10-09-90 BZA Minutes .� � � � MINUTES OF A REGULAR MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS October 9, 1990 The regular meeting of the Golden Valley Board of Zoning Appeals was held Tuesday, October 9, 1990, at 7:30 P.M. in the City Council Conference Room, City Hall , 7800 Golden Valley Road, Golden Valley, Minnesota. The following Board members were present: Chairman, Mike Sell Mahlon Swedberg Art Flannagan Joan Russell Herb Polachek, alternate Absent by prior arrangement, Larry Smith. The first order of business was approval of the minutes of a regular meeting held August 14, 1990, copies of which had previously been distributed to the Board. Herb Polachek moved to approve the minutes as written and pre- sented. Second by Art Flannaqan and upon vote carried. 90-1(�-22 (Map 17) Residential 215 North Edgewood Charles E. Swanson The Petition is for waiver of Section: 11.21 Subd. 7 (A) front setback, for 2.1 feet off the required 35 feet to a distance of 32.9 feet to the house as it now exists, and a proposed addition 8 feet wide added to the south side of the house in line with the present front. The petition was in order, consent obtained from adjacent properties. Mr. Swanson was present. No others were in attendance. Secretary, Lloyd Becker, provided staff background on the proposal . This property was before the Board of Zoning Appeals August 22, 1967. A waiver of front setback to 33.9 feet was granted. A new survey in 1990 shows the house built at 32.9 feet. Therefore, the existing house and pro- posed addition must be addressed again. Mr. Swanson described the proposed 8 foot addition to his home and he noted the proposed attached garage does not require a waiver as it meets the required front and side setback. Ad,iacent homes are also at less than the 35 foot front setback. Secretary, Lloyd Becker, said this home and others may have been part of an old subdivision approval where the setbacks were addressed; however, no blanket approva'1 is of record. Mike Sell noted this proposal is basically to correct the existing discrepancy. Art Flannagan concurred and moved to approve the waiver as requested. Second by Herb Polachek and upon vote carried unanimously. 90-10-23 (Map 4) Residential 2913 Perry Avenue North Edward M. Frary The Petition is for waiver of Section: 11.21 Subd. 7 (C)1 side setback, for 6.6 feet off the required 15.0 foot sid2 setback from the south lot line to a distance of 8.4 feet to the pro- posed garage addition. The petition was in order, consent obtained from ad,iacent properties. Mr. Frary was present. No others were in attendance. Secretary, Lloyd Becker, said a sim9lar request had been granted in 1984 but no construction took place and the waiver expired after one year. Mr. Frary said, at the present time, he has a very narrow single-car garage similar to others in the neighborhood. Some have been expanded to two cars. He described the structural characteristics proposed and noted the addition would meet all other code requirements. Joan Russell said her observations were that other similar garage conditions existed and there were also some detached garages. She felt the proposed addition would enhance the property. Mahlon Swedberg moved to approve the waiver as requested. Second by Joan Russell , who in doing so, noted the topography and lot conditions that existed at the time of the previous approval . Upon vote, motion carried unanimously. 90-10-24 (Map 6) Residential 1240 Toledo Avenue North Bruce & Michelle Zirbes The Petition is for waiver of Section: 11.21 Subd. 7 (A) front setback, for .8 feet of a foot off the required 35 feet from Toledo Avenue to a distance of 34.2 feet to the house as it now exists; and for 19.1 feet off the required 35 feet from Alfred Road to a distance of 15.9 feet to the attached garage as it now exists. �� � � o Board of Zoninq Appeals Page 3 October 9, 1990 The petition was in order and consent obtained from adjacent properties. Bruce and Michelle Zirbes were present. No others were in attendance. Mr, Zirbes explained their proposal which is to eliminate the present breezeway and attached single-car garage and rebuild as an attached two-car garage. The addition would extend toward Alfred Road, no closer than at present. There is also an addition at the rear that fully conforms. The recent survey done for this proposal also shows the existing house at one corner at 34.2 feet from the front lot line and this is included as part of the petition. �loyd Becker said it appears that Rlfred Road was not platted as right-of- way when this home was built and the side facing this area was developed usin� a side setback as 15 feet and now with the road established, it requires a 35 foot setback. After further discussion of the proposed garage area, Art Flanndgan moved to approue the waivers as requested noting one was only for a very small front setback at one corner as it now exists, the previous setback as a side set- back along Alfred Road when the house was built and the hardship the addi- tional 35 foot requirement now required along the south side. Second by Herb Polachek and upon vote, motion for approval carried unanimously. 90-10-?_5 (Map 17) Residential 512 Jersey Avenue North Jason Wiebesick The petition is for waiver of Section: 11.21 Subd. 7 (B) rear setback, for 11 .7 feet off the required 32 feet from the rear lot line to a distance of 20.2 feet from the rear lot line to the proposed deck. The petition was in order, consent obtained from adjacent properties. Mr. Wiebesick was present, no others were in attendance. Mr. Wiebesick said his structure is a duplex that actually faces Highway 55 but because of the lot configuration has access from Jersey Avenue. When built, the structure appears to ha��e been set as far back as possible from HiQhway 55 and any addition to the rear would impose on the rear setback. Mr. Wiebesick said his deck would be at ground level with no perimeter railinQ. It would be built to serve both units. � 17 � Board of Zoning Appeals Page 4 October 9, 1990 Mahlon Swedberg said he had visited the site and the proposed ground level deck would appear to have very little visual impact. Mahlon Swedberg moved to approve the waiver as requested, noting the lot configuration, topography and location of the existing building. Second by Joan Russell and upon vote carried unanimously.
