MINUTES OF A REGULAR MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS May 8, 1990 The regular meeting of the Golden Valley Board of Zoning Appeals was held Tuesday, May 8, 1990 at 7:30 P.M. , in the City Council Chambers, City Hall , 7800 Golden Valley Road, Golden Valley, Minnesota. The foliowing Board members were present: Chairman, Mike Sell Art Flannagan Joan Russell Larry Smith , Mahlon Swedberg The first order of business was approval of the minutes of a regular meeting held Wednesday, April 11, 1990, copies of which had previously been distributed to the Board. Larry Smith moved to approve the minutes as written and presented. Second by Mahlon Swedberg and upon vote carried. 90-5-5 (Map 12) Residential 15 Paisley Lane James Wohlford The Pe tition is for waiver of Section: 11.21 Subd. 7C (1) side setback, for 3.5 feet off the required 15 feet from the north lot line to a distance of 11.5 feet a t its closest point to the proposed addition. The petition was in order and consent obtained from all adjacent property owners. Mrs. Wohlford was present. No others were in attendance. Mr. Wohlford described the existing deck which was built at the same time the house was constructed. The deck is deteriorating and their proposal is to replace it with a 3-season porch. Their home is a corner lot with two 35 foot setback requirements. When the house was built, it was setback 45 feet from busy Glenwood Avenue. The rear of the house is the only area affording privacy. The Board discussed several structural characteristics of the pro- posed porch and noted the substantial separation that would still exist bet- ween the porch and the adjacent neighbor's a ttached garage. Mahlon Swedberg said the adjacent house is set back beyond 35 feet and it appears to him the proposed porch would have no impact on adjacent proper- ties. Mahlon Swedberg moved to approve the waiver as requested, noting the required 35 feet on two sides, the shape of the lot and the location of the existing home which leave no other alternatives for the porch. Peters The petition is for waiver of Section: 11.21 Subd. 7C (1) side setback, for 4.3 feet off the required 15 feet from the south lot line to a distance of 10.7 feet from the south lot line to the . proposed deck. The petition was in order and consent obtained from all adjacent properties. Mrs. Pe ters was present, no others were in attendance. Mrs. Pe ters described the existing concrete patio which is set up off the ground slightly because of topography. The proposed deck would be built around this patio and would project into the side setback. Currently, there is a sidewalk along the south side that leads to the existing patio. The Board discussed the height of the deck sides and noted it basically surrounds what is existing patio area. Mike Sell said this is a 100 foot wide lot and this new survey shows the south side setback to the house is 8 one hundredths of a foot less than the required 15 foot setback. Larry Smith moved to approve the waiver as requested and to include the waiver for the house as it now exists. Smith also noted the waiver for the pa tio deck was to the closest poin t and the major portion of the deck is a t the rear of the house. Art Flannagan seconded the motion and upon vote carried.
