03-10-92 BZA Minutes I I I MINUTES OF A REGULAR MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS MARCH 10, 1992 1231 The regular meeting of the Golden Valley Board of Zoning Appeals was held Tuesday, March 10, 1992, at 7:30 P.M. in the City Council Chambers, City Hall, 7800 Golden Valley Road, Golden Valley, Minnesota. The following Board members were present: Mike Sell, Chairman Pro Tern Herb Polachek Linda McCracken-Hunt Larry Smith Don Singer, alternate . Absent by prior arrangement, Chairman Mahlon Swedberg. The first order of business was approval of the minutes of a regular meeting held February 11, 1992, copies of which had previously been distributed to the Board. Herb Polachek moved to approve the minutes as written and pre- sented. Second by Larry Smith and upon vote carried. 92-3-5 (Map 20) Residential 8541 Winsdale Street Charles & Marilynn Smith The petition is for waiver of Section: 11.21 Subd. 7(A) front setback, for 10 feet off the required 35 feet from Winsdale Street to a distance of 25 feet to the proposed addition, and for waiver of Section 11.21 Subd. 7 (1) side setback, for 7.5 feet off the required 15 feet from the north/west lot line to a distance of 7.5 feet at the closest point of the proposed addition. The petition was in order and consent obtained from all adjacent properties. Chairman Sell asked Secretary, Lloyd Becker, for an overview of this property. This is a very unusual lot configuration. The half-section map shows this to be an area of 50 foot lots with a combination of some lots with a dwelling built on two lots and others with a home on one 50 foot lot~ Lloyd Becker reviewed the previous merger of title ordinance the City had in place years back. This lot along Winsdale appears to have a part of the lot adjacent on the south attached to it to make composite of square footage to meet the Zoning Code in effect in the 1960.s. The result is a lot 231 feet wide on Winsdale, a narrow corner of 28 feet at Aquila Avenue, an east lot line 16.7 feet long and narrowing to a point at the south lot line. 1232 Board of Zoning Appeals Page 2 March lOt 1992 I Mike Sell noted the information provided in the agenda packet. This pro- perty had been before the Board in 1987 and side setback waivers were approved for a deck at the rear of the home. Sell noted the adjacent properties along Winsdale are less than 35 feet with most at 22 to 23 feet. Don Singer noted the topography to the east and said by his observations in that directiont it appeared.the adjacent home would still appear to be forward if the waivers requested are granted. The Board discussed the general areat street configuration and topography. Mr. and Mrs. Smith reviewed the plans for the additions to the frontt west and south side. Mrs. Smith said the front setback was to provide for an entrance and stairway to the upper level. The present configuration of the house makes it very difficult for any alternative to the upper level. Linda McCracken-Hunt noted the unusual shape of the lot and that the plans presented appear to address the only possibility of any reasonable addition to the existing structure. At the close of discussiont Herb Polachek moved to approve the waivers as requested and in doing so recognized the unusual lot linest the placement of the existing houset the setbacks of adjacent propertiest and the topo- graphy to the east and south. Second by Larry Smith and upon vote carried unanimously.
