11-13-79 BZA Minutes �-Y�, �, � .�a�_� MINUTES OF A REGULAR MEETING OF THE GOLDEN VALLEY BOARD OF ZONIN6 APPEALS November 1�, 1979 The regular meeting of the Golden Valley Board of Zoning Appeals was held Tuesday, November 13, 1979 at 7:30 P.M. at the Golden Valley Civic Center, 7800 Golden Va11ey Road, Golden Valley, Minnesota. The following Board members were present: Mahlon Swedberg, Chairman Pro Tem Art Flanagan A1 DeSautels (Alternate) Board members absent by prior arrangement: Forster, Christiansen, and Sell . The first order of business was consideration of the minutes of the regular meeting of the Board of Zoning Appeals held October 9, 1979, copies of which had previously been distribu�:ed to the Board. Art Flanagan moved, and A1 DeSautels seconded a motion to approve the minutes as written and presented. Upon vote, motion carried. 79-11-40 (Map 8) Residential Lot ? Block 2 Glendale Addition (Lot ]ocated SW Corner Burntside Drive �nd Hwy. 55) By: Frederick J. Sicora The petition is for wai��er of Section 3.07 (1 ) front setback for 10' off the required 35' setback to a distance of 25' from the north lot line along Highway #55. The petition was in order. Present for the meeting was Mr. Frederick J. Sicora, proponent and architect for the proposal . Mr. Sicora explained that this lot is bound by streets on two sides and has a soil problem. It is his desire to build 10' closer to the Hwy. #55 service ' road to allow better utilization of the sun on the south side of the structure. Mr. Sicora has designed this heme to utilize a unique so�ar heating system while having all the appearance of a contemporary home. This was discussed with the Board in detail . The principle of this solar design is a passive air flow and is in effect a double watled home. Mr. Flanagan noted his discussion with adjacent neighbors, none of whom object to the proposal . Mr. Sicora noted he is directly across from a heavier use (paper company) on Hwy. #55 4nd in his �pinion the waiver request presents no problem to anyone. He also explained that if the solar designed home with its requirements for maximum sun utilization is not built, the waiver would not apply to any other home subsequently constructed or proposed on this site. � � -� �.�'.� �_ Board of Zoning Appeals November 13, 1979 Page 2 The Board ackno�al�dged and noted this to be a condition if any waiver is granted. Art Flanagan moved, seconded by A1 DeSaute]s, and upon vote, motion carried to approve the waiver as requested subject to the condition that if no solar designed home is proposed or constructed, the waiver would not apply, and subject to Mr. Sicora obtaining a release of the highway easement as noted on the property survey dated October 29, 1979, Egan, Field and Nowak, Inc. Mahlon Swedberg noted the review of the by—laws should be done as soon as possible.
