MINUTES OF A REGULAR MEETING OF THE
GOLDEN VALLEY BOARD OF ZONING APPEALS
MAY 11, 1993
The regular meeting of the Golden Valley Board of Zoning Appeals was held
Tuesday, May 11, 1993, at 7:30 P.M. in the City Council Chambers, City Hall,
7800 Golden Valley Road, Golden Valley, Minnesota.
The following Board members were present:
Chairman, Larry Smith
Emilie Johnson
Mahlon Swedberg
Herb Polachek
Mike Sell
The first order of business was approval of the minutes of a regular meeting
held April 13, 1993, copies of which had previously been distributed to the
Board.
Mike Sell moved to approve the minutes as written and presented. Second by
Mahlon Swedberg and upon vote carried.
93-5-7 (Map 4) Residential
3101 Kyle Avenue North
Harry & Mary Steen
The petition is for waiver of Section:
11.90 Subd. 4 (C)4 to provide for additional construction on a
property where a previous waiver has been
granted.
The petition was in order and consent obtained from adjacent properties.
Harry and Mary Steen were present. No others were in attendance.
Lloyd Becker, staff liaison, reviewed this proposed deck addition with the
Board. The deck is at the rear and fully conforms. It replaces an exist-
ing deck that has deteriorated badly. This item is before the Board because
of a previous waiver granted for front setback for an attached garage. The
ordinance requires any subsequent construction or activity be approved by
the Board of Zoning Appeals.
Mahlon Swedberg said there is no contention in the matter of the deck
replacement and in this particular situation approval is primarily an
administrative function in harmony with the ordinance. Mr. Steen generally
described the deck replacement and noted it will meet the setbacks.
Mahlon Swedberg moved to approve the petition as on the agenda. Second by
Herb Polachek and upon vote carried.

The petition is for waiver of Section:
rear setback, for 5 feet off the required 22
feet to a distance of 17 feet from the rear
lot line to the proposed deck at its closest
poi nt.
The petition was in order and consent obtained from adjacent properties.
Claudia and Margaret Forrey were present. No others were in attendance.
Mahlon Swedberg noted the unusual lot configuration and questioned staff
how the mean lot depth had been determined. Lloyd Becker reviewed how it
had been done, including a review by the Engineering Department. Margaret
Forrey explained the deck size and location. Only a corner of the deck
falls into the 20 percent rear yard setback.

At the close of discussion, Mike Sell moved to approve the waiver as on the
agenda. Sell noted the most unusual lot configuration and that the deck
has no affect on adjacent properties. Second by Emilie Johnson and upon
vote carried.

Secretary, Lloyd Becker, noted the next item on the agenda, 8901 Wayzata
Blvd., Ackerberg Properties, had withdrawn their petition several days earlier.

The petition is for waiver of Section:
11.21 Subd. 7 A
front setback, for 12.3 feet off the required 35
feet from Golden Valley Road to a distance of
22.7 feet to the proposed garage addition at its
closest point; and for 1.8 feet off the required
35 feet to a distance of 33.2 feet from Golden
Valley Road to the house as it now exists at
its closest corner.
The petition was in order. Consent obtained from adjacent properties.
Michael and Marjorie Mord were present. No others were in attendance.

Mr. Mord said their present single-car garage. is inadequate. The topo-
graphy drops off steeply to the side and rear and prohibits any~easonable
access for a detached garage at the rear. To add on to the side of the
existing garage would require very deep footings and concrete w~llswith
substantial fill. If approved, the existing garage area will be converted
to living space.
Mah 1 on Swedberg noted that Golden Va 11 ey Road, at thi s poi nt, is a' long ,
curve and when he examined the site, it appeared the setbacks of adjacent
homes were staggered such that the proposed garage addition would not
substantially alter existing conditions. Swedberg said he had also noted
the topography at the side and rear.
Marjorie Mord said one of the reasons they wanted more garage space is one
of their cars was stolen at night last year and it became a very costly
event. Michael Mord said entry to the garage will be from the east side.
This will provide for a turn-around area so they won1t have to back out on
Golden Valley Road.
Mike Sell said the existing topography prohibits any reasonable alternative
for a detached garage at the rear or an addition to the side. Sell noted
the curve of Golden Valley Road and the variation of adjacent setbacks.
The plan as proposed appears as good of an alternative as possible and with
the garage entry from the side and a turn-around eliminates the danger of
backing out into G01den Valley Road.' ,
Sell moved to approve the waiver as requested. Second by Herb Polachek and
upon vote carried. The Board noted that in their approval safety was as
much of a factor as the lot configuration and topography.
