MINUTES OF A REGULAR MEETING OF THE
GOLDEN VALLEY BOARD OF ZONING APPEALS
December 13, 1983
The regular meeting of the Golden Valley Board of Zoning Appeals was held
Tuesday, December 13, 1983, at 7:30 P.M. in the Council Chambers of the
Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota.
The following Board members were present:
Chairman, Mahlon Swedberg
Art Flannagan
Glen Christiansen
Absent by prior arrangement, Mike Sell and Herb Polachek.
The first order of business was approval of the minutes of a regular meeting
held November 10, 1983, copies of which had previously been distributed to the
Board.
Art Flannagan moved to approve the minutes as written and presented. Second
by Glen Christiansen and upon vote carried.
Following approval of the minutes, the chair noted that the only petitioners
present were Bruce and Karen Johnsen, 4420 Adell Avenue. The Chairman proposed
adjusting the order of the agenda and proceeding with the petition by the
Johnsen's. The Board concurred.

The Petition is for waiver of Section
3A.06(2) rear setback for 8.1 feet off the required
33.5 feet to a distance of 25.5 feet from the
west lot line to the house as it now exists.
Purpose is to allow a lot division to an
adjacent neighbor to adjust present lot
lines between existing houses.
The petition was in order. Consent had been obtained from all adjacent pro-
perties. The secretary reviewed with the Board the background for this request.
The proponents have been before the Planning Commission requesting a minor lot
division to adjust property lines between the two properties. If approved by
the City Council , the rear setback would be non-conforming at 4420 Adell Avenue.
However, both 4420 Adell and 3300 Lee Avenue, the abutting property, are corner
lots and as reviewed by the Planning Department, the adjustment in property
lines would be of overall benefit and has recommended approval of the division.

Following addition clarification by the Johnsen's, Glen Christiansen moved to
approve the waiver as requested. Second by Art Flannagan and upon vote carried
unanimously.
The other petitioner arrived for the meeting.
83-12-33 (Map 4) Residential
2640 Perry Avenue North

The Petition is for waiver of Section
3A.06(3) side setback for 1.6 feet off the required
15 feet sideyard setback from the north lot
line to the existing house to a distance of
13.4 feet. Purpose of the request is to allow
a fully conforming addition to be added to the
rear of the house which is now non-conforming
for side setback from the north lot line.
The Petition was in order, consent had been obtained from all adjacent
properties.
This is an existing home which when constructed some 20 years ago was placed
inadvertently 1 .6 feet closer to the north lot line than provided for in the
Zoning Code.
An addition that fully conforms is proposed for the rear of the house. A non-
conforming structure requires appropriate and applicable waivers from the
Zoning Code to be expanded.
Mr. Glass was present to explain the addition.
Following a review and discussion of the proposed addition, Art Flannagan moved
to approve the waiver as requested noting this is for the existing house and
the extreme hardship structurally and financially it would be to move the house
to a conforming condition. Second by Glen Christiansen and upon vote carried
unanimously.

83-12-34 (Map 9) Residential
4115 Glencrest Road

The Petition is for waiver of Section
3A.06(1) front setback for 1.0 feet off the required
35 feet front setback to a distance of 34
feet from the front lot line to the house as
it now exists. Purpose of the waiver is to
allow a fully conforming addition to be
added to the rear of the house which is
non-conforming for front setback.
The petition was in order. Mr. Rosholt was present. Consent had been obtained
from all adjacent properties. The Board reviewed the proposed addition to the
rear which fully conforms.
The secretary said that at Mr. Rosholt's request he had reviewed the background
of Glencrest Road with engineering. No records show that when the road was
installed that additional property was acquired. The error appears to be when
the home was constructed.
Art Flannagan noted that the proposed addition to the rear was fully conforming
and moved to approve the waiver of the existing house as requested. Second by
Glen Christiansen and upon vote carried unanimously.
The Board discussed several administrative items with the Secretary, Lloyd
Becker.
There beiny no further business to come before the Board, it was upon motion,
second, and vote to adjourn at 8:00 P.M.
