MINUTES OF A REGULAR MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS August 8, 1978 The regular meeting of the Goiden Valley Board of Zaning AppBals was held Tuesday, August 8, 1978 at 7:3� P.M. at the Golden Valley Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota. The following Board members were present: Glen Christiansen Mike Sell Larry Smith Donald Hughes (Alternate from Planning Cor�mission) Mervyn Mindess (Alternate from Ptanning Commission) Members absent: (by prior arrangement) Mahlon Swedberg and Wiltiam Forster. In the absence of the Chairman and in accordance with the by laws, the Secretary called the meeting to order at 7:30 P.M. and called for nominations for Chairman pro tem. Larry Smith mo�ed and Mike Sell seconded a motion to nominate Glen Christiansen as Chairman pro tem. Glen Christiansen moved to nominate M'rke Se11 as Chairman pro tem. There was no second to the motion. The vote was called on the motion made by Larry Smith and the motion carried to nominate Glen Christiansen as Chairman pro tem for this meeting. The first order of business was the consideration of the minutes of the regular meeting of the Board held on July 11 , 1978, copies af which had been distributed to the Board. It was moved by Mike Sell , seconded by Larry Smith, and upon vote carried unanimously to approve the minutes of July ll , 1g78 as written and presented. 78-7-24 (Map 19) Commercial 9405 Medicine Lake Raad Mobil Oil Gorporation (Deferred from July 1978) The petition is for waiver of Section 1 .03 of the Zoning Gode for more than l principal building on one parcel of land (both structures existing) . The Chairman reviewed the petition and it was in order. Present for the request were Messrs. Milton Fry and Dick Anderson of Mobil Oil Corporation. No abutting property owners were present. The Board reviewed the proposed construction plans for the car wash bay. The Secretary noted that presently this service station is connected to New Hope for water across Medicine Lake Road and there is a septic tank and drainfield for sewer. Golden Va11ey Engineering Department has coordinated arrangements to connect this service station into the New Hope sewer system also as service is availa6le on Medicine Lake Road. The staff has advised that connection to municipal sewer is the only feasible manner to consider the car wash bay. Mobil Oil Corporation has agreed to this condition and to rearrange the parking around the station to conform to the Zoning Code. �- � `__ . Board of Zoning Appeals August 8, 1978 page 2 Mr. Fry noted that consideration is being given to dividing the property but at this time it would delay construction into the winter. Mr. Fry confirmed that the structure is similar to the car wash bay recently granted at Douglas Drive and Duluth Street and that its operation is similar in character. Mike 5e11 moved to grant the waiver as requested, and the motion was seconded by Gten Christiansen. Mervyn Mindess asked to have the following conditions attached to the motion: 1) the building permit to be issued subject to Mobil Oil Corporation connecting the service station to sanitary sewer, and 2) the property to be subdivided in accordance with the Zoning Code by March l , 1g79. Sell and Christiansen agreed to the amendment and the conditions are a part of the motion to approve. Upon vote, motion carried. 78-8-26 (Map l) Residential 2525 Meridian Drive Glen E. & Karoline M. Seibold The petition is for waiver of Section 3. 12 for 10' off the required 20-foot house to garage separation to allow construction of a kitchen addition 10' from the garage. The petition was in order. Mrs. Seibold was present to explain the request. Approvat had been obtained from all adjacent property owners. It was noted this is a narrow lot (60 ') and there is no other practical altern- ative but to construct to the rear. Mrs. 5eibold said they like the house, would like to stay in Golden Valley, and in addition to providing additional and more convenient room it would also upgrade the property. The Board noted that in the future, should any major structural changes be considered on the existing garage, it would be desirable to move it further back. Larry Smith moved to approve the request as proposed, subject to the required fireproof sheefirock being installed on the garage walls per Code, and also to approve a waiver of .3' off the required 6' setback along the North property tine because the registered survey shows the existing house to be 5.7' from this lot line. Mervyn Mindess seconded the motion and upon vote, motion carried. 78-8-27 (Map 17) Residential 6610 Glenwood Avenue Daniel K. & Elizabeth 0'Brien The petition is for waiver of Section 3.07 (3)A of the Zoning Code for 3.4' off the required 15' setback on the East lot line to allow construction of a garage addition. The petition was in order. A1so present was Mr. L. E. Shaffer, 6620 Glenwood Avenue, adjacent property owner who spoke in approval of the construction. Mike Sell asked Mr. 0'Brien to explain how the existing garage was attached to the house as it appeared there could be some adjustments made. Mr. 0'Brien explained there are window wells and a step on the driveway side and the garage is actually only 11 'wide now. Mike Se}l moved to approve the waiver as requested, noting the window wells and the steps on the driveway side and the garage being only 11 ' wide now that the proposal as presented was reasonable. Donald Hughes seconded the motion and upon vote, motion carried. 78-8-28 (Map 20) Residential 1909 Gettysburg Avenue North Richard Huston The petition is for waiver of Section 3• 12 for 12' off the required 20-foot house to garage separation to a distance of 8' between the garage and the proposed addition. Mr. Richard Huston was present for the meeting. Atso present was Mr. Donald Herstein, representing Sussel Company, the eontractor for the addition. The petition was in order. No adjacent property owners were present. This lot is 60' wide, and observing front and side yard setbacks, there is no other alternative to providing addition living area, except to the rear. Mike Sell noted that the fireplace projected beyond the proposed waiver request and further reduced house to garage separation. During further discussion the owner and contractor agreed to move the fireplace to the South, driveway side of the addition thereby giving additional room. The Secretary noted fihat the Bui �ding lnspector and City staff had discussed the problems for any construction on narrow lots, and as an example, this construction can be done observing all other setbacks except the house fio garage separation and that a reasonable solution for the future on these sites may be that if a waiver is granted to allow additions reducing house to existing garage distances, a condition be attached that no additions or alterations to that existing garage may be made in the future other than routing maintenance, and that if any future construction be proposed, the garage be moved further to the rear and/or side to provide for the required separation. Mervyn Mindess noted that the entire addition was to be built in the rear of the house and that if the fireplace was moved and appropriate conditions attached to the existing garage, it may be a workable solution to providing additional living area. Mike Sell noted he could see that additional living area would be more of a priority than if it were a garage being proposed to be built closer to the house, and if reasonable conditions can be met, he could look favorable at the request. -. ���� --� � � , � Board of Zoning Appeals August 8, 1978 page 4 Donald Hughes moved to grant 12' off the required 20-foot house to garage separa- tion, subject to the following conditions: l) the fireplace to be moved as noted, 2) appropriate fireproof on walls as required to be installed on garage, and 3) if any other alterations or additions are considered for the existing garage, that the garage be required to be moved to the proper separation distance. Larry Smith seconded the motion and upon vote, motion carried. 78-8-29 (Map $) Residential 4025 Roanoke Circle Oscar B. Charlson The petition is for waiver of Section 3.07 (2) for waiver of the required rear setback to allow construction of a deck within 2 feet of the rear lot line. Mr. and Mrs. Charlson were present for the request. Also present was the contractor for the wood deck and shade structure. The petition was in order and signatures of approval from all abutting property owners had been obtained. Larry Smith noted that on the petition for waiver the deck was described �s detached from the house; however, Mr. Charlson explained that it was attached and he presented to the Board pictures from a design brochure on how it woiald look and also details showing the perimeter of the deck and its supports. Mr. Charlson noted he had obtained approval from the abutting neighbor and noted the large distanee from his rear lot line to the neighbor's home. The area is heavily wooded and a v�ritable bird sanctuary. The deck and enclosure is designed in keeping with that environment. Noting the substantial distance to the adj,acent prpperty and the characteristics of the area, Donald Hughes moved to grant the waiver as requested, subject ta the condition that no permanent roof be attached to the deck. Mike Sell seconded the motion and upon vote, motion carried.
