03-08-94 BZA Minutes 1319 MINUTES OF A REGULAR MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS I March 8, 1994 The regular meeting of the Golden Valley Board of Zoning Appeals was held Tuesday, March 8, 1994 at 7:30 PM in the Council Conference Room, .CHy Hall, 7800 Golden Valley Road, Golden Valley, Minnesota. . The following Board members were present: Chairman Larry Smith, Emilie Johnson, Herb Polachek, Mike Sell, and Mahlon Swedberg. Also present was Mark Grimes, Staff Liaison. I. Approval of Mi nutes - January 11, 1994, MOVED by Swedberg, seconded by Sell and motion carried unanimously to approve the January 11, 1994 minutes as submitted. Note, there was no Board of Zoning Appeals meeting for the month of February, 1994. II. I Request: The petition is for waiver of Section 11.21 Subd. 7 (C)(2) side setback for 3.2 feet off the required 11.40 feet along the south property line (needed for the expansion of an existing non-conforming structure) and a waiver of Section 11.21 Subd. 7(C)(2) sideyard setback for 2.70 feet of the required 10.00 feet along the south property line (for construction of proposed deck). Purpose: The applicants are proposing to build a deck and 4-season enclosed room onto the rear of the house. I The petition was in order and consent obtained from adjacent property owners. Richard and Darlene Cook were present to explain the waiver request. No other persons were in attendance. Staff liaison, Mark Grimes, provided a staff report. The purpose of the waiver request is to convert an existing non- conforming setback and grant an additional sideyard setback variance to allow a deck to be constructed. Mr. Grimes noted that when the house was constructed in 1963, it was incorrectly placed on the lot. The sketch plan submitted with the building permit on 1963 indicated the house was to be built about 15 feet closer to the street and closer to the north property line. If it were located as originally intended. these waivers would not be necessary. It was also noted that the triangular shape of the lot makes a house more difficult to place on the lot. Mr. and Mrs. Cook briefly explained the building project to the Board. MOVED by Sell, seconded by Polachek and motion carried unanimously to approve the two sideyard setback variances noting that the house was incorrectly placed on the lot when it was built in 1963. 1320 Meeting of the Board of Zoning Appeals March 8, 1994 Page Two I III.
