A regul.ar meeting of the Planning Commission of Golden Valley was held on March
12, 1959 at 7:30 P.M.at 80I�O Olson Memorial Highway. Pres�dent Pennock presided
and the following members were present; Messrs. Brown, Dre�ser, Hetman, Jordan,
L�nch, Raugland, Shinder and Velz. A1so present were Clarence Scherer, Trus-�ee,
Dan Zynch, Villa.ge Building Znspeetor, and Don 5orensen,�i�l:�.age Engineer, who
acted also as recording Seeretary in Roger Ulstad�s absence,
On mot3on by Brown, seconded by Hetman, the manutes of the regular Planning
Commission meeting o� February 12, 1959 were approved.

Motion by Shinder, s�corlded by Brown to defer this matter �o Apri1 16, 1959 to

the Committee. Motion by Shinder, seconded by Hetman that the Commission recommend
preliminary approval to Couneil, subject to the above con.ditions, carried.

quently the committee was not in a position to act on it at its meeta.ng.
Individuall,y, s�me of the committee members have viewed the propasal and parcel
of land. Several questions and suggestions have been given -�o the applicants of
this petition and the Committee suggests that with the approva7. of the Chairman,
the entire Commission reviek= �he proposal this evening. Motion by Dresser
seconded. by Ve1z that the rezonino reques� be recorranended for approval to the_

DUANE W. FOSS Letter Regarding Zoning.
With reference to the above letter, the committee took this opportunity to revie�a
flur basic responsibilities as the Zoning Committec of the Planning Commis�ion. The
preface to the zoning code indicates: ��Regulating the location, size, use and height
of buildings; the arrangement of buildings on l�-ts and the density of popula-�ion in
the Village of Golden Valley, and for the purpose of promoting the health, �afety,
order, convenience, prosperity and general we].�are of said Village��, and further �
Section 13.01 under the adm.�inis-�ration of our zoning code states: "Any building,
structur�, improvement or premises may be erected, established, altered, enlarged,
used, occupied, or maintained in any District under the provisions of` the Zoning
Code for any purpose permitted in said District, but only if the Village Council,
after consideration of the ro osed develo ment and use in relatin�r} to the surround-
ing ro erties shall have determined that t e use will no-t be contrary to the public
in-�erest and a buil ing permi s all ave properly and lawfully been issued or
such use and it shall be unlawful and a violation of the Z�ning Code for any person,
firm or corporation to er�ct, establish, alter, enlarge, use, occupy or maintain
any build.ing, structure, impx°ovement or premises wit�r�ut first having such pe�mit
and complied with the provisior_s of the Zoning Code and a11 other ordinances of
the Village of Golden Valley and a11 other applicable provision.s of 1aw.'�

Therefore the Zoning Commi-�tee recommends that� no action be taken by this
Commission on the proposed letter under Item C of the a�enda and _f_urther that
the Aclministrator be advised of this action, so that further requests be sub-
mitted only via standard zonin.g petitions.
Motion by Brown, seeond�d by Hetman to accept the Committee report and Make it
part of the minutes, carried.

Application for ordinance waiver withdrawn.

The Committee checked this property� and also the building permit. The permit
showed a 15 ft. �id.�lot cl�arance. This building was built in violation and the
Committee recommenc3.s denial.. Motion by Jordan, seconded by Brown that Commission
' recommends denial of request by Couneil, carried.

The request is for a waiver of the 35 ft. setback �rom the street line. The
proposed building would be added to the Southerly end of the present school
buzlding, however it would run East and West and would be only 2�. feet from the
street line on Southeas-� corner. Inasmuch as there is ample room to the West as
well as �lsewhere on Church property, the Gommittee feels that a true haxdship
does not exist, Denial therefore is recommended.
The Commissian takes cognizance of the Ordinance Committee report, but due to the
interpre�at3.on of the status of the adjoi.ning property (Glenwood Parkwa3r) on
motion by Velz, seconded by Ratzgland, the matter is referred to the Village Council
for consideration without Planning Commission �ction, subject to the Village
attorney�s interpreta�ion of the existing ordinance as related to this problem.

The Committee feels that dividing this one large lot into two (2) as proposed
and �ranting necessary waiver would improve the general area and be to the
best inter�sts of the Vi1l.age. Committee recommends approval. Motion by
Brown, seeond.ed by Hetma._n to recommend approval and th�t this waiver would
create lots in conformance with the general plat of Yale Garden Homes, carried.
The Flanning Commissicn requested that the Village Attorney expZain �o the
Village Council the metr�od of provic�ing the Building Inspector and Planr�ing
Corrtnission with iriformation regar�ing tA�FGEF� Or iITLEt on requests for
buildinb permits on sub-standard lots.
