MINUTES OF A REGULAR MEETING OF THE
GOLDEN VALLEY BOARD OF ZONING APPEALS
October 9, 1984
The regular meeting of the Golden Valley Board of Zoning Appeals was held
Tuesday, October 9, 1984, at 7:30 P.M. in the Council Chambers of the Civic
Center, 7800 Golden Valley Road, Golden Valley, Minnesota.
The following Board members were present:
Mahlon Swedberg
Gary Prazak
Mike Sell
Larry Smith
Absent by prior arrangement, Art Flannagan, Chairman. Mahlon Swedberg, as past
chair, called the meeting to order promptly at 7:30 P.M.
The first order of business was approval of the minutes of a regular meetiny
held September 12, 1984.
Mike Sell moved to approve the minutes as written and presented. Second by
Larry Smith and upon vote carried.

The Petition is for waiver of Section
3A.10(1) accessory buildings for 2 feet off the
required 5 foot setback from the south
lot line to a distance of 3 feet from
the south lot line to the proposed
detached garage.
The petition was in order. Mr. Herold was present for the meeting. No
other adjacent property owners were in attendance.
Mr. Herold explained that in September 1981, the Board of Zoning Appeals
granted a waiver of front setback for 7.9 feet off the required 35 foot
setback so an addition could be added to the existing house. The house,
when built, was at 29.1 feet from the front lot line at its closest point.
At that time an existing single-attached garage was adjacent to the house
and was moved to the side and placed on a concrete slab. The slab was
poured to provide for two-car detached garage in the future. When Mr.
Herold came in for the building permit about a month ago and upon examina-
tion by the building inspector, it was noted that the garage slab was
closer to the south lot line than required.

This is a narrow lot that fronts on Jersey. Adjacent to the south lot line
where the garage is proposed is a driveway that leads to a two-f amily
dwelling east of Mr. Herold's and faces Highway 55. There is no home to
the south of Mr. Herold's property to Highway 55.
Mr. Herold explained that there is a very large oak tree that enhances not
only his property but surrounding properties. To move the garage two feet
closer to the house would result in one garage stall being inaccessible.
Based on the size of the lot and topography to cut down the tree, it would
ruin the site.
The Board discussed thoroughly with Mr. Herold his previous improvements to
the structure and noted that this is a difficult lot to locate any alter-
native to where the garage is now proposed.
Mike Sell noted that the owner has come a long way in remodeling and com-
pletion of the garage would add to the overall improvement.
Gary Prazak said that the garage as located on the south side and not
adjacent to any other home or structure is significant and does not appear
to have an impact as it would otherwise. He noted that based on the lot
size and topography and the location of the existing house, that the
tree is very desireable and an advantage if it can be retained.
Larry Smith moved to approve the waiver as requested. Second by Mike
Sell and upon vote carried.
There being no further business to come before the Board, the meeting was
adjourned at 8:00 P.M.
