MINUTES OF A REGULAR MEETING OF THE
GOLDEN VALLEY BOARD OF ZONING APPEALS
FEBRUARY 8, 1983
The regular meeting of the Golden Valley Board of Zoning Appeals was held
Tuesday, February 8, at 7:30 P.M. in the Council Chambers of the Civic
Center, 7800 Golden Valley Road, Golden Valley, Minnesota
The following Board members were present:
Chairman, Mike Sell
Art F1 annagan
M ahl on Swedberg
Absent by prior arrangement, Glen Christiansen and Herb Polacheck.
The first order of busi ness was approval of the mi nutes of a regular
meeti ng hel d January 11, 1983, copies of which had previ ously been di s-
tri buted to the Board.
Mahl on Swedberg moved to approve the mi nutes as written and presented.
Second by Art F1 annagan and upon vote carried.
83-2-4 (Map 8) Residential
Lot Southeast corner of Hi ghway 55 & Indiana Avenue.
Lot 135, except the South 15.0 feet and all of Lot 136
together with the West 1/2 of the adjacent alley thereof.
Subject to an easement over the East 15.0 feet, all in
Glenwood Addition, Hennepin County, Minnesota.

The Petition is for waiver of Section
3A.06(1 ) front setback for 10 feet off the required
35 feet front setback to a distance of 25
feet from the lot line on Indiana and also
f rom the lot li ne on the servi ce road at
Highway 55 to the proposed new single
f ami ly hou se.
The Petition was in order. Consent had been obtained from adjacent properties,
n one were present at the meeti ng.
Mr. Bradley Jones was present and explained his proposed single-family dwelling.
The secretary noted that the adjacent properties were at 25 feet from the
service road at Highway 55 and that in similar instances the Board had granted
w ai vers of front setback al ong Ol son Hi ghway (55) .

Mr. Jones said that originally he had proposed a six-unit townhouse P.U.D. on
the site which included the entire Wirth Baptist Church land; however, he had
n ot recei ved a favorable recomrnendati on from the P1 anni ng Comni ssi on and di d
n ot pursue it further. Hi s purpose i n requesti ng a wai ver along Indi ana is
that adjacent houses in the rest of the block are set at 22 feet to 24 feet
f rom the lot 1 i ne and he thought i t woul d di srupt the establ i shed setback li ne
if he constructed at 35 feet setback.
Following further discussion of the entire site which includes a proposal by
Mr. Jones to "remove the old church structure and build a new home on the lot",
M ahl on Swedberg i ntroduced and read the fol l owi ng wri tten resol uti on and
moved its adoption:
RESOLUTION 83-2-4
(Waiver of Section 3A.06( 1 ) - Front Setback)
WHEREAS, the Board of Zoning Appeals for the
City of Golden Valley has the power and authority
p ursuant to Appendix I, Section 14.08, Subd. (b)
of the City Code, to grant a waiver of zoning
o rdinances where it appears that good cause is
s hown to grant said waiver; and whereas good cause
h as been shown by Bradley Jones the petioner herein
t o grant a side setback on the premises legally
d escribed as:
Lot 135, except the South 15.0 feet and all of Lot 136
together with the West 1/2 of the adjacent alley thereof.
S ubject to an easement over the East 15.0 feet, all in
Glenwood Addition, Hennepin County, Minnesota.
W HEREAS, all persons present were given the opportunity
to be heard, NOW THEREFORE
BE IT RESOLVED, by the Board of Zoning Appeals for the
City of Golden Valley that the following waiver of Section
3A.06(1 ) is hereby granted, to-wi t:
f ront setback for 10 feet off the required
35 feet front setback to a distance of 25
f eet from the lot li ne on Indi ana and also
f rom the lot line on the service road at
Highway 55 to the proposed new single
f ami ly house.
T he motion for the adoption of the foregoing resolu tion was seconded
by Art Flannagan and upon vote being taken thereon the following voted in
f avor thereof: carried unanimously and the following voted against the
s ame: none. Whereupon said resolu tion was declared duly passed and adopted,
signed by the Chairman and his signature attested by the Secretary.

The board discussed several administrative items which included legal costs
involved to now record the variances when granted and also the secretary
u pdated the Board on cu rrent zoning and construction activities in the City.
There being no further business to come before the Board, it was on motion,
second and vote to adjourn at 8:45 P.M.
