Minutes of a Regular Meeting of the
Golden Valley Board of Zoning Appeals
December 15, 1998
The regular meeting of the Golden Valley Board of Zoning Appeals was held Tuesday, December
15, 1998, at the Golden Valley City Hall, Council Conference Room, 7800 Golden Valley Road,
Golden Valley, MN. Chair Sell called the meeting to order at 7pm.
Those present were: Chair Sell and Members Lang, Polachek, and Swedberg; and Planning
Commission Representative Shaffer. Also present was Staff Liaison Mary Dold.
I. Approval of Minutes - November 24, 1998
MOVED by Shaffer, seconded by Polachek and motion carried unanimously to approve the
minutes of November 24, 1998 as submitted.
II. The Petitions:
5920 Wolfberry Lane (Map 11) (98-12-45)
Mark Benzell
Request:
Waiver from Section 11.21 , Subd. 7(A) Front Yard Setback for 6 feet off the
required 35 feet to a distance of 29 feet for the existing house at its closest
point to the front property line; and
Waiver from Section 11.21, Subd. 7(C)(1) Side Yard Setback for .3 feet off
the required 15 feet to a distance of 14.7 feet for the existing house at its
closest point to the side (west) property line.
Purpose:
To allow for the construction of conforming addition and deck onto the rear
of the house.
Chair Sell read the requested variance. Mark Benzell was in attendance.
Staff Liaison Dold reviewed the request commenting that the construction of the addition and deck
would be conforming. The variances are for the existing house which lies in the front setback by 6
feet and a side setback by .3 feet. Dold also said that staff let Mr. Benzell sign-off on a "Hold
Harmless" letter because the proposed construction was in a conforming area on the lot.
Staff Liaison Dold told the Board that the existing shed, which sits at the northwest corner of the
lot, is nonconforming in that it actually is in a front setback off of Adair Avenue. She said that 24
feet of the applicant's property abuts Adair at the northwest corner. Staff informed Mr. Benzell that
the shed would have to be moved to a conforming location on the site or demolished no later than
June 1, 1999. Mark Benzell, applicant, said the shed would be demolished.
Chair Sell informed the Board and Mr. Benzell on what the area had looked like many years ago at
which time the rear of his lot would not have abutted Adair Avenue.
MOVED by Shaffer, seconded by Polachek, and motion carried unanimously to approve the
request for variances as stated above.

III.
Other Business
A. Review of requirements for submittal of BZA application (neighbor notification).
Staff Liaison Dold informed the Board that she had called several cities abutting Golden Valley to
gather information on their application process for variances. Because many of these cities have
smaller lots, the notification process is quite different. Staff will have additional information
available at the January, 1999 meeting on this subject.
B. Continued Service of existing members on the Board for 1999
Chair Sell informed the Board that he had been requested by Mayor Anderson to find out if the
existing members are interested in continuing on the Board for another year. All members said
they would be continuing their service to the City for another year.
IV. Adjournment
Chair Sell adjourned the meeting at 7:20pm.
