10-26-94 BZA Minutes 1.355 MINUTES OF A SPECIAL MEETING OF THE GOLDEN VALLEY BOARD OF ZONING APPEALS I October 26, 1994 The special meeting of the Golden Valley Board of Zoning Appeals was held Wednesday, October 26, 1994 at 7 PM, City Hall Council Chambers, 7800 Golden Valley Road, Golden Valley, Minnesota. The following Board members were present: Emilie Johnson, Mahlon Swedberg, and Linda McCracken-Hunt. Also present was Mark Grimes, Staff Liaison. The first order of business was to appoint an Acting Chair. By unanimous vote, Mahlon Swedberg was elected Acting Chair for the meeting of October 26, 1994. Minutes of the Petition: 537 Meadow Lane North (94-10-45) Roberta Toutges Request: Waiver of Section 11.21, Subd. 12(A) which states that detached accessory buildings shall be no less than 5 feet distant from any lot boundary line other than a street line -- variance is for 2.9 feet off the required 5 feet -- garage site at 2.1 feet from the side rear property line; and I Purpose: Waiver of Section 11.21, Subd. 7(C)(2) which states that the side setback shall be 15% of the lot width -- variance for 5.4 feet from the required 12 feet to a distance of 6.6 feet on the north side property line. To make the present home and garage legally non-conforming so a conforming addition can be built onto the south side of the home. Acting Chair Swedberg reviewed the previous variance request made by Ms. Toutges at the August, 1994 BZA meeting. These variances were denied because alternative designs that were not as large could be considered by the applicant. Staff Liaison Mark Grimes reviewed the new application for variances. He said that the new request was solely for variances to make the existing structures legally non-conforming (garage and house). Ms. Toutges' plan is to now put an addition on the house that meets all setback requirements and is somewhat smaller. With these two variances to make the house and garage legally non- conforming, the addition that meets all requirements of the Zoning Code may be constructed. I The two variances that are being considered at this meeting could have been granted at the August meeting. However, Ms. Toutges did not asked that they be considered and the BZA did not consider these variances. Because of this misun- derstanding, the BZA is holding the special meeting to consider the two vari- ances on the Toutges property. 1~6 Special Meeting of the Board of Zoning Appeals October 26, 1994 Page Two The BZA members discussed the proposed addition. Member Swedberg felt that the revised addition is still out of character with the neighborhood. He did indi- cate he would vote for the variances. Member Johnson said she felt that the addition is an improvement to the house and that it fits better than the Toutges' previously proposed addition. Member McCracken-Hunt asked about how the existing house and new house would be "tied together". Ms. Toutges said the entire house will have a new roof, windows and stuccoed. I MOVED by Johnson, seconded by McCracken-Hunt and motion carried unanimously to approve the petition for waiver of Section 11.21, Subd. 12(A) and Subd. 7(C)(2).
