MINUTES OF A REGULAR MEETING OF THE
GOLDEN VALLEY BOARD OF ZONING APPEALS

January 11, 1994
The regular meeting of the Golden Valley Board of Zoning Appeals was held
Tuesday, January 11, 1994 at 7:30 PM in the City Council Chamber, City Hall,
7800 Golden Valley Road, Golden Valley, Minnesota.
The following Board members were present: Chairman Lar~ Smith, Emilie
Johnson, Herb Polachek, Mike Sell, and Mahlon Swedberg. Also present was Mark
Grimes, Staff Liaison.
I. Approval of Minutes - November 9, 1993
MOVED by Polachek, seconded by Swedberg and motion carried unanimously to
approve the November 9, 1993 minutes as submitted.
Note, there was no Board of Zoning Appeals meeting for the month of December,
1993.

II. 4520 Westwood Lane (94-1-1)
Mark and Kristi Berg
Request: The petition is for a waiver of Section 11.21, Subd. 7 (C) (1)
side setback for .92 feet off the required 15 feet from the
west property line to a distance of 14.08 feet to the house as
it now exists at its closest point.
Purpose: To correct an existing non-conforming setback so a second
floor addition may be constructed.
The petition was in order and consent obtained from adjacent property owners.
Mark Berg was present to explain the waiver request. No other persons were in
attendance with regard to this request. Staff Liaison, Mark Grimes, provided a
staff review of the ~aiver report. the purpose of the waiver request is to
correct an existing non-conforming setback of the house in order that a second
story addition may be built above the existing foundation that is currently in
violation of the side yard setback requirement.
Mr. Berg explained that he would like to add two addition bedrooms on the upper
level. In 1986, he had received a side yard setback variance of about five (5)
feet to allow two (2) emergency exit/skylights build along the west side of the
house. This variance was granted which allowed basement bedrooms.
Mr. Berg said that the siding on the addition will be continuous with the
existing siding.

Mahlon Swedberg said that the height of the second story addition bothered him
somewhat because it will be higher than the other houses in the area. However,
Mr. Berg noted that there were only two small windows on the west side and that
there were trees that will screen the addition from other houses in the area.
Mr. Berg also noted that he did not want to place the addition to the rear of
the house because it would cause the elimination of two large oak trees.
MOVED by Sell, seconded by Polachek and motion carried unanimously to the
approve the waiver.

III. Other Business
The BZA discussed changing the time of meetings from 7:30 PM to 7 PM. It was
decided to move the meeting to 7 PM unless this time was not convenient for the
two alternate members.
Staff Liaison, Mark Grimes, reviewed the change in responsibilities within the
Inspections Department and Planning Department.
IV. Adjournment
Chair Smith adjourned the meeting
