Pres�dent Pennock presided and the following members were present; Messrs. Brown, Dre�ser, Hetman, Jordan, L�nch, Raugland, Shinder and Velz. With reference to the above letter, the committee took this opportunity to revie�a flur basic responsibilities as the Zoning Committec of the Planning Commis�ion. The preface to the zoning code indicates: ��Regulating the location, size, use and height of buildings; the arrangement of buildings on l�-ts and the density of popula-�ion in the Village of Golden Valley, and for the purpose of promoting the health, �afety, order, convenience, prosperity and general we].�are of said Village��, and further � Section 13.01 under the adm.�inis-�ration of our zoning code states: "Any building, structur�, improvement or premises may be erected, established, altered, enlarged, used, occupied, or maintained in any District under the provisions of` the Zoning Code for any purpose permitted in said District, but only if the Village Council, after consideration of the ro osed develo ment and use in relatin�r} to the surround- ing ro erties shall have determined that t e use will no-t be contrary to the public in-�erest and a buil ing permi s all ave properly and lawfully been issued or such use and it shall be unlawful and a violation of the Z�ning Code for any person, firm or corporation to er�ct, establish, alter, enlarge, use, occupy or maintain any build.ing, structure, impx°ovement or premises wit�r�ut first having such pe�mit and complied with the provisior_s of the Zoning Code and a11 other ordinances of the Village of Golden Valley and a11 other applicable provision.s of 1aw.'� 71 RE�ULAR. The proposed building would be added to the Southerly end of the present school buzlding, however it would run East and West and would be only 2�. feet from the street line on Southeas-� corner. Inasmuch as there is ample room to the West as well as �lsewhere on Church property, the Gommittee feels that a true haxdship does not exist, Denial therefore is recommended. The Commissian takes cognizance of the Ordinance Committee report, but due to the interpre�at3.on of the status of the adjoi.ning property (Glenwood Parkwa3r) on motion by Velz, seconded by Ratzgland, the matter is referred to the Village Council for consideration without Planning Commission �ction, subject to the Village attorney�s interpreta�ion of the existing ordinance as related to this problem. r7otion earried. �� .
