman Mike Sell Donald Hughes Glen Christiansen Walter Kost Mahlon Swedberg Lloyd Becker, staff liaison Members absent: None The Board met prorr�tly at 7:30 P.M. Chairman Sell reviewed the minutes of the meeting of November 9, 1976 as amended. There being no omissions, errors or corrections, it was moved by Swedberg to approve the minutes as presented. Glen Christiansen seconded the motion, upon vote the motion carried with 4 ayes and Donald �ughes abstaining. 76-12-38 Lot 11 Btock 11 Lakeview Heiqhts (Map 20) Residential-Ori inal Homes, Inc. The petition is for waiver of Section 3.07 for 11 feet off the required 35 foot setback to a distance of 24 feet from the front property line on Oly�ia Street. Mr. John M. Lithgow of Original Homes, Inc. was present for the hearing. Chairman Sell reviewed the petition and found it to be in order. The Board reviewed the surrounding lots and discussed and revi_ewed simitar waivers in the Lakeview Heights Addition. Chairman Sell noted that in reviewing the registered survey and the location of the proposed building that was slightly short of the 20q rear yard require- ment. It was determined that to be absolutely correct a waiver of 0.2 feet woutd be required for the rear of the building. Upon discussion with Mr. Lithgow, Watter Kost moved to grant the waiver as requested for 11 feet off the required 35 foot setback on plyrr�ia Street to a distance of 24 feet from the front property line to the proposed home and to also grant a waiver of 0.2 feet off the required 12.2 feet from the north lot line to a distance of 12 feet to the proposed house from the lot line. The motion was seconded by Donald Hughes. Upon vote, the motion carried unanimously. ��� Board of Zoning Appeals December 14, 197b page 2 76-12-39 5738 Olson Memorial Highway (Map 12) Business � Professional Weinstein International Inc. � This petition had been filed with the Secretary after the agenda had been published and shortly after the required date for submittal of petitions as defined by ordinance. Lloyd Becker, Secretary, presented this petition to Chairman Sell and the Board explaining its background and the proponents desire to be heard this month due to the hardship of winter construction and further frost problems if delayed. Mr. Earl Weikle of Weikle and Sons, Inc. was present for the proponent and further detailed the proposal . Mahton Swedberg moved to accept the petition and allow it to be heard. Glen Christiansen seconded the motion. Upon vote, it was unanimous to hear the petition. The petition was for a waiver of the side lot setback, Section 10.06 for 3.86 feet off the required 20 feet to a distance of 16.14 feet from the west property line to the proposed addition. Chairman Sell reviewed the petition and found it in order. It was noted that the existing building when built was in conformance with zoning require— ments at that time. The plan is for an addition — 20 feet deep and 75 feet wide to the rear of the existing building with the west wall being in line with the west watl of the existing building. Mahlon Swedberg moved to approve a waiver of 3.86 feet off the required 20 foot setback to a distance of 16.14 feet from the west property line to the proposed addition. Whe motion was seconded by Walter Kost. The Chairman called for discussion. Glen Christiansen noted that when he visited the site the parking lot was full and questioned whether it was ade�uate, was more parking planned and did the building and lot have the ability to conform to current requirements. Mr. Weilke noted that in his contract he is required to add an additional parking area of blacktop construction of a size, 35' x 100' , if the addition is approved. Lloyd Becker noted that the site does have adequate land to meet the parking requirements and proposed that a plan showing the required number of parking spaces be filed with the buitding department as a condition of the waiver Mike Sell re—stated the motion to inctude the requirement that a plan be submitted to the building department showing adequa�e parking to comply with all current ordinance requirements. Upon vote, motion carried unanimously. Chairman Sell reviewed with the Board two appeals which were brought to the City Councit from the November meeting. � _�� � ��� Board of Zoning Appeals December 14, 1976 page 3 Ltoyd Becker brought to the Board' s a�tention two other appeals that wilt be brought to the Council in December and in January, 1977. Mike Sell read the letter from Mayor Hoover regarding disposition of the appeal from the Humane Society of Hennepin County to the City Council . The Board reviewed several administrative items.
