09-12-84 BZA Minutes ����-� MINUTES OF A REGULAR MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS September 12, 1984 The regular meeting of the Golden Valley Board of Zoning Appeals was held Wednesday, September 12, 1984, at 7:30 P.M. in the Council Chambers of the Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota. The following Board members were present: Chairman, Art Flannagan Gary Prazak Mike Sell Larry Smith Herb Polachek (Alternate) Absent by prior arrangement, Mahlon Swedberg. Arriving later, due to a previous commitment, Herb Polachek. The meeting was called to order promptly at 7 :30 P.M. The first order of business was approval of the minutes of a regular meeting held August 14, 1984, copies of which had previously been distributed to the Board. Larry Smith moved to approve the minutes as written and presented. Second by Mike Sell and upon vote carried. 84-9-29 (Map 3) Residential 3215 Kyle Avenue North Robert M. Vogel The Petition is for waiver of Section 3A.06(1 ) front setback, for 1 .6 feet off the required 35 feet to a distance of 33.4 feet from the front lot line as the house now exists to allow for a fully conforming addition to be added to the rear. The petition was in order. Consent had been obtained from all adjacent properties. Mr. Vogel was present. This waiver had been approved previously by the Board. However, "due to interest rates", the owner did not proceed and the approval lapsed after one year. Mr. Vogel reviewed his proposal to add a fully conforming addition to the rear of his existing home. The house exists as a non-conforming structure as it is 33.4 feet from Kyle Avenue at its closest point. Mike Sell said he had reviewed the past minutes that were again sent to all Board members and he had also looked at the site again and could see no problem with this proposal . The Board concurred and Mike Sell moved to approve the waiver as requested. Second by Larry Smith and upon vote carried unanimously. ��,�--; '�` Board of Zoning Appeals Page 2 September 12, 1984 84-9-30 (Map 20) Residential 1512 Boone Avenue North Richard F. Ohlgren The Petition is for waiver of Section 3A.06(3c) side setback, for 5.9 feet off the required 12 foot side setback from the south lot line to a distance of 6.1 feet from the lot line to the proposed garage addition. Mr. and Mrs. Ohlgren were present. The petition was in order. No adjacent neighbors were in attendance. Mr. Ohlgren described his present single-car yarage set somewhat detached by a roof port area. His lot is a 60 foot wide lot and because of existing construction, a detached garage to the rear is not practical . The new garage would be attached and blend architecturally in the existing roof line. The existing garage would be torn down. During discussion, the Board reviewed the possibility of narrowing the garage width to 22 feet or 21 feet in width. Mike Sell noted the separate entry as it now exists into the house and the separate entry to the garage so the framing and present steps and doorway would work out, It would be structurally difficult, if not impossible, to narrow the structure and maintain adequate strength to meet code compliance Gary Prazak noted the size of the lot and topography and said he felt tearing down the existing garage and working the new garage into the existing structure improved the overall appearance substantially and was a good trade off to the waiver necessary. Gary Prazak moved to approve the waiver as requested, noting the lot width and topography. Mike Sell seconded the motion and also suggested amending the motion to approve the existing house as it now exists on the lot. (One corner is at 34.5 feet from the front lot line at its closest point and on the north side at 5.6 feet from the side lot line (6 feet required). Gary Prazak agreed to the amended motion. The vote was called and it was unanimous for approval . The survey dated August 16, 1984, by Lot Surveys, Inc. , was labeled Exhibit "A" and filed by the secretary as part of this approval . ��'�= Board of Zoning Appeals Page 3 September 17, 1984 84-9-31 (Map 10) Residential 4315 Tyrol Crest Douglas C. Diedrich The Petition is for waiver of Section 3A.06(1) front setback, for 11 feet off the required 35 feet from Tyrol Crest to a distance of 24 feet from the lot line to the proposed addition and for 6.3 feet off the required 35 feet from June Avenue to a distance of 28.7 feet from the lot line to the proposed entry. (Note this lot fronts on three streets.) Mr. and Mrs. Diedrick were present. The petition was in order. Consent had been obtained from all adjacent property owners, none of whom were in attendance. This home is on an unusual lot which fronts a street on three sides each requiring a 35 foot setback (June Avenue, Tyrol Crest and Sussex Road). Mr. Diedrich described the present home which has no basement. This type of construction limits space for storage or expansion. The proposal is to add a master bedroom on the north side and a new front entry on the east. Both requires a waiver. The front on June Avenue requires the waiver for some pillars that are in the 35 foot area, which extend approximately 5 f eet. The Board thorouyhly discussed the existing home and the proposed construction. It was agreed that this was a very difficult and limited site and the only area to provide for any expansion was as proposed. The topography was also discussed and Mr. Diedrich described the additional landscape be planned. Mike Sell noted the Board has always guarded the front setback very carefully. However, faced with a 35 foot requirement on three sides and noting the topo- graphy of the lot and the good screening that now exists and more to be added, Sell moved to approve the waivers as requested. Lary Smith seconded the motion. Gary Prazak agreed with the comments made and also noted the topography, set- back requirements and overall improvement to an already attractive property. Upon vote, motion carried for approval unanimously. 6°1 Y� �'�`_� Board of Zoning Appeals Paye 4 September 12, 1984 84-9-32 (Map 5) Residential 4120 Golden Valley Road Mary J . Allenza The Petition is for waiver of Section 3A.06(1 ) front setback for 24 feet off the required 35 feet from Indiana Avenue to a distance of 11 feet from the west lot line to the house as it now exists to allow a fully conforming addition to the rear. The petition was in order and consent obtained from adjacent properties. No adjacent neighbors were present. The owner is ill and was represented by Mr. Robert Smith, his attorney. The proposed addition to the kitchen at the rear of the house fully conforms and Mr. Smith noted that the present non-conforming condition has existed from the time the home was built some 24 years ago. He described the need for a larger kitchen area as one of the occupants require a wheel chair and the present kitchen is small and difficult to get about in. Mike Sell noted the size and depth of this very large lot. He could not recall when Indiana Avenue was constructed, but possibly some of the yard area along it had been acquired for right-of-way at an earlier date. The house has requirements for two 35 foot setbacks, Indiana Avenue and also Golden Valley Road. Larry Smith said it appears the non-conforming side had existed for many years without an apparent detrimental effect on the neighborhood or with objections by the neighborhood. There is no alternative short of tearing a good portion of the house down. The Board concurred. Larry Smith moved to approve the waiver as requested. Second by Larry Prazak and upon vote carried. 84-9-33 (Map 12) Residential 100 North Brunswick Avenue Calvin D. Danielson The Petition is for waiver of Section 3A.06(1 ) front setback for 10 feet off the required 35 feet from Brunswick Avenue to a distance of 25 feet from the lot line to the garage at its closest point. ��� Board of Zoning Appeals Page 5 September 12, 1984 The petition was in order and consent obtained from all adjacent properties. Mr. Danielson described his present single-car garage as it is attached to the house. This is a large lot on a cul-de-sac area and no alignment problem with adjacent homes. The garage at its closest point is where the lot line offsets 15 feet to provide for the cul-de-sac. From that closest corner all other construction proposed fully conforms. The Board noted the unusual lot configuration and that except for the closest corner of the garage, it could be expanded and still conform. Larry Smith moved to approve the waiver as requested. Second by Mike Sell and upon vote carried.
