06-11-64 PC Minutes REGULAR MEETING ��.�� of the GO�DEN VALlEY PLANNING COMMISSION June 11 , 1964 A regular meeting of the Gotden Valley Planning Commission was held on Thursday, June 11 , 1964 at $:00 P,M. at the Civic Center , 7800 Golden Valley Road, Golden Valley, Minn�sota. Pr�sident Brown presided and the fol1owing members were present ° Shinder , Velz, Bedwell , Hetman, Loughland, Jensen, Senstad and Van Hauer . Absent members were Pennock, Lynch, Bromschwig, Discher , Raugland and Straw. Also present were Donald Sorensen, Village Enginecr; Roger Ulstad, Village Manager ; Dan Lynch, Building Inspector ; Tom Snetsinger , Acting Secr�tary, and Mrs. Fredrickson , Recording Secretary from the Engin eering Department . It was moved by Senstad, seconded by Hetman to approve the minutes of May 14, 1g64 as mailed, subject to the following corr�ctions : a) Page 2, Item C, line 1 ; "Committee Chairman Senstad read the foltowing Committee report; �� b) Page 5, Item E , paragraph 1 , line 3; "'This is a situation which has existed for about 9 years , and which just came to light when a permit to bui1d a garage on the South side was denied. �� PLATS A) Lots C � F Massolt Gardens (Leber Addition) - Jerry Green Committee Chairman Bedwell read the following Committ�e report : '�The remaining part of Lot C and all of Lot F is platted into 4 lots . It was noted that the existing house of part of Lot C is 27,7 � from Leber Lane right-of-way, That a waiver of 7.3 ' be granted to a setback of 27.7 ' . The Committee unanimously recommended approval of this plat. �� Mr . Stuart Durkee of Caswell Engineering, representing Mr . Green, was present to answer questions. It was moved by Van Hauer , second�d by Hetman and unanimously carried to accept thc Committee report and re�ommend to tt� Council approva1 of the Plat of Leber Addition , B) Third Addition of Brunswick Court - K�n Nash Corrxnittee Chairman Bedwell read the following Committee r�port: "This parcel consists of 4 lots intended for residential use. � '% �: Regu1ar Meeting of the G. V . P1anning Commission, 6/11/64 The Committee suggests that the curved portion of the existing cul -de-sac on the now through street (Adair Ave. ) be vacated and returned to Lots 1 & 2 . The Committee also noted that a vacated lane lies on the Eastern part of Lot 2. The Committee unanimously recommended approval of this plat , " Mr . Ken Nash was present to answer questions . It was moved by Loughland, second�d by Bedwell and unanimously carried to defer the matter to the July meeting for lack of information on the Piat. ZONING A) 2136 Mendelssohn Ave, No. - Olson Company Velz read the fo1lowing Committee report : "The applicant did not appear at the Committee meeting , therefore, no action was taken. �' In view of the Committee report and the applicant ' s absence from the Planning Commission meeting, the Commission took no action, B ) 750o Olson Memorial Highway - 7501 - 6th Ave, No, - Skyline Builders Velz read the following Cornmittee report : ��The applicant and their Engineer were present at the meeting and presented their proposal . This request is for a change in Zoning from Open Developrnent (Lot 46 of Aud. Sub. 322 and Tract A, R .L.S . No. 312) and Resi - dential Zoning (Lots 7,8, 9, 10, 11 , 12, 13 and part of 14, Block 1 , Gottage Grove) to Professional and Business Offices Zoning to permit the construction of a Clinic and Mortuary and to Commercial Zoning to permit the construction of a Service Station and Bank Building with office space. The rezoning of the area in question has been reviewed on a number of occasions in the past. The present rezoning petition is similar in some respects to the other requests, and the Committee reaffirms previous recommendations for this area that it be rezoned only on the condition that the p1an provide for deveTopment which would positively establish a buffer zone of Institutional and/or Multiple Dwe1ting use for the area South of Cataract Lodge and immediatel � West of the existing residential zoning abutting Kelly Drive, and that the full deveiopment would incorporate a11 of the property West of this residential zone between Glenwood Ave , and Olson Memorial Highway, Inasmuch as the proposed plan does not provide a good buffer, is � imited in scope, retains a portion of the existing Residential Regular Meeting of the G, V. Planning Commission, 6/11/64 �� ���� Zone abutting Rhode Island Ave. , and because specific tenants for the proposed buildings and uses are not known, the Committee unanimously recomm�nds denial of this rezoning request. The Committee fee1s that all th� proposals for this low area to date have been of such a nature and scope that they do not justify injecting heavier use zones into the existing residentiat areas which border the low area on two sides. �� Mr Ray White, Mr . It was moved by Bedwel1 , seconded by Hetman and unanimously carried to accept tl� Committee report and recommend denial of this zoning request to the Council , C) 655 Ottawa Ave . No. - Heilicher Bros , , Inc. - withdrawn - Velz read the following Committee report : 'rThe appiicant withdrew his request for rezoning. �� In view of the Committee report and the applicant ' s withdrawal of the request , the Commission took no action, D) 6000 Duluth Street - Apostolic Lutheran Church Velz read the following Committee report: ��Pastor Hendrickson was present to explain his proposal . This r�quest is for the proposed rezoning from existing Residential Zoning to Institutional Zoning Sub-District I-1 for parts of Lots 4 and 5, Yarnall ' s Golden Valley Outlots (Northeast Quadrant Duluth Street, also known as C.S.A.H. No. 66 and Brunswick Ave. No. ) The proposed Church will have a seating capacity of �00 and the off street parking requirements conform to the Code as does the proposed setbacks . The Committee questioned the loe�tion of the most Southerly driveway entrance on Brunswick Ave. and felt that the distance between said driveway and Duluth St, wi11 create a problem with turning movements and storage space of the traffic that will be ` generated. Pastor Hendrickson stated that this problem can be resolved and will work with the Staff to attempt a more desireb1e placement or establishment of a ��one-way�� entrance. The Committee discussed the proposal and recommends approval of this rezoning request . �' It was moved by Jensen, seconded by Shinder to accept the Committee report and recommend approval of this zoning request to the Council . Motion carried with (8) Ayes and ( 1 ) Abstaining, 1 / 6` Regular Meeting of the G. V. Planning Commission, 6/11/64 E ) S . W. Quadrant - Douglas Driv� and Medicine Lake Rd. �'�This zoning requ�st was deferred by the Planning Commission at the May 14, 1g64 meeting to permit th� Zoning Committee to make a physical inspection and to further study the area in question. As previously noted, a petition was submitted requesting that the area South of Medicine Lake Road, West of Douglas Drive, North of Sandburg School property and East of the plat of Advertising Creative Center be zoned Residential , The area is presently Open Development . After physical inspection and a further study of thc area, thc Committee fett that th� us� is definit�ly of a residential character and unanimously recommends the area be zoned Residentiat . �� Property owners from the area pres�nt were: Mr . Ear1 Johnson , representing his mot� er , Mrs, Amelia Johnson, Mr . Vern Thor , Mr . Joe Guertin and Mr . Wahl . It was moved by Hetman, s�conded by Van Haucr and unanimously, carried to accept the Committee report and recommend to the Council the approval of this rezoning request, �ff�ctive immediately. This recommendation includes cverything except that property abutting Douglas Drive, for which resid�ntiat zoning should be deferred to a later date in order not to deprive the property owners of their ri�ghts to the existing agricultura1 usage. F) Part of Aud. Sub. 322 - East of Jersey - No, of T . H. 55 Velz read the following Committee report : '�The area in question lies East of Jersey Ave, , North of Olson Memorial Highway, South of 6th Ave. No. , and West of the �xisting P. � B. 0. Zoning District , A petition has been submitt�d by the property owners requesting that the above area be zoned Residential . The area at the present time is Open pevelopment . In view of pr�vioas recommendations dated February 15, 1962, the Committee unanimous1y recommends the area be zoned Residential . �r Property owners in the ar�a present were: Mr . Klund and Mrs . ORDINANCE WAIVERS A) 2016 Gettysburg Ave. - Imperial Properties Chairman Senstad read the follawing Committee report : ��Petition is for the Waiver of Sec. 3. 11 , Zoning Regulatio ns, Front Yard Setback. Petitioner desires a waiver of 11 f�et to a setback of 24 fe�t on Lot 20, Block 1 of Lakevi�w Heights. This conf orms to past actions on similar lots on Duluth Street and permits a consistent setback in th� area. The Committ�e recommends approval of the petition , stipulating that Village Ordinances and Regulations be complied with in all other respects. �� It was moved by Velz, seconded by Bedwell and unanimously carried to accept the Committee report and recommend approval of this ordinance waiver to the Counci1 . B) 1821 Hillsboro Ave. - Imperial Properties Chairman Senstad read the following Committee r�port : '�Petition is for the Waiver of Sec. 3 . 11 , Zoning Regulations, Front Yard Setback. Petitioner desires a waiver of 13 feet to a setback of 22 fc�t on Lot 1 , Block 6 of Lakeview Heights . This conforms to past actions on similar lots on Duluth Street and p�rmits a consistent setback in the area. The Committec recommends approval of the petition, stipulating that Village Ordinances and Regulations be complied with in all other respects.'� It was moved by Loughland, seconded by Shinder and unanimously carried to accept the Committee rcport and recommend to the Council th� approval of this oreiinance waiver. c ) 8204 Duluth St. Chairman Senstad read the foll�ving report : '�Petition is for the waiver of Sec. 3. 11 , Zoning R�gulations , Front Yard Setback. q waiver of 4,5 feet to a setback of 31 .5 feet on Lot 4, 61ock 1 of proposed Duluth Terrace Third Addition is request�d, Due to gratis dedication of property on Duluth, this existing house was placed in non-conformance, but through oversight no waiver was gr�nted at this time. The Committ�e recommends approval of the petition, stipulating that Village Ordinances and Regulations be complied with in all oth�r respects.�' 1 + Q� Regular Meeting of the G. V . Planning Commission 6/11/64 It was moved by Velz seconded by Van Hauer and unanimously carried to accept the Committ�e report and recommend to the Council approval of this ordinance waiver. D) 3502 Manor Drive - D. W. Rowe Chairman Senstad read the following re port : "Petition is for the Waiver of Sec. 3. 11 , Zoning Regulations, Sideyard Setback, Petitioner desir�s a waiver of 2 feet to a setback of g feet on Lot 3 and South 1/2 of Lot 2, Block 3 of Delphian Heights Third Addition, Action October , 1963 establish�d a 25 foot front and side setback, plus 11 foot ( legal ) North side setback, Allowing a 2 foot waiver :-. will p�rmit a logical single garage addition which will not in- fringe upon the neighbor on Lot 1 nor int�rfere with his view. The Cor�nitt�e feels that while a detached garage can be built conforming, it would do �sth�tic violence as compared with the proposed plan. Thc Committee recommends approval of tk� petition, (nofi unanimously) , stipulating that Village �rdinances and Regulations be compli�d with in all oth�r r�spects. �� Chairman Senstad read the Committee report of October 10, 1963 : �'The house as located on the corner lot is set back 25 feet from Manor Drive, The Com�itte� was of the opinion that this setback could be continued para11e1 with the front and side lot line and along the radius of th� corner and allow ample room for the proposed construction. The rear yard se�back being computed at 11 feet was also established as a rear timit for said construction,. The applicant having revised his plans to fit the proposed structure within these confines has complied with the Committee request. The Committee therefore is of the opinion that the 25 foot setback as �stabiished and indicated on the plot plan would be a reasonable and fair solution to the probl�m of this corner; lot and therefore recommends approval of this request. " D. W. Rowe, t�: applicant , was present to answer questions regarding his request . It was moved by Velz, seconded by Shinder to accept the Committee' s report and recommend to the Council approval of this ordinance . waiver. Motion carried with (4) Ayes and (3) Nayes. E) 655 Ottawa Ave. No. - Heilicher Bros. , Inc. Applicant withdrew request, therefore no action was taken. G) Existing Sideyard Setback - West Constance Drive This matter was deferred until July meeting . Regular Meeting of the G. V . Planning Commission , 6/11/64 1 �``� H) 1420 Yosemite Ave. - Robert Putnam Chairman Senstad read the fol1owing report : "Petition is for the Waiver of Sec. 3 ,04, Zoning Code, creating a Substandard Lot. Petitioner desires a waiver of i0 feet to a Lot width of 90 feet, plus Sec. 14, P1atting Regulati�ns (Metes and Bounds) on Tract E of R.L.S . No. 35; (North 90� ) . The lot to be created would be adequate in area, but only 90� in width. Inasmuch as additional 1and is available to make a 100� lot, it is recanmended that every effort be made by the propon�nt to adquire an additional 10� width, It is understood by the . proponent that a 10� dedication on Yosemite Ave, will be required. The Committ�� recommends denial �of the p�tition for a waiv�r of Sec, 3 , 04. If propon�nt can create a standard lot, approval of waiv�r of Sec, 14, Platting is recommended, �� Mr . Robert Putnam and Mr . Moser were present to answer questions. It was moved by Bedwell , seconded by Shinder and unanimously carried to accept the Committee report and recommend to the Council denial of this ordinance waiver, I ) 7500 Olson Memorial Highway - 7501 6th Ave No -Sky1ine Builders App1icant withdrew reques.t, therefore no action was taken , LONG RANGE A) Alley Vacation - Block 2, Lakeview Heights President Brown read the following Committee repa- t: "This matter was deferred by the Planning Commission until the Staff contacted the owners of the lots who did not sign the petition. Since then, the owner of Lots 11 , 12 � 13, B1ock 2, Lakeview Heights, has submitted a letter stating that they do not oppose the vacation of said alley, The Committee therefore reaffirms the Planning Commission recommen- dation of vacating the alley in Block 2, Lakevi�w Heights, subject to requ i r�d Easemen ts , �� It was mov�d by Senstad, seconded by Van Hau�r and unanimously carried to accept the Committee report and r�:commend tothe Council this vacation, B) Champlain St, Right-of-Way Presid�nt Brown read the fol1�ving Comm�ttee report: "This matter was deferred by the Planning Commission on May 14 for further study. � �V Regular Meeting of the G. V. Planning Commission, 6/11/64 Standard Oil Company recently deeded a strip of land, abutting County Road 18, 50� wide and 208.7 ' in depth (Tract C, R , L.S, 1059) for street and road purposes along the South side of their property. The deeding of this land is a result of a recommendation by the P1anning Commission to 1� e Council at the time of the rezoning of the property (November , 1956) . The Council therefor� required that Standard Oil deed a strip of land for a possible future street. In view of the previous recommendations , the Committee therefore recommends tl��t ?.the V i l l age accept thi s R i ght-of-Way. " It was moved by Loughland, second�d by Jensen to accept the Cocnmittee report and recommend the acceptance of this Right-of-Way. C ) Alleys - Lakeview Heights President Brown read the fo1lowing Committee report : �'The Planning Commission at their meeting of May 14, instructed the Staff to make a study of the alleys in Lakeview Heights . The only alleys that have been vacated are those on the Sheriff� s Tower site, in addition to the pending vacation . The alley in B1ock 6 has been petitioned for grading and gravelling . The remainder of the alleys in the area hav� not been improved, but all the alleys appear to have utility po1es located thereon. The Committee recommends trat the alleys in Lakeview Heights remain as is and any further action be considered only on the basis of petitior� by property owners . " It was moved by Loughland, seconded by Van Hauer to accept the Committee report and that the Commission take no action. Motion carried unanimously. D) Residential Zoning Sub-districts R- 1 � R-2 Paul Senstad stated that the Ordinance Committee would continue to study the proposed Residential Zoning Code and ask Bob Skare to attend the next Ordinance me�ting. E) T. H. No. 55 � Winnetka Ave. Interchange President Brown read the following Committee reports �'The Committee viewed the preliminary proposed plan for the Interchange at T. N. No. 55 & Winnetka, No action was taken, inasmuch as only the above was shown, and the Committee f�lt no recommendation could be made until the entire revised plan for T. N. No, 55 be submitted. �� Don Sorensen read letters from the County r�garding the Interchange to bring the Commission up-to-date. Regular Me�ting of the G. V . Planning Commission, 6/11/64 �„�'�' It was moved by Loughland, seconded by Velz to accept tl� Committ�e report and that the Commission take no action. Motion carried unanimously. OTHER St�dy of Area North of Bassett Creek, East of Skyline Apartments Commencing at 7 : 15 p,m, the Planning Commission �nemb�rs made a fieid inspection of this area. Particular attention was given to site topography and examination of t�st boring data submitted by previous applicants for r�zonir�g, President Brown stated th�t the Commission is of the opinion that a considerable area can be developed residentially� without too much difficulty. Further detailed recommendations cannot be mad� with- out resorting to additional investigations and study. Thc Commission therefore confirms their previous recommendation that this area be developed residentially. Fences Roger Ulstad, Viliage Manager was present to ask the Planning Ca�nmission for advise in regard to fence problems developing in the Vil1age, Cl�airman Brown stated that some previous study has been given this matter, however , legal advise is required for futur� study, Staff will submit material for Planning Commission consideration . Communication to Vi l lage Counci l Chairman Brown read the letter directed from the Planning Commission to the Village Council indicating their appreciatiion for the opportunity to meet with the Council on May 12, 1964, Study of Belmont The area in question is platted in 50 foot lots and is quite low and swampy. Piling and fill would be required to develop the area. A developer had questioned the possibility of developing , the area if lots less than 100 feet in width were permitted, but withdrew because of the cost involved in developing the area. The Staff asked if the Planning Commission would consider such a proposal and felt the area is too large to consider granting permits without the Planning Commission ' s recommendations. The Planning Commission stated that the Village should be careful about setting a precedent for low area , The Planning Commission asked that the Village Staff prepare additional information for the July meeting and that the Planning Commission meet at the site at 7 : 15 P.M, on July 16th. 18l� Regular Meeting of the G.
