Minutes of a Regular Meeting of the
Golden Valley Board of Zoning Appeals
December 21, 1999
A regular meeting of the Golden Valley Board of Zoning Appeals was held Tuesday, December
21,1999, in the Lower Level Employee Lounge, 7800 Golden Valley Road, Golden Valley, MN.
Chair Swedberg called the meeting to order at 7:00 p.m.
Those present were: Members Lang, McCracken-Hunt, Sell and Swedberg; and Planning
Commission Representative Shaffer. Also present was Staff Liaison Mary Dold.
I. Approval of Minutes - November 23, 1999
MOVED by Shaffer, seconded by Lang and motion carried unanimously to approve the
November 23, 1999 minutes with the following correction: Page 2, Paragraph 2 - the second
sentence should read, "Polachek suggested that because this is a new structure on the lot, the
Mindrum's may need to get accustomed to having a two-stall garage on the property next to
their lot."
II. The Petitions:
3211 Orchard Avenue North (Map 3) 99-12-37
Lonnv and Annette Olson
Request: Waiver from Section 11.21, Subd. 7(A) Front Yard Setback.
(Original Request)
. 1 foot of the required 15 feet to a distance of 14 feet for the existing house at its
closest point to the side property line; and
. 1 foot off the required 15 feet to a distance of 14 feet for the proposed addition
and deck at its closest point to the side property line;
Waiver from Section 11.21, Subd. 12 Accessory Structures.
. 1 foot off the required 15 feet to a distance of 14 feet for the existing garage at
its closest point tot he street property line on Lowry Terrace
(Amended request)
Waiver from Section 11.21, Subd. 12 Accessory Structures.
. .2 feet off the required 35 feet to a distance of 34.8 feet for the existing garage
at its closest point to the front setback along Lowry Terrace.
Purpose: To allow for the construction of an addition and deck onto the rear of the house.

Staff Liaison Dold presented to the Board a corrected survey from the applicant. The applicant
believed that the initial measurements were incorrect and requested the surveyor to return and
do new calculations. Dold told the Board that the new calculations showed that the existing
house did not need any variances, nor did the proposed addition, and the proposed garage only
needed a very small variance. In light of this situation, Dold told the Board that she had
informed the applicant that he did not need to attend the meeting. Swedberg, for the record,
noted that the applicant was not present at the meeting.

The Board concurred that this was a very straightforward request.
Moved by Sell, seconded by McCracken-Hunt and motion carried unanimously to approve the
requested variance for .2 feet off the required 35 feet to a distance of 34.8 feet for the existing
garage at its closest point to the front property line along Lowry Terrace.
1640 Kelly Drive (Map 15) (99-12-39)
Larry and Andrea Dunbar
Request: Waiver from Section 11.30, Subd. 7(C)(1) Side Yard Setback.
· 7 feet off the required 15 feet to a distance of 8 feet for the proposed addition at
its closest point to the side property line.
Purpose: To allow for the construction of a nonconforming addition onto the east side of the
house.

Mr. and Mrs. Dunbar were in attendance for the meeting. Staff Liaison Dold gave a brief
summary of her report noting that the existing house sits somewhat lopsided on the lot making
it difficult to stay within the required setback along the south property line. She also referred
the Board to an older survey enclosed in the packet that shows the distance of the applicant's
house to its neighbor's house, which was 54 feet.
Mr. Dunbar reviewed the proposal with the Board noting that it would be a two-story addition
and that they are making it handicapped accessible. Dunbar told the Board that he believed
that his neighbor to the south once owned much of the land in this area.
Lang said he believed the proposed addition would have very little impact on the neighborhood.
Shaffer concurred that the proposal should have little impact on the neighborhood and to the
applicant's neighbor to the south. He noted the house being skewed on the lot and the distance
to the adjoining neighbor's house.
MOVED by Shaffer, seconded by Lang and motion carried unanimously to approve the
requested variance for 7 feet off the required 15 feet to a distance of 8 feet for the proposed
addition at its closest point to the side (south) property line.
