GOLDEN VALLEY BOARD OF ZONING APPEALS
SEPTEMBER 12, 1989
The regular meeting of the Golden Valley Board of Zoning Appeals was held
Tuesday, September 12, 1989, at 7:30 P.M. in the lower level of the Public
Safety Building, 7800 Golden Valley Road, Golden Valley, Minnesota. The
following Board members were present:

Art Flannagan
Mike Sell
Kevin McAleese
Herb Polachek, alternate
Absent by prior arrangement, Mahlon Swedberg.
The first order of business was approval of the minutes of a special
meeting held Wednesday, August 30, 1989, copies of which had previously been
distributed to the Board. Kevin McAleese asked to have the first sentence
of the third paragraph on page 4. "Kevin McAleese a cknowledged Chairman Smith's
comment" deleted from the minutes because the exchange took place af ter the
meeting had adjourned. This being acceptable to all members, Mike Sell moved to
approve the minutes as amended. Second by Art Flannagan and upon vote carried.

Jim and Kae Crawford
The Pe tition is for waiver of Section:
11.21 Subd. 7(C) (2) side setback, for 7.7 feet off the required
12.7 feet from the south lot line to a dis-
tance of 5.0 feet from the south lot line
to the proposed garage addition.
The petition was in order and consent obtained from three of four adjacent pro-
perties. Jim and Kae Crawford were present. No adjacent owners were present.
Chairman Smith asked Jim and Kae Crawford to explain why they needed this
waiver. Kae Crawford responded that they have two cars and would greatly
appreciate the added convenience of protecting themselves and their vehicles
from the elements with a two-car attached garage. She said this would also add
value to the neighborhood.
Mike Sell suggested that if the existing garage was demolished, then a new
detached two-car garage could be constructed to the rear that would meet the
Zoning Ordinance.
A discussion followed concerning this proposal. Jim Crawford was concerned
about the extensive repair that would have to be done to the house. The roof
line would have to be changed, the breezeway is part of the kitchen now and he
wasn't sure what the neighbors, who approved of the a ttached addition, would
feel about a detached garage. He said that they would probably not build if a
detached garage would be required.

Chairman Smith noted that the neighbor to the rear, Mr. Arnold K. Roland, did
not sign the petition. Kae Crawford explained that Mr. Roland was concerned
that this may set a precedence for the neighborhood. Jim Crawford interjected
that he wasn't sure if Mr. Roland would prefer a detached garage that was closer
to his property.
Mike Sell moved that the waiver as requested be approved. Second by Kevin
McAleese and upon vote carried.
89-9-29 (Map 4) Residential
2835 Kyle Avenue North
Paul and Susan Hovde
The Pe tition is for waiver of Section:
11.21 Subd. 7(A) front setback, for 7.7 feet off the required
35 feet from Kyle Avenue to a distance of
27.4 feet to the house as it exists at its
closest point, and for 4.2 feet off the
required 35 feet from Culver Road to a distance
of 30.8 feet to the house a t its closest point
as it now exists. Purpose of the waivers is to
provide for a fully conforming addition to the
south side and rear.
The petition was in order and consent obtained from four of five adjacent pro-
perties. Paul and Susan Hovde were present. No adjacent owners were present.
Acting Secretary, Gary Johnson, noted that waiver was to address an existing
condition of a house built in 1946. The proposed addition requires no further
variance.
Mike Sell noted that if the proposed addition were constructed as shown on the
survey, then the existing shed would not meet current zoning requirements. He
asked if this shed would be removed if the addition were built. Paul Hovde said
that he could do that since the shed is not on a permanent foundation.
A discussion followed between the home owners and board members regarding how
long they had lived a t this house and future intentions.
Art Flannagan moved to approve the waiver subject to the removal of the existing
shed from the side setback area. Second by Herb Polachek and upon vote carried.
There being no further business to come before the Board, it was upon motion,
secon and vote to adjourn a t 8:00 P.M.
