12-05-68 PC Minutes � ��J REGULAR MEETING OF THE GOLDEN VALLEY PLANNING COMMISSION December 5 ,1968 A regular rneeting of the Golden Valley Planning Commission was Y�eld on Thursday, December 5,1968, at 7 : 30 p .m. at the Golden Valley Civic C�nter, 7800 Golden Valley Road, Golden Valley, Minnesota. Chairman Senstad presided and the following were present : Vice- chairman Christiansen; Planner Schmid and Commissioners Silverman, Swedberg, Swanson, Provost and Franzen. Members absent : Daly, Johnston. l. APPROVAL OF MINUTE�S - November 21, 1968 MOVED by Christiansen, seconded by Swanson, unanimously carried to approve the minutes as distributed with the corrections noted. �. PROPOSED ORDINANCE CHANGE - Sections 3 .02; 3.13; 11.02; 11.08. FOSTER GROUP HOMES, GROUP HOMES AND HALFWAY HOUSES The Planner briefly explained the ordinance to the Commission, noting that this is a proposed ordinance and the staff would like comments from the Commission. The Commission reviewed the proposed ordinance point by point , and suggested the follo�ring changes . In Section 3.7-3, Provision 3 was changed to read as follows : 3 . The agency or organization responsible for the group home shall, prior to the actual operation of said group home, appoint an advisory comrnittee for the purpose of resolving problems which may arise . The advisory committee shall provide a means of communication between the agency, the neighborhood, the community, and the school district and will have among its members the following: A responsible mernber of the agency operating the home; a representative from the neighbor- hood in which the home lies; a member of the Village Police Dept . ; a member of the Human Rights Commission of Golden Valley and a representative of' the school district in which the home lies . This language was also recommended for Provision 4 in Section 11 .08. In addition, Section 3.13 Provision �4 was changed to read one mile instead of one half mile regarding density. This change also applied to Provis�.on 5 in Section 11.�8. The Commission recommended that 11.02 read as follows : The following uses and no others shall be permitted in the I-6 Institutional Zoning Sub-District : l. Foster Group Homes of more than four (4) foster cha.ldren and other group homes or halfway houses operated by social work agencies as licensed by the State of Minnesota Department of Publie We�fare; provided that said houses comply with require- ments of Section 11.0$ of this chapter The Commissioners were of the opinion that this particular specialized use should have its own zoning classification. In addition, the Commissioners recommended th�t Provisions 1 & 2 af Section 11 .Q8 be changed to read as follows ; 15 :� GQlden Valley Planning Com�hission Minutes Page 2 12�5.-6$ 1. ) No foster family group home, other group home or halfway house, shall be occupied by more than 10 adolescents including children of the foster �roup home, group nome or half way home supervisors. 2. ) The home shall be located on a minimum 12,500 sq. ft . lot and shall contain a minimum 2100 sq ft of living area exclusive of base- ments, cellars or attics including walk out basements . The Commission then instructed the Planner to send the proposed ordinance with the suggested changes to the Village Attorney for his commen�s . It was hoped that the Village At'torney would have the draft of the proposed ordinance ready for the December 1g,1968 meeting. The acting chairman of the Comrnission then asked for comments from those present . Mr. David DeCoursin from the Human Rights Commission said that the HRC is 'particularly concerned that the concept of �roup homes be accepted and that they be permit�ed' and he noted that this did not seem to be the issues with the Planning Commission. 3 . REPORT TO COUNCIL ON GROUP HOMES The Planner $ave to the Planning Commission some thoughts concerning the Commission's report which will be sent to �he Village Council on January 7,196g. He noted th�t the report should be the Commission's Report and should contain the facts the Commission believes to be pertinent to this particular problem. He also suggested that the Commissioners begin to �ot down their thoughts concerning what they think should be said, noting that the report should not be started until after the Planning Commission meeting on the 19th of December. This would give the Commission full advantage of the panel of experts who will be present at that meeting. Commissioner Franzen suggested that the report contain a list of those people con�ulted by the Staff. Commissioner Silverman seconded this thought and also suggested that emotions and hearsay be eliminated from this report. �n addition, Member F�anzen said that an historical- chronilogical record be included in the report . It was also thought that the Human Rights Commission, as a matter of courtesy, review the Planning Commission Report . ; Vice-chairman Christiansen moved that the minutes show that the Planning Commission expressed their appreciateion to the Planner and to ' Mr, David DeCoursin, Mrs. Ellen Walton and Mrs . Julia Mather for the many hours they have put into this $roup home study; seconded by Franzen and received the unanimous approval of the Commissioners present . 4 . PLANNING STUDY - Interview Dates The Planner noted that letters were sent to the six eonsultants decided upon by the Commission at the November 21st meeting. He pointed out that January has five Thursdays and it seems that the Commissiqn will be meeting every Thursday during January. The con- sultants not being interviewed have been notified. The Planner will notify the Commission, the Council and a11 other interested as to the interview dates before the December 19th meeting. � c'� � Gold�n Valley Planning Commission Minutes Page 3 . December 5,1968 5. GENERAL: NOMINATING COMMITTEE The Planner nd�d thati the terms of Commissioners Franzen, Swedberg, and Swanson are up as of December 31,1968. He also suggested that the nominating committee be appointed tonight in order to expedite the matter of appointing a chairman and vice-chairman for the year 1969. Vice Chairman Christiansen appointed members Silverman, Swanson, Swedberg and outgoing Chairman Senstad to the Nominating Committe.e . AMENDMENTS TO PLANNING BY LAWS: The Planner suggested that the following Sections of the By-laws be amended as follows : Section 2. Regular meetings of the Commission shall be held at 7 : 30 p.m. on the second and fourth Monday of each month. Attendance is required at all meetings . Absence from a third of the regularly scheduled meetings in any one year shall constitute grounds for automatic review of a member's appointment by the Council . bection 13: The Viee President shall act for the President when the President is absent or disabled. All duties of the President 's office or as a member of any committee shall temporarily devolve upon the Vice-President . The Vice-President shall serve as a member of the Board of Zoning Appeals . The Vice-president shall perform all other duties the Commission may prescribe . � The Commission MOVED to vote on these proposed By-Law changes at the December 19,1968 meeting. ORDINANCE CHANGE : Section 14 .08 (a) : The Planner noted that Section 14.08 (a) of the Zoning Code would be amended to read as follows : (Underlined portion is the proposed change . ) Section 14.�8 (a) Organization - The Vi:llage Council shall, during the first manth of each calendar year, appoint a Board of Zoning Appeals . Said Board of Zoning Appeals shall consist of five (5) members and three f3) alternate members . The Vice President of the Planning Commission shall serve as a member of the Board and the three (3) alternate members shall be appointed from among the members of the Planning Commission. Said members shall serve a one-year term." The Commission recommended approval of the noted change . REZQNING PETITION FEES; The Planner noted that the $25.OQ Rezoning Petition fee was not realistic. He noted most other communities in this area are charging $75 .00 for rezoning petition fees . The Commission recommended that $75 .00 be set as the fee required for rezoning petitions and that refunds be given only if the petit�oner withdraws his request before the Planning Commission reviews same .
