06-14-77 BZA Minutes � �`'� �._ �. _� MINUTES OF A REGULAR tMEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS June 14, 1977 The regular meeting of the Go]den Valley Board of Zoning Appeals was held Tuesday, June 14, 1977 at 7:30 P.M. at the Golden Uailey Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota. The following Board members were present: Walter Kost, Chairman PAahlon Swedberg Robert I�agman Mike Sell Lloyd Becker, Secretary and Staff Liaison Member absent: Glen Christiansen (by prior notice) The first item was consideration of the minutes of the previous meeting held May 10, 1977, copies of which had been distributed to the Board. Chairman Kost reviewed the minutes, questioned the board members for orrmissions, errors or corrections. Upon review Mike Sell moved to approve the minutes as written and presented. Robert Wagman seconded the motion, upon vote it was unanimous to approve. 77-6-21 (Map 14) Residential—Southwest Corner of Medicine Lake Road and Douglas Drive (Parcels 1 ,2, �- 3 as Platted) Charles P. Thompson, President New Hope Nursinq Home, Inc. The petition is for the waiver of Sections 3.p2 � 3•a41 to allow 2 two—family dwellings in a Residential area, and for the waiver of 30' off the required 150' of frontage on the westerly Parcel II along Medicine Lake Road. Mr. Lyn Caswell was present for the meeting representing Charles P. Thompson of New Hope Nursing Home, Inc. Also present was Mr. William Thomas, 2511 Doublas Drive adjacent property owner to this proposal . Chairman 1�alter Kost reviewed the petition carefully, referring to previous Planning Comnission actions on this proposal and also reviewing with the Board the plot plan presented showing locations of the buildings, garages, and proposed driveways and parking area. The Board asked Mr. Thomas if he desired to be heard on this proposal . Mr. 7homas reviewed past neighborhood efforts toward development of other lots in the area and noted that total agreement among all property owners had not been accomplished. Mr. Caswell had previously contacted Earl Wilson of I�est Suburban Builders, who has a permit to construct a single family dwelling at 250$ Florida Ave. North and who was attempting to coordinate the development of the area adjacent to Mr. Caswell ' s proposal . It is Mr. Wilson' s intent at this time to construct only the dwelling at 2508 Florida Ave. �`'^-r�� Board of Zoning Appeals June 14, 1977 page 2 Mike Sell called attention to the adjacent property, the multiple dwellings across the street, and the traffic flow on both Medicine Lake Road and Douglas Drive and said he feels the proposed 2 two—family dwellings were a good use in this area and provided a good transition of zoning. Lloyd Becker reviewed the driveway requirements, explaining both Medicine Lake Road and Douglas Drive required County approval for the driveways to the property and also reviewed the possibility of right hand turn lanes or right hand acceleration lanes being considered by the County some time in the future. The 50 foat setback for both buildings recorrmended by the Planning CorrrYnnission appears to remove any future problems, should the County consider any lane adjustments. Mahlon Swedberg noted that while the westerly lot was short some of the required lot width, the lot square footages were more than ample. Mike Sell moved to approve the waivers as requested subject to a 50 foot front setback on Douglas Drive and on Medicine Lake Road and subject to suitable drive— way design to eliminate any necessity for backing out onto either street and to provide suitable turnaround area on the property if necessary to accomplish this. Robert Wagman seconded the motion, upon vote it was unanimous to approve. 77-6-22 (Map 18) Industrial 750 Florida Ave. South Product Design Jerry Porter, ' President The petition is for the waiver of Sections 7.055 Loading Dock facing a Street 5.05 Sideyard setbacks — for 19.6' off the required 20' setback at the closest point off the westerly lot line to the proposed addition, and for 10' off the required 10' landscape along the west property line, and for 20' off the required 20' setback for each building on the east—west line, and 10' off the required 10' green area along this line for each building. Mr. Jerry Porter was present for the hearing. Chairman Kost reviewed the petition and found it in order. The Board reviewed the total background for both structures and the additions as they were constructed. t9r. Porter gave his reasons for desiring to expand his business and the necessity to provide the square footage as requested so the production area can be developed. The Board questioned the necessity for the loading dock as located and atso the truck traffic and parking on the site. Mr. Porter agreed to locate the loading dock in conformance with the ordinance so no waiver for this would be required. ,_ ��- ,. �_ . _- Board of Zoning Appeals June 14, 1977 page 3 Mike Sell said that along the west property line the proposed construction was an extension of an existing building line and in all other resnects the building would confarm. Mr. Porter explained to the Board that if approved his future plans included a complete new facade on the existing buildings to provide a continuity of appearance. Mike Sell moved to grant the waiver request to extend the existing building on the west property line as requested and to deny the waiver as requested for the loading dock on Florida Avenue and as a condition of approvat the proponent merge the property to the extent of the proposed construction on the east—west property line between the two buildings. Robert �lagman seconded the motion, upon vote the motion carried with 3 ayes and 1 nay (Kost opposed). 77-6-23 (Map 7) Industrial 845 France Avenue North, Animal Humane Society of �_ Hennepin Countx . ` The petition is for the waiver of Section 13.02 (D) for 35' off the required 35' green area at the existing parking lot to allow blacktop as shown. Mr. Alan Stensrud of the Humane Society was present for the meeting. The Chairman reviewed the petition as previausly presented at the Board of Zoning Appeals meeting of November 12, 1976. This request had been denied at that time, was appealed and heard by the City Council December 6, 1976, at which time it was referred back to the Board of Zoning Appeals because the Council felt the proponent had not negotiated any alternatives. A lengthy discussion was held with Mr. Stensrud who reviewed the operations of the Society, its parking requirernents, funding, expenses and responsibilities. The Board considered the effects of any variance if granted on adjacent properties in the area. ti�Jhile Mr. Stensrud desired the entire 35' waiver of the green area as shown on the plot plan, he agreed some adjustment in his plans could be made. Mahlon Swedberg moved that in light of other alternatives the proposal as pre— sented be denied. The motion was seconded by Mike Seil , upon vote the mation to deny carried unanimausly. Discussion on this item continued with Mr. Stensrud requesting the Eoard to consider a variance of 15' off the required 35' green area to a distance of 20' . After further discussion Mike Sell moved to grant a variance of 15' off the required 35' area to a green area of 20' from the front lot line subject to proper landscaping of the surrounding area. Robert 1�agman seconded the motion, upon vote the +notion carried with 3 ayes and 1 nay (Mahlon Swedberg opposed). , � /� � �. Sorensen The petition is for the waiver of Section 3.07 for 8.7� off the required 35' setback along the front lot line to 26.3' at the closest point of the existing house. Mr. Sorensen was present for the meeting. Chairman Kost reviewed the petition noting it was in order, atl signatures indicated approval and that it was for an existing house which had been con— structed in 1947 and had been located too close to the lot iine aiong Bassett Drive. Bassett Drive is a platted but undeveloped street at this point along the creek. Mr. Sorensen explained when he presented his plans and survey for construction of an addition to his home the Building Inspector noticed the error and required this to be corrected before any permit could be issued. Mike Sell rr�ved to grant the request as presented noting that in his opinion if it were not for the utilities in the street the unused road should be vacated. Mahlon Swedberg seconded the motion, upon discussion the Board concurred with Mike Sell ' s opinion on the street vacation. Upon vote it was unanimous to approve the request. Walter Kost reviewed several items with the Board, discussed the work plan �s requested by the City Council , and indicated a meeting sometime this fall would be desirable between the Board of Zoning Appeals and the Council .
