MINUTES OF A REGULAR MEETING OF THE
GOLDEN VALLEY BOARD OF ZONING APPEALS
November 10, 1992
The regular meeting of the Golden Valley Board of Zoning Appeals was held
Tuesday, November 10, 1992, at 7:30 P.M. in the Council Conference Room, City
Hall, 7800 Golden Valley Road, Golden Valley, Minnesota.
The following Board members were present:
Chairman, Herb Polachek
Larry Smith
Emilie Johnson
Mike Sell
Absent by prior arrangement, Mahlon Swedberg.
The first order of business was approval of the minutes of a regular meeting
held October 13, 1992, copies of which had previously been distributed to
the Board. Larry Smith moved to approve the minutes as written and pre-
sented. Second by Mike Sell and upon vote carried.

The petition is for waiver of Section:
11.21 Subd. 7 A
front setback, for 12.6 feet off the required
35 feet from Ridgeway Road to a distance of
22.4 feet to the house as it now exists at
its closest point. (Purpose of the waiver
is to provide for a fully conforming addition
on the north side.)
The petition was in order and consent obtained from adjacent properties.
Steve and Becky Aaker were present. No others were in attendance.
Secretary, Lloyd Becker, described this corner lot. The home was
constructed in 1947. Originally, it had a Ridgeway address which years
later was changed to Winnetka. A detached garage was constructed in 1976
and it appears at that time there was a staff determination that the north
lot line was the rear of the lot. The detached garage conforms to the
required setback. Viewed from Winnetka Avenue, the garage would appear to
be to the side of the house. When a building permit was requested for the
addition, the lot stakes could not be found and a survey was done. The
survey showed the closest point of the existing house toward Ridgeway did
not meet the required 35 foot setback.

Mr. and Mrs. Aaker described the proposed addition. The addition itself
meets all required setbacks. Mr. Aaker said they owned the home since
1985. At the close of discussion, Mike Sell said he felt the garage, when
built, was determined to be wholly to the rear of the house, but when viewed
from Winnetka, it appears to the side. This condition is possible on any
corner lot. The consensus of the Board was to not make any decision sub-
sequent to the front and rear determination made in 1976. Mike Sell moved
to approve the waiver as on the agenda for the house as it now exists so a
fully conforming addition may be added. Second by Larry Smith and upon
vote carried.
There being no further business to come before the Board, it was upon motion,
second, and vote to adjourn at 7:55 P.M.
