11-15-62 PC Minutes �� REGULAR MEETING OF THE GOtOEN VALLEY PLANNING COMMISSION November 15, 1962 A regular meeting of the Golden Valley Planning Commission was hetd on Thursday, November 15, 1962 at 7:30 p.m. at the Civic Center , 78d0 Golden Va11ey Road, Golden Valley, Minnesota. President Brown presided and the fotlowing members were present : Bedwell , Bromschwig, pischer , Hetman, Jensen, Loughland, Lynch, Pennock, Raugtand, Shinder , Straw, VanHauer and Velz . Also present were Don Sorensen, Village Engineer ; Stanley D. Kane, Vitlage Attorney and Mike Sell , Ptanning Commission Secretary. On motion by Bromschwig, seconded by Jensen the minutes of October 11 , 19b2 were unanimously approved. PLATS MERCHANT' S INDUSTRIAL PARK - C . W. Merchant Plat C�nmittee Chairman Straw gave the following report: �'This plat was reviewed by the Ptanning Commission at the October meeting. The ptat met all the requirements of our platting regulations but the Commission voted to defer action pending the extension of Colorado Circle East to the Bury-Carlson property. The plafiter has done this and as a resutt the committee unanimously recanmends approval ." Motion by Hetman, seconded by �.oughland that the Ptanning Commission accept the committee report and recommend approval of this plat to the Council . Motion unanimously carried. ZON ING 7700 OLSON MEMORIAL HIGHWAY - Phitip Krelitz Zoning Committee Chairman Paul Velz gave the fol1owing report : �'Mr . Krelitz is requesting rezoning from residential to com- mercial category - seven tots (7 thru 14) on the West side of Rhode Istand Ave. in Cottage Grove Addition. This pro- perty lies immediately East of the Commercial zone which includes Red Owl and Warner Hardware. Mr . Krelitz proposes to construct a building approximately 70 ft . by 107 ft . which would be an extension from the present Warner Hardware building. This addition would be divided into four 20-ft . store areas fronting East and one 30-ft. store fronting South and East . In addition, he proposes a medical clinic bui1ding approximately 60 feet by 139 feet on the North end of the lots to be rezoned, and `.�'�t , Regular Meeting of the Golden Valley Pianning Commission,Nov. 15, 1gb2 ZONING (continued) the remaining area would be used for parking out to Rhode Island. Mr. Krelitz was present at the Zoning Corrnnittee meeting and presented the proposal described above. The Committee pointed out several things which were in conflict with the Zoning Code as follows: The medical building and all parking would have to be set back 75 feet from Rhode Island Ave. , and this setback would have to be landscaped as long as the property East of Rhode Island is residential . On the North a 50 foot setback would be required. Consequently, the medical clinic could not be constructed as indicated, and about 3/4 of the proposed parking spaces would be eliminated. Therefore, the proposal does not and could not conform to the requirements of the ordinance. The Committee was also concerned about establish- ing a buiiding setback line on the West side of Rhode Island. These setback requirements were recently adopted by the Viilage to encourage the development of buffer zones between different tand uses. This is a good example of how they discourage creeping commercialism and encourage larger devetopments with broad enough scope to provide transitions between zones of heavy and light use. The Corrnnittee pointed out to Mr . Kretitz the recent report of the Long Range Committee (Aug. 16, 19b2 ) which set forth a broad plan for the coordinated development of the entire area between the Commercial area West ofi Rhode Island and the residential development along Ketly Drive. The Zoning Committee is of the opinion that this broad ptan is correct from a planning viewpoint and witl result in the best devetopment of the area for the Viltage as a whole. Because the proposed development does not meet the require- ments of the Village Zoning Code, and because it is so limited in scope as to be contrary to the Commission' s - recommended plan of coordinated development for the entire area, the Zoning Committee recommends denial of the request . (One Committee member voted against denying the request ) ."' The Go�anission then deferred this request to Qec�mber 13th. REQUEST FOR PET HOSPITAL IN COMMERCIAL ZONE - Dr . R . Rainors Zoning Committee Chai�man Velz gave the fotlowing report : '�Dr . Rainors appeared before the Zoning Committee to request permission to establish a pet hospital in the commercial zone East of the Golden Valley Lanes bowting alley. He in- dicated fihat there would be no outside runs or pens, and that he had no ptans to board pets other than as required for treatment . The Committee discussed this type of business as canpared to other commercial business and concluded that an opera- tion such as proposed by Dr. Rainors might well fit into a Commerciat Zone. Therefore, the Zoning Committee recommends adding the following described use to the Commercial Zone: 'Animal hospitals where domestic animals are received for treatment, care and cure, by a du1y licensed vefierinary physician and surgeon in the customary and ordinary pur- suit of his profession, provided that no outdoor pens, runs or kennels are allowed. ' The Committee atso recommends that either the Zoning Code or Building Code be modified to require pet hospital buildings be soundproof.�� i�r . Rainors was present and answered questions the Commission had regarding his proposal . Motion by Jensen, seconded by Raugland that the Planning Commission accept the committee report and recommend to the Council that the Zoning Code be, changed to altow Pet Hospitats in a Commercia1 Zone. M�ation unanimously carried. 2001 NORTH LILAC DRIVE - Richard Hipp Zoning Committee Chairman Velz gave the following report: "Mr . DeZiet appeared before the Zoning Committee to request rezoning of a small parcel of land, approximately 1/3 acre, from Open pevelopment to Commercial . This parcel is tocated in the Northeast corner of the presently zoned commercial property at Trunk Highway No. 100 and County Road No. 66, and was overlooked when the rest of the property was rezoned. The Zoning Committee recommends approvat of this request .�� Motion by Shinder , seconded by hetman that fihe Ptanning Commission accept the committee report and recommend approval of this request to the Council . Motion unanimously carried. Motion carried with $ members voting ��Yes" and 5 members vot�ng ��No+�. ORDINANCE WAIVERS 2205 SPRUCE TRAIL - Augie Johnson Ordinance Committee Chairman Bromschwig gave the foltowing report : � "Request is for a waiver of Sec. 3 . 11 (setback from alt streets) Applicant proposes building a home facing Spruce Trail (East) . Propos�d buitding is 80 feet wide which puts it 6 feet in violation of the 35 foot setback requirement on the North. The Committee took into consideration that the tot was other than square or rectangular and was bounded by streets on three sides. The Committee also noted that the house in reality is too big for the site and was not designed to fit the lot incorporating the required set- backs. In view of the foregoing, a motion was made to apprave the request for a 6 foot waiver. Said motion was not unanimous, being approved by a vote of 3 for and 2 against . The Committee therefore recorr�nends approval ," Mr . Johnson was present and showed his plans to the Comm:i,ssion. Motion by Hetman, seconded by Velz that the Planning Commission accept the committee report recommending approval of this request and recommend approval to the Council . Motion carried with 8 member s vot i ng ��Yes" and 5 member s vot i ng "No�� . 9100 OISON MEMORIAL HIGHWAY - Gunnar Widen Ordinance Committee Chairman Bromschwig gave the following report : "This request is for a Waiver of Section 14, Platting Regulations to convey by Metes and Bounds Description a parcel of land to Dr . Rainors for his proposed Pet Hospita1 . There are no streets to be dedicated or utility easements invoived. The committee unanimousiy recommends approvai of this request, with the understanding that any further division of the property betwe�n the bowling alley and this site is to be done by platting.�� Mr .
