08-11-92 BZA Minutes I I I 1~5 MINUTES OF A REGULAR MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS August 11, 1992 The regular meeting of the Golden Valley Board of Zoning Appeals was held Tuesday, August 11, 1992, at 7:30 P.M. in the City Council Chambers, City Hall, 7800 Golden Valley Road, Golden Valley, Minnesota. The following Board members were present: Chairman Pro Tern, Mahlon Swedberg Mike Sell Emilie Johnson Donald Singer, Alternate Lloyd Becker, Secretary/Staff Liaison Absent by prior arrangement, Chairman, Herb Polachek, and Larry Smith. The first order of business was approval of the minutes of a regular meeting held July 14, 1992, copies of which had previously been distributed to the Board. Emilie Johnson moved to approve the minutes as written and presented. Second by Mike Sell and upon vote carried. 92-8-21 (Map 8) Residential 4620 Glenwood Avenue Kurt Larsen/Mike Ashburn The petition is for waiver of Section: 11.21 Subd. 7 B & C (1) to allow for a fence 8 feet in height along the north and east lot lines. The fence would be an enclosure around an exisiting swimming pool. (Any fence over 6 feet high is considered a structure). The petition was in order. Consent obtained from all adjacent properties. Kurt Larsen and Mike Ashburn were present. No others were in attendance. Secretary, Lloyd Becker, said the Building Code does not require a permit for fences six (6) feet or under. Over 6 feet, it requires a permit and is considered a structure wall. As such, this requires a waiver if within the required setback. 1.256 Board of Zoning Appeals Page 2 August 11, 1992 I Mahlon Swedberg noted the fence at 8 feet is primarily around the existing swimming pool, which is already adjacent the side and rear lot lines. Mike Sell noted this is more an administrative matter rather than a habitable structure proposed within the setback area. Sell moved to approve the waiver as on the agenda, noting topography, loca- tion of adjacent existing homes and the large setbacks that exist for this property, (59 feet from Glenwood and 47 feet from Natchez as a corner lot).
