03-11-86 BZA Minutes �3 � MINUTES OF A REGULAR MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS March 11 , 1986 The regular meeting of the Golden Valley Board of Zoning Ap�eals was held Tuesday, March 11, 1986, at 7:30 P.M. in the Council Chambers of the Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota. The following Board members were present: Chairman, Larry Smith Mike Sell Mahlon Swedberg Herb Polachek (alternate) Absent by prior arrangement, Art Flannagan and Margaret Leppik. The first order of business was approval of the minutes of a regular meeting held January 14, 1986 (no meeting in February) , copies of which had previously been distributed to the Board. Mike Sell moved to approve the minutes as written and presented, second by Mahlon Swedberg and upon vote carried. 86-3-3 (Map 3) Residential 3327 Noble Avenue North Frank and Carole Hansen The Petition is for waiver of Section 3A.06 3 (A) side setback, for 4.3 feet off the required 15 foot setback from the south lot line to a distance of 10.7 feet to the proposed garage addition. The petition was in order, consent had been obtained from all adjacent properties. Mr. and Mrs. Hansen were present, no others were in attendance. Mr. and Mrs. Hansen explained the proposal . The present home has an attached garage approximately 20 feet in width. The kitchen area is adjacent to the garage and is very small and they propose to add to the garage and then expand the kitchen into a portion of what is now garage. The garage would be no wider than it now is. Mrs. Hanson said they have owned the home 10 years and the proposed addition to the kitchen would make it more accessible and workable. Mahlon Swedberg said it was important to note that the home directly adjacent to this proposal is 39 feet from the side lot line. It has a detached garage to the rear and it doesn't appear that the proposed Hansen addition would have any significant effect on the adjacent neighbor. � 3 �. Board of Zoning Appeals Page 2 March 11 , 1986 Noting the topography which would limit expansion to the rear, the minimum width of the garage after expansion and the distance to the adjacent neighbor, it was the consensus of the Board that generally the proposal was non-controversial and appeared reasonable based on other similar requests that have received approval . Recognizing all of the above, Mahlon Swedberg moved to approve the waiver as requested for 4.3 feet off the required 15 feet to a distance of 10.7 feet from the south lot line to the garage addition. Second by Herb Polachek and upon vote carried. 86-3-4 (Map 9) Residential 4520 Westwood Lane Mark and Christie Berg The Petition is for waiver of Section 3A.06(a) for 6 feet off the required 15 foot side setback to a distance of 9 feet f rom the west lot line to the pro- posed addition. The petition was in order and consent obtained from all adjacent properties. Dr. and Mrs. Berg were present, no other property owners were present. Dr. Berg described the purchase of this home as a two-bedroom structure and now with two children, they need the additional room. The home when built was placed crooked on the lot and because of topography to one side of the lot. The proposed addition is actually expansion of the basement by 5 feet to allow bedrooms to be built in the basement and special emergency egress windows required by code to be placed in the five foot addition. The Board examined the drawings, foundation profile and detail of the window egress. Mahlon Swedberg said this was a highly unusual approach without any significant intrusion into the side setback that would be visible. Swedberg also noted that the adjacent home is approximately 30 feet from the side lot line so this proposed basement addition appears to be a good conservative approach to additional room in the house. Mike Sell thouyht it a very good solution without physically adding to the overall size of the house. Noting the topography, placement of the existing house at an angle on the lot and that the proposed 5 foot basement addition was required by code if the lower level was to be used for bedrooms, Mike Sell moved to appro�e the waiver as requested. Second by Herb Polachek and upon vote carried unanimously. Board of Zoning Appeals � v � Page 3 March 11 , 1986 86-3-5 (Map 20) Institutional I-4 9300 Naper Street Hennepin County Sheriff' s Radio Tower Facility The Petition is for waiver of Section 14.02 to allow expansion to the building where previous waiver conditions on the site apply. The petition was in order, consent had been obtained from adjacent properties. No adjacent owners were present. Mr. Earl Johnson, Hennepin County Project Manager, was present and explained the proposal . Also present were representatives from the Hennepin County Sheriff's Department, Harvey R. Cain, Principal Management Information Specialist, Donald H. Vodegel , Captain Radio Division, and Ovide LaBerge, Chief Deputy. Chairman, Larry Smith, asked staff liaison, Lloyd Becker, for an update on this proposal . Lloyd Becker described the previous waiver for front setback landscape along Naper Street that was granted in 1981 . This waiver was in conjunction with remodeling and expansion at that time. Lloyd Becker explained that he had reviewed this most recent proposal with the City Attorney and it was determined that the previous waiver when granted was based on all conditions existing at that time and to now expand the building again changed those existing conditions and should be addressed by the Board of Zoning Appeals. Mahlon Swedberg questioned what effect the proposed expansion would have on traffie to the facility. Captain Vodegal replied that most of the proposed addition is for new computerized dispatching equipment and while they may have some additional employees, they are spread over three shifts in a 24-hour period, the number of police and fire vehicles coming to the site for service will remain about the same. The present staff is 38 people, but with the expan- sion they are also providing additional parking for the future. The Board con- tinued a detailed informational discussion with the Hennepin County Repre- sentatives. Mahlon Swedberg noted that the proposed addition is fully conforming and this appears to be more an administrative matter. The proposed parking and setbacks all meet the current Zoning Code. Mahlon Swedberg moved to approve the request for expansion of the existing structure and parking. Second by Mike Sell and carried unanimously. � � � Board of Zoning Appeals Page 4 March 11 , 1986 Lloyd Becker reviewed a proposed ordinance amendment to Section 14.04 of the Zoning Code that had been drafted at his request by the City Attorney. There were concerns by the Board that while the proposed amendment appeared applicable to commercial and industrial properties, there may be a hardship created for the average residential property owner. Lloyd Becker agreed that may occur and before proceeding further with the amendment, he would review it again with the City Attorney and bring it back to the Board of Zoning Appeals for their review and comment at the regular meeting in April , 1986. There being no further business to come before the Board, it was upon motion, second, and vote to adjourn at 9:00 P.M.
